Accountability court to announce verdict on £190mn case on Jan 13

ISLAMABAD: A special court in Islamabad indicted Pakistan Tehreek-e-Insaf (PTI) founder and his wife, Bushra Bibi, in the Toshakhana case–II.

The Special Court Central-I Special Judge Central Shahrukh Arjumand, who presided over the hearing at Rawalpindi’s Adiala jail, framed the charges on Khan and Bushra.

Toshakhana case-II was initially investigated by National Accountability Bureau(NAB) and in the light of NAB amendments, the case was transferred to Federal Investigation Agency. In September 2024, FIA submitted the challan to the court after investigation.

A Toshakhana case was filed against PTI founder and Bushra Bibi over the Bulgari jewelery set given by the Saudi Crown Prince.

The reference said that Bushra Bibi was given a Bulgari jewelery set during her visit to Saudi Arabia from May 7 to 10, 2021. The jewelery set includes a ring, bracelet, necklace and a pair of earrings.

The reference stated that as per the evidence founder PTI and his wife illegally kept the Bulgari jewelery set, Deputy MS informed Toshakhana on May 18 2021 about estimating the value.

ISLAMABAD: The Islamabad High Court (IHC) has issued a notice to Bushra Bibi, wife of Pakistan Tehreek e Insaf (PTI) founder on the Federal Investigation Agency’s (FIA) plea pertaining to cancellation of bail in the new Toshakhana case.

Justice Miangul Hassan Aurangzeb of Islamabad High Court heard the FIA’s petition seeking bail cancellation of Bushra Bibi in new Toshakhana case. During which, FIA Prosecutor Zulfiqar Abbas gave arguments.

The FIA ​​prosecutor told the court that Bushra Bibi is misusing the bail granted by the IHC and she does not appear in most of the hearings of the trial court, so her bail should be cancelled.

On the request of FIA, the court issued a notice to Bushra Bibi and sought her reply and adjourned the hearing till next week.

Earlier, Islamabad High Court (IHC) granted bail to Bushra Bibi in new Toshakhana case and she was released from Adiala Jail.

Bushra Bibi remained in jail almost nine months. She was sentenced to 14 years imprisonment in the new Toshakhana case on January 31 this year.

Special Judge Central Shahrukh Arjumand issued a warrant for the release of PTI founder Imran Khan.

It is written in the court order that PTI founder’s bail has been approved by the High Court, if PTI founder is not wanted in any other case, he should be released.

The court has issued a written order for the release of founder PTI in the Toshakhana case-II, in which it has been said that Tariq Noon and Raja Ghulam Sajjad gave one million each to PTI founder.

ISLAMABAD: The Islamabad High Court (IHC) ordered the release of former first lady and wife of Pakistan Tehreek e Insaf (PTI) founder. Bushra Bibi on bail in the new Toshakhana case.

A hearing was held on Bushra Bibi’s bail petition in the new Toshakhana case in the Islamabad High Court.

During the hearing, Justice Gul Hassan Aurangzeb inquired that “If Bushra Bibi did not submit the gifts, then why was the founder of PTI made accused”.

Federal Investigation Agency (FIA) prosecutor Umeer Majeed explained that PTI founder was the public office holder and this case is slightly different from the Justice Qazi Faez Isa case. He said gift received by the state has to be submitted and declared.

Umair Majeed said that this case is related to such a gift which has not been deposited, there are consequences of this action and the property of the state cannot be kept before buying the gift

Justice Gul Hasan Aurangzeb said that the British Prime Minister also took gifts home with him. When everyone told him, British PM said that he has taken it according to the rules.

On which the FIA ​​prosecutor said that the National Accountability Bureau(NAB) law has a plea bargain but there is no such provision in the law.

After the arguments, the Islam High Court accepted the bail petition of Bushra Bibi in the Toshakhana case and ordered her release on bail.

