IHC suspends sentences of 10 convicts in May 9 cases

ISLAMABAD: Islamabad High Court (IHC) on Friday suspended the sentences of 10 individuals convicted in cases related to the May 9 and May 10, 2023 riots.

A bench comprising Justice Mohsin Akhtar Kiyani and Justice Sardar Ejaz Ishaq Khan ordered the convicts to submit bail bonds of Rs 25,000 each

During the hearing, the court said that the suspected in the FIR were accused of attacking the police and burning the police post in Faizabad. According to the record, none of the accused was arrested from the scene.

After arguing in the case, the court suspended the sentence of 10 PTI workers, including 5 Afghan nationals, convicted in May 9 and May 10 cases and ordered them to be released on bail.

According to the prosecution charge sheet, the court ordered the accused to submit the original identity cards to the Deputy Registrar to confirm their citizenship.

IHC seeks reply from FIA on acquittal pleas of PTI founder, Bushra Bibi

ISLAMABAD: The Islamabad High Court (IHC) has sought a response from the Federal Investigation Agency (FIA)  ​​on the acquittal pleas of Pakistan Tehreek e Insaf (PTI) founder and Bashra Bibi in the Tosha Khana-2 case.

ISLAMABAD: Islamabad High Court (IHC) on Thursday allowed senior advocate and Pakistan Tehreek e Insaf (PTI) leader Latif Khosa to travel abroad.

A hearing was held in the Islamabad High Court on the petition to withdraw the name of senior advocate Latif Khosa from Exit Control List (ECL).

Justice Mohsin Akhtar Kayani heard the plea of Latif Khosa. Advocate Latif Khosa appeared in the court.

The public prosecutor said that the name is in the ECL, a case is registered, on which the court inquired whether the challan has been submitted. On this lawyer said that the challan has not been submitted yet.

IHC fixes plea seeking ban on social media app X for hearing

IHC rejects PTI founder's request to transfer Toshakhana case

ISLAMABAD: The Islamabad High Court (IHC) has fixed the petition against the ban on social media app X (formerly twitter) for hearing.

Islamabad High Court Chief Justice Aamer Farooq will hear the petition on February 6.

The last hearing on the petition against the ban on X was held on April 17  2024, while the case against the X ban was scheduled on  May 2 and June 11 but could not be heard.

On November 22, a miscellaneous petition to schedule the case for early hearing was approved, after which Chief Justice Aamer Farooq directed to schedule the case after the winter vacation.

ISLAMABAD: The Islamabad High Court (IHC) has restrained the federal capital and Punjab police from arresting Pakistan Tehreek e Insaf(PTI) leader Sher Afzal Marwat till December 20.

Justice Arbab Muhammad Tahir, judge of Islamabad High Court, heard the plea regarding the provision of details of the cases of PTI leader Sher Afzal Marwat.

During the hearing, on the order of the court, Deputy Superintendent of Police (DSP) Legal presented the record of the Cell FIR in the court.

Justice Arbab Muhammad stated that  “We have given a decision regarding the power of the Executive Magistrate, on this Sher Afzal Marwat said that you have given the best landmark order”.

Sher Afzal Marwat said that a report is also to come from the IG Punjab. On this the court directed the DSP Legal to contact the Punjab government and order the records.

Sher Afzal Marwat said that his 4.1 million have been invested in the advocacy of his cases.

Sher Afzal Marwat pleaded to the court more time.

Later, court restrained the Islamabad and Punjab police from arresting Sher Afzal in any registered case till December 20.

The FIA ​​prosecutor told the court that Bushra Bibi is misusing the bail granted by the IHC and she does not appear in most of the hearings of the trial court, so her bail should be cancelled.

ISLAMABAD: The Islamabad High Court (IHC)  on Friday suspended the physical remand of journalist Matiullah Jan in a first information report (FIR) registered at Islamabad’s Margalla Police Station, which includes provisions related to anti-narcotics and anti-terrorism.

Chief Justice Islamabad High Court Aamer Farooq and Justice Arbab Muhammad Tahir heard the petition against the 2-day physical remand of Matiullah Jan.

