ISLAMABAD: The Supreme Court of Pakistan dismissed a curative review reference against Justice Qazi Faiz Isa.

Chief Justice of Pakistan Justice Umar Ata Bandial has issued a written order in which it has been declared that there is no scope for curative in the jurisprudence of Pakistan, therefore the curative against Justice Qazi Faiz is dismissed on the basis of withdrawal.

Justice Qazi Faiz Isa is also a senior judge of the Supreme Court and a designated Chief Justice. PTI sent a reference to remove Justice Qazi Faiz as Supreme Court judge. Nominated Chief Justice Qazi Faiz Isa challenged the presidential reference in the open court.

The Supreme Court in a majority judgment dismissed the presidential reference. The court referred the matter to the Federal Board of Revenue(FBR) for investigation in the presidential reference case judgment.

Justice Qazi Faiz had filed a review appeal on sending the matter to FBR for investigation. Justice Qazi Faiz Isa had given arguments in a personal capacity in the revision case.

ISLAMABAD: A detailed decision on the appeal in the Supreme Court against the arrest of Chairman Pakistan Tehreek-e-Insaf (PTI) on May 9 has been issued.

The detailed decision of the Supreme Court consists of 22 pages, which has been written by Chief Justice of Pakistan Umar Ata Bandial.The Supreme Court declared the Islamabad High Court’s arrest warrant illegal.

In the verdict, it has been said that Chairman PTI approached the High Court for pre-arrest bail in the Al-Qadir Trust case. At the time of biometric, law enforcement agencies forcibly entered the diary branch and arrested Chairman PTI. The LAE broke the glass in the High Court premises and tortured lawyers and staff.

In the written decision of the Supreme Court, it is written that the Chief Justice of the Islamabad High Court took notice of the incident of arrest on May 9. The Chief Justice of the High Court declared the method of arrest as wrong but the arrest as legal.

It has been said in the decision that Chairman PTI approached the Supreme Court to declare the arrest illegal. Chairman PTI was presented in the court at 4:30 on the order of the court, the court stated the events of May 9. Therefore, Chairman PTI was allowed to come to the rostrum.

The court verdict also said that the PTI chairman expressed ignorance of the events after his arrest. The court asked if he condemned the May 9 incidents. PTI chairman assured and said he never provoked his supporter to violence.

In the written judgment of the Supreme Court, it is written that the petitioner expressed his disappointment with the arrest from the premises of the Islamabad High Court, immediately after hearing the NAB Prosecutor and the Attorney General, a short order was issued, in the short order the arrest of Chairman PTI. The warrant was declared illegal.

The verdict states that the PTI chairman was allowed to meet the named people in the police guest house, but the fundamental right to justice was violated by arresting him under the cover of the court. Compliance is mandatory for all, people come to the courts with the assurance of a free environment and transparent justice.

LAHORE: Pakistan Tehreek e Insaf (PTI) has decided to file a petition against the Election Commission of Pakistan (ECP) for postponing elections in Punjab.

Addressing a press conference, senior PTI leaders Fawad Chaudhry and Asad Umar said Barrister Ali Zafar will file a plea in the Supreme Court (SC) tomorrow. They said President Dr. Arif Alvi had already announced the elections scheduled in Punjab on April 30 and added that ECP could not postpone polls.

They said a contempt of court petition will also be filed against Governor Khyber Pakhtunkhwa for not announcing the elections schedule in the province. They said 96 bars of Pakistan strongly condemned the postponement of elections in Punjab.

Fawad Chaudhry said the crackdown against PTI workers and supporters has continued across the country while 753 PTI workers have been arrested so far.  He said the arrest of PTI workers and supporters was contempt of high court orders.

He said the judiciary is under extreme pressure in Pakistan after criticisms from PML-N leadership. He hoped that supermen court judges will provide justice and millions of people attached expectations to the apex court.

He welcomed the formation of a commission to probe alleged murder attack allegations on behalf of Imran Khan by the Caretaker Chief Minister Mohsin Naqvi and said PTI will present reservations to the commission.

Former federal minister Fawad Chaudhry said PTI will hold a power show on March 25 at Minar e Pakistan Lahore which will prove referendum.

Governor KP announces to hold elections on May 28

ISLAMABAD – In accordance with a ruling of the Supreme Court, the Governor of Khyber Pakhtunkhwa, Haji Ghulam Ali, proposed to organize the elections on May 28 during the meeting of the Election Commission.

According to the details, a consultative meeting of the Election Commission regarding the elections was held in Khyber Pakhtunkhwa, in which the date of the elections was suggested in light of the Supreme Court’s decision.

Sources reported that the Governor raised concern over the current state of KP’s law and order and expressed his uncertainty over holding the elections in such circumstances.

Governor Haji Ghulam Ali has reported that the Election Commission was briefed about the security concerns prior, yet has not taken responsibility for making all the arrangements for the elections.

Furthermore, a request was made by the governor of Khyber Pakhtunkhwa to defer the elections but was denied by the Election Commission due to the Supreme Court’s decision.