ISLAMABAD: The Islamabad High Court (IHC) fixed bail petition of former first lady Bushra Bibi in the Toshakhana case-II for hearing.

Islamabad High Court Justice Miangul Hasan Aurangzeb will hear Bushra Bibi’s bail plea tomorrow for which the Registrar Office has issued a cause list.

The court had directed the registrar’s office to schedule the case this week. The court has issued a notice to the Federal Investigation Agency (FIA) for tomorrow’s hearing.

It should be remembered that Special Judge Central had rejected Bushra Bibi’s bail petition.

Toshakhana Reference-II was filed against the former Prime Minister Imran Khan and Bushra Bibi over the Bulgari jewelery set given by Saudi Crown Prince, according to which Bushra Bibi was given a Bulgari jewelery set during her visit to Saudi Arabia from 7 to 10 May 2021.

ISLAMABAD: The Accountability Court rejected the bail petition  of Pakistan Tehreek e Insaf (PTI) founder chairman Imran Khan and his wife Bushra Bibi in the Toshakhana case-II.

Special Judge Central Shahrukh Arjumand heard the plea related to the second case of Toshakhana in Adiala Jail.

During the hearing, the Federal Investigation Agency  ​​prosecutor said that the accused did not deposit the valuable seat worth Rs 71.5 million received from the Saudi government in the Toshakhana.

The  accused charged the value of the Bulgari jewelry seat only Rs 5.8 million from a private firm.

Barrister Salman Safdar, lawyer of Imran Khan and Bushra Bibi, said in his arguments Tosha Khana case-II is similar to the first reference, the same allegations and the same sworn witnesses in the first and this reference.

He said how two cases of one Toshakhana can be made. He said Bushra Bibi has been imprisoned for 7 months, this case should end after the Supreme Court’s NAB amendment decision.

Lawyer Salman Safdar said that the case was transferred from the NAB court to the Special Judge Central but the founder PTI and Bushra Bibi did not get bail, they request the court to grant bail.

ISLAMABAD: The Islamabad High Court (IHC) dismissed a petition challenging the arrest of Pakistan Tehreek-e-Insaaf (PTI) founder and Bushra Bibi in the Toshakhana case, following the National Accountability Bureau’s (NAB) filing of a reference in the accountability court.

A division bench of the Islamabad High Court, consisting of Justice Miangul Hassan Aurangzeb and Justice Babar Sattar, heard the petitions challenging the arrests of PTI founder and Bushra Bibi in connection with the Toshakhana case.

During the hearing, PTI’s lawyer Salman Safdar and NAB prosecutors Rafeh Maqsood and Umair Majeed presented their arguments.

The NAB prosecutor informed the court that a reference regarding the Toshakhana case had already been filed in the accountability court. This development, he argued, granted the right to seek post-arrest bail.

Salman Safdar, representing the PTI founder, contended that the court had previously stated that the call-up notices in the case were unclear.

The court questioned the prosecution on several points, including the validity of the call-up notices and the fundamental rights at stake.

ISLAMABAD: A new bench has been constituted to hear petitions against the arrest of founder Pakistan Tehreek e Insaf(PTI) and his wife Bushra Bibi in the Toshakhana case.

A division bench comprising Justice Miangul Hasan Aurangzeb and Justice Arbab Muhammad Tahir of Islamabad High Court will hear the Toshakhana case today(Thursday).

On July 25, Chief Justice Aamer Farooq and Justice Saman Rafat Imtiaz held a hearing, on behalf of the founder PTI, Chief Justice Aamer Farooq was asked not to listen to the case.

The lawyers said that the PTI founder filed an petition against the Chief Justice in the Supreme Judicial Council, they did not listen to the case. Chief Justice Aamer Farooq had rejected the request to leave the bench due to the filing of the reference.

ISLAMABAD: The Islamabad High Court (IHC) suspended the sentence of Pakistan Tehreek e Insaf (PTI) founder Imran Khan and his wife Bushra Bibi’s sentences in the Toshakhana case and ordered them to be released on bail.