IHC grants bail to PTI founder in Toshakhana case-II

ISLAMABAD: The Islamabad High Court (IHC) granted bail to Pakistan Tehreak e Insaf(PTI) founder in Toshakhana case-II on Wednesday .

Islamabad High Court Judge Miangul Hassan has granted bail to former prime minister in the Tosha Khana case-II.

The court has given bail to founder PTI on a bond of one million each.

The court said that it is a case of proof of overcharging of the seat, the case of duress is yet to be proved.

It should be noted that the National Accountability Bureau (NAB) arrested Pakistan Tehreek-e-Insaf founder Imran Khan and his wife Bushra Bibi in the Toshakhana case-II on July 13, 2024.

According to NAB sources, PTI founder and his wife Bushra Bibi as prime minister received gifts from Toshakhana, the gifts were bought at low prices and sold at high prices.

ISLAMABAD: The Islamabad High Court (IHC) has fixed for hearing the acquittal petitions of  Pakistan Tehreek e Insaf(PTI) founder and his wife Bushra Bibi in the £190 million  reference case for hearing.

Chief Justice Islamabad High Court Amer Farooq and Justice Miangul Hasan Aurangzeb will hear case on October 29. The previous hearing on the acquittal petitions in the Islamabad High Court was held on October 2.

It is to be remembered that the accountability court had rejected the acquittal requests of PTI founder and Bashree Bibi. The court has restrained the trial court from passing the final decision on the reference.

Both the accused have challenged the decision of the accountability court in the Islamabad High Court.

ISLAMABAD: The Islamabad High Court (IHC) ordered the formation of a medical board for the check-up of former prime minister and Pakistan Tehreek e Insaf (PTI) founder.

The Islamabad High Court, while dealing with the petition of founder PTI Imran Khan, said that the founder of PTI is 72 years old and former prime minister is under-trial prisoner.

The court said that the security measures in Adiala Jail cannot hinder the check-up of a Class B prisoner.

The Islamabad High Court said in its decision that the Executive Director Pakistan Institute of Medical Sciences(PIMS) should form a board for the medical examination of the founder PTI.

The court said that a copy of the court order should also be sent to the Superintendent Adiala Jail for implementation.

It should be remembered that PTI founder Imran Khan had filed a request for a medical check from his personal physicians.

A hearing was held on Bushra Bibi’s bail petition in the new Toshakhana case in the Islamabad High Court.

During the hearing, Justice Gul Hassan Aurangzeb inquired that “If Bushra Bibi did not submit the gifts, then why was the founder of PTI made accused”.

Federal Investigation Agency (FIA) prosecutor Umeer Majeed explained that PTI founder was the public office holder and this case is slightly different from the Justice Qazi Faez Isa case. He said gift received by the state has to be submitted and declared.

Umair Majeed said that this case is related to such a gift which has not been deposited, there are consequences of this action and the property of the state cannot be kept before buying the gift

Justice Gul Hasan Aurangzeb said that the British Prime Minister also took gifts home with him. When everyone told him, British PM said that he has taken it according to the rules.

On which the FIA ​​prosecutor said that the National Accountability Bureau(NAB) law has a plea bargain but there is no such provision in the law.

After the arguments, the Islam High Court accepted the bail petition of Bushra Bibi in the Toshakhana case and ordered her release on bail.

ISLAMABAD: The Islamabad High Court (IHC) ordered Capital Development Authority(CDA) to de-seal Khyber Pakhtunkhwa House (KP-House).

Islamabad High Court Chief Justice Amer Farooq heard the request of the Khyber Pakhtunkhwa government, in which CDA’s lawyer gave arguments.

During the hearing, CDA’s lawyer said that illegal construction has taken place and some dues are still pending, the first notice was given in this regard in 2014.

IHC accepts intra-court appeal regarding election tribunals

A division bench of high court declared the ICA as maintainable against the verdict of single member bench.

The order said that the petitioner stated that election tribunals were appointed under article 225 of the Constitution.

It stated that as per the judgment of the top court the appointment of judges couldn’t be made in tribunals without the  consultation with chief justice of the concerned high court.

ISLAMABAD: The Islamabad High Court (IHC) has stopped Shaheed Zulfiqar Ali Bhutto Medical University (SZABMU) from announcing Medical and Dental College Admission Test (MDCAT) results.