Haji Ghulam Ali expressed that he was under immense pressure from the entire nation, he said “I have fulfilled my constitutional responsibility regarding the election, and I have informed the Election Commission about my concerns.”

Haji Ghulam Ali said that in pursuant to the Supreme Court’s order, he has proposed that the elections will be held on 28th May.

Governor Khyber Pakhtunkhwa’s talks

Earlier, the governor of Khyber Pakhtunkhwa, Ghulam Ali, held a press conference regarding the arrival of the Election Commission in the province. Ali pointed out that the President was consulted on the date of the elections, and that the current state of law and order in the province was precisely what had caused the attack on the census team the previous day.

He also stated that four casualties occurred in the DPO Charsadda attack, further alluding to the increase, even greater than before, of casualties in the Lakki Marwat incident today with 8 killed.

When asked about the prospects of elections in such a perilous scenario, he simply stated “If it is difficult to conduct the census, how can the election campaign be carried out safely?”

In the end, he expressed his commitment to conveying his opinion on the date of the elections in KP to the Election Commission, urging that this was the job of the Commission and not him.

ISLAMABAD: The Supreme Court of Pakistan has fixed the murder case of eminent journalist and Bol News anchor Arshad Sharif for the hearing in suo motu notice.

A five-member bench headed by the Chief Justice will hear the murder of journalist Arshad Sharif tomorrow on a suo motu notice.

The hearing on the Arshad Sharif case will be held tomorrow at eleven o’clock in courtroom number one.

It should be noted that the Supreme Court has sought a report on the investigation in the UAE and Kenya from the special Joint Investigation Team(JIT) set up to investigate the Arshad Sharif murder case.

A few weeks ago, the JIT established in the murder case of a Pakistani journalist and senior Bol News anchor Arshad Sharif, returned to Pakistan after completing its investigation.
It should be noted that the five-member special JIT was headed by DIG Headquarters Awais Ahmed, while other officers included Deputy DG Sajid Kayani from IB and Muhammad Aslam from ISI.

Apart from this, Director Cybercrime FIA Waqaruddin Syed and Muhammad Afzal from MI are included while the five-member team, investigating inspector of the case Muhammad Shahbaz was also with the team in Dubai and Kenya.

KARACHI: The Election Commission of Pakistan (ECP) has decided to conduct the elections in Khyber Pakhtunkhwa and Punjab in the light of the Supreme Court order.

According to the sources, a meeting of the Election Commission was held under the supervision of the Chief Election Commissioner Sikandar Sultan Raja, in which the decision of the Supreme Court regarding the Khyber Pakhtunkhwa and Punjab elections was considered.

Sources said that in the Election Commission meeting, the proposed dates of both provinces were consulted and it was agreed to keep the election schedule of 54 days.

Sources Election Commission said that Ramadan and Eid will be taken into consideration in the proposal of election dates and there will be final consultation with the stakeholders on the polls schedule. “If the President and the Governor consult, the Election Commission will participate.”

The Election Commission said that the preparations for the elections will be completed by April 24, and the ECP will give the date for the polls immediately after the completion of the arrangements.

The sources further said that the polls in Punjab and Khyber Pakhtunkhwa are not possible in 90 days but steps will be taken to hold the election as soon as possible.

It should be noted that in view of the decision of the Supreme Court regarding the elections in Punjab and Khyber Pakhtunkhwa, an emergency meeting of the Election Commission was held under the chairmanship of Chief Election Commissioner Sikandar Sultan Raja, in which DG Law briefed the ECP to follow the decision of the Supreme Court.

Sources said that the Election Commission has decided to resume the consultation process in light of the Supreme Court’s decision.

ISLAMABAD: The Supreme Court (SC) has sought a response from the Sindh Excise and Taxation Department regarding the vacant posts.

A three-member bench headed by Justice Ijaz ul Ahsan heard the case.

During the hearing of the details in the Supreme Court, Justice Ijaz ul Ahsan asked the Sindh Excise and Taxation Department for an answer regarding the vacant posts and asked them to tell how the recruitment was done when there was a ban on appointments.

Justice Ijaz ul Ahsan said why those who had completed the interview, test, and other stages in 2007 were not appointed.

The Secretary of Excise Department Sindh told the court that restrictions were imposed on the appointments during that time, Justice Ijaz ul Ahsan asked that there be a ban in 2007, so how the recruitments took place in 2008.

Secretary Excise and Taxation Sindh said that the ban was lifted in 2008, the court then inquired why the 2007  were not recruited when the ban was lifted in 2008.

The lawyer of the petitioner Shams Larik stated that the Sindh High Court ordered the appointment of those qualified in 2007 in 2011. The petition of the Sindh government against the decision of the Sindh High Court has been pending in the apex court for 12 years.

Justice Ijaz ul Ahsan said how many posts are vacant in Sindh Excise and Taxation Department and those who cleared all the stages for jobs in 2007 are still fighting in the courts. He remarked, “We sought all records from the department and then we will see what to do.”

Abdul Waheed, Ghulam Shabir Mallah, Bahadur Khan, Shakeel Bhatti, and Nadeem Ahmed Samoo have approached the Supreme Court.