A two-member bench headed by Islamabad High Court Chief Justice Aamer Farooq heard PTI founder Imran Khan and his wife Bushra Bibi’s request for suspension of sentence in the Toshakhana case, in which Imran Khan’s barrister Ali Zafar argued.

During the hearing, the court asked whether the appeal was scheduled for hearing today. “Will not initiate an appeal, argue for suspension of the sentence if you wish”.

On this, Ali Zafar said that instead of suspending the sentence, “we will argue on the central appeal”.

Chief Justice Aamer Farooq said that after hearing the Toshakhana case today, we cannot keep it for hearing tomorrow.

During the hearing of the case, the NAB prosecutor said that the decision has been reviewed and this is a case of suspension of sentence. On this, the court said that this is a highly commendable stand of NAB.

Later, the court suspended the sentence of PTI founder Imran Khan and his wife Bushra Bibi in the Toshakhana case and ordered them to be released on bail.
Chief Justice Aamer Farooq said that the appeal against the sentence will be decided after Eid.

It should be noted that the Toshakhana reference against Imran Khan was filed on September 5, 2022, and the court sentenced Imran Khan and his wife to 14 years in prison on January 31, 2024.

ISLAMABAD: Accountability Court Islamabad has approved the judicial remand of former prime minister and founder of Pakistan Tehreek e Insaf (PTI) in the Toshakhana case.

Islamabad Accountability Court Judge Muhammad Basheer heard the Toshakhana case against PTI founder Imran Khan in Adiala Jail, in which the former prime minister was presented in the court after completing his two-day physical remand.

During the hearing, the National Accountability Bureau(NAB) requested the physical remand of Imran Khan and asked for another three days’ remand.

The court rejected NAB’s request for physical remand and approved Imran Khan’s judicial remand.

ISLAMABAD: Pakistan Tehreek-e-Insaf(PTI) Chairman will not be a candidate for the chairmanship in the intra-party elections.

According to the sources, Chairman PTI conveyed a message to the core committee of the party from jail that he will not be a candidate for the chairman in the intra-party elections.

Sources say that due to the sentence in the Toshakhana case, there will be a new candidate as the chairman in the intra-party election and another member will be elected as the chairman in the intra-party election.

Sources said that there will be elections for PTI chairman and vice chairman and organizational positions. The chairman will approve the organizational matters and decisions of the PTI party himself.

Party sources said that Imran Khan will take part in the intra-party elections as the chairman after his sentence is over, while for now the name of the new chairman will be decided by Imran Khan himself.

ISLAMABAD: The Islamabad High Court(IHC) has fixed the plea of the former Prime Minister and Chairman of Pakistan Tehreek e Insaf(PTI) for a hearing on Monday to suspend the judgment in the Toshakhana case.

Chairman PTI’s miscellaneous petition was decided by the Registrar High Court with objections.

A two-member bench was constituted to hear the petition. Chief Justice Amir Farooq and Justice Babar Sattar are included in the bench.

The district branch of the Islamabad High Court has raised three objections how two types of pleas can be made in one petition, how relief can be sought again in the petition that has already been decided, and in the first petition for suspension of sentence. How can you ask for relief if you have not asked for it?

Chairman PTI has requested to suspend the decision of the Toshakhana case and to make the state a party in the appeal.

Earlier, the former prime minister approached the Islamabad High Court to suspend the disqualification order in the Toshakhana case.

In the petition filed on his behalf, it was contended that the Election Commission had issued a disqualification notification after the conviction in the case and declared him ineligible to contest the elections.

Chief Justice of Pakistan Umar Ata Bandial has fixed Toshakhana appeals for hearing and a three-member bench headed by him will hear on August 23.

Justice Mazahar Naqvi and Justice Jamal Mandokhail will be part of the bench.