Islamabad High Court Justice Arbab Muhammad Tahir issued a 3-page order and said in the judgment that SZABMU should not release the results of MDCAT test.

Students who appeared for the MDCAT for medical admissions have filed a petition for re-conducting MDCAT exam.

The court has issued notices to the Federal Ministry of Health and other parties for September 26. The order said that the court was told today that as the university has not yet declared the results, the Additional Attorney General should immediately inform the university about the stay order.

The students appearing for the MDCAT exam had approached the Islamabad High Court, stating that the papers of other provinces were very easy, so there were a large number of students scoring more than 190 marks, but our paper was  out of syllabus. , which made a huge difference to the result.

A student said there were more than 20 questions in the paper which were out of syllabus, not only that, but when he came home and checked the questions he had corrected. His ‘key’ was also given wrongly.

The students said that when their parents went to the SZABMU and when the matter was raised there, the vice chancellor left from the back door and also called the police. What happened, the registrar was laughing while standing there.

IHC stops law enforcers to arrest Salman Akram Raja till tomorrow

ISLAMABAD: The Islamabad High Court(IHC) has restrained law enforcers Pakistan Tehreek e Insaf leader Salman Akram Raja from being arrested in any case till tomorrow.

The PTI MNAs arrested in connection with cases registered against them following the September 8 rally.

The five Pakistan Tehreek-e-Insaf (PTI) MNAs, including Amir Dogar, approached the Islamabad High Court (IHC) challenging the eight-day physical remand order.

The petitioners stated that as elected members of the National Assembly they were illegally arrested from the assembly premises without any reason and taken to an unknown location.

IHC approves bail of ex-MNA Ali Wazir

ISLAMABAD: The Islamabad High Court (IHC) has approved the bail of former Member National Assembly Ali Wazir.

A two-member bench comprising Justice Babar Sattar and Justice Sardar Ejaz Ishaq Khan of the Islamabad High Court granted bail to Ali Wazir on a bond of Rs 25,000.

Earlier, the anti-terrorism court had rejected Ali Wazir’s bail, after which the former member of the assembly approached the Islamabad High Court for bail.

It should be noted that former MNA Ali Wazir is currently imprisoned in Adiala Jail and a case of terrorism has been registered against him.

IHC grants 15-days protective bail to Aliya Hamza

ISLAMABAD: The Islamabad High Court (IHC) granted 15 days protective bail to the Pakistan Tehreek-e-Insaf(PTI) leader Aliya Hamza Malik.

A hearing on Aliya Hamza’s security bail applications was heard in the Islamabad High Court. Justice Miangul Hassan Aurangzeb heard the petitions.

During the hearing, Justice Miangul Hasan Aurangzeb inquired that Alia Hamza stayed in jail for how many days. On this, lawyer Aliya Hamza said that she spent 15 months and 6 days in jail.

The court asked Aliya Hamza’s lawyer how many days do you need. The lawyer requested to give us two weeks’ time.

The court accepted the plea and granted a 15-day protective bail and restrained the police from arresting Aliya Hamza.

The High Court ordered Aliya Hamza to appear before the concerned courts within 15 days.

IHC dismisses PTI founder, Bushra Bibi’s pleas against arrest

ISLAMABAD: The Islamabad High Court (IHC) dismissed a petition challenging the arrest of Pakistan Tehreek-e-Insaaf (PTI) founder and Bushra Bibi in the Toshakhana case, following the National Accountability Bureau’s (NAB) filing of a reference in the accountability court.

A division bench of the Islamabad High Court, consisting of Justice Miangul Hassan Aurangzeb and Justice Babar Sattar, heard the petitions challenging the arrests of PTI founder and Bushra Bibi in connection with the Toshakhana case.

During the hearing, PTI’s lawyer Salman Safdar and NAB prosecutors Rafeh Maqsood and Umair Majeed presented their arguments.

The NAB prosecutor informed the court that a reference regarding the Toshakhana case had already been filed in the accountability court. This development, he argued, granted the right to seek post-arrest bail.

Salman Safdar, representing the PTI founder, contended that the court had previously stated that the call-up notices in the case were unclear.

The court questioned the prosecution on several points, including the validity of the call-up notices and the fundamental rights at stake.
