SC directs govt for comprehensive report on slums

ISLAMABAD: The Constitutional Bench of the Supreme Court (SC) has sought a slums(Katchi abadis) policy report from the federal government within two weeks.

The Constitutional Bench of the Supreme Court heard the slums (Katchi Abadis) clearance case of the Capital Development Authority (CDA) and sought the federal government for a report on slums within two weeks.

Justice Aminuddin, head of the Constitutional Bench, has said that the power to regulate informal housing settlements lies with the provinces and local governments.

Justice Jamal Mandokhail has inquired that what can the federal government legislate on the provincial authority.

Justice Rizvi said that the land mafia build slums on the banks of the drains. Slums and houses are built on plots of public facilities. Tell the government what measures it has taken to prevent slums.

Counsel CDA while arguing in the court said that Capital Development Authority has notified 10 slums. First of all, the definition of slum should be defined.

Justice Jamal Mandokhail said that if there is any encroachment other than these slums, government should take action as there are laws against illegal possession. On this, the CDA lawyer informed the court that the court itself has issued an stay order against the release of possession.

SC seeks report from CDA on illegal constructions in Margala Hills

ISLAMABAD: The Supreme Court has sought a report from the Capital Development Authority (CDA) on illegal constructions in Margalla Hills.

The Supreme Court’s constitutional bench, led by Justice Ameenuddin Khan, heard the case regarding unlawful constructions in the Margala Hills. During which the CDA lawyer and Director General Environment appeared before the court.

On this occasion, the lawyer of Monal Restaurant said that our restaurant was demolished on the order of the Supreme Court Constitutional Bench, but there are still around 134 hotels, restaurants and kiosks in Margalla Hills.

Justice Mazhar asked how many illegal constructions are currently established in Margalla Hills. On this Municipal Corporation’s Lawyer said that 80 to 132 constructions are left on Margalla Hills, while Islamabad Club also comes in Margalla Hills National Park.

On this occasion, Justice Naeem Akhtar said that in the master plan of 1960, the Supreme Court was also built within the boundaries of Margalla National Park, the CDA should first look into the illegal constructions around Monal.

Justice Jamal Khan Mandokhail asked whether the decision of the Supreme Court was only for Monal. The court has set the rules regarding the construction in Margalla Hills, why does CDA not do its job.

Justice Mussarat Hilali said that why CDA is violating court orders?

The DG Environment told the court that more than 50 kiosks are currently running in Margalla Hills which are causing environmental problems in Margalla Hills.

The court orders restrained the demolition of the booths.

IHC orders CDA to de-seal KP House

ISLAMABAD: The Islamabad High Court (IHC) ordered Capital Development Authority(CDA) to de-seal Khyber Pakhtunkhwa House (KP-House).

Islamabad High Court Chief Justice Amer Farooq heard the request of the Khyber Pakhtunkhwa government, in which CDA’s lawyer gave arguments.

During the hearing, CDA’s lawyer said that illegal construction has taken place and some dues are still pending, the first notice was given in this regard in 2014.

On this, Justice Amer Farooq spoke to the lawyer of CDA that “You can do it according to the law, if there is anything, notice it, they will see it, don’t act like you are targeting someone, today, I will pass the order and de-sell the house”.

CDA’s counsel said that the lease of KP House had expired in 2014. On this, the Chief Justice asked when CDA had issued notices. A notice should have been issued even before sealing the house, “It is a shame to seal a provincial house, I am ordering to de-seal the KP House”.

Later, the court ordered the de-sealing of Khyber Pakhtunkhwa House.

ISLAMABAD: Federal Interior Minister Mohsin Naqvi took important decisions to make Islamabad a world-class city in upcoming years.

Interior Minister Mohsin Naqvi has banned the purchase of petrol motorcycles in the federal capital and said that in order to reduce environmental pollution.  The Capital Development Authority (CDA) will buy only electric bikes in the future and eco-friendly electric buses will be run for the citizens of Islamabad.

He said that international standard emergency services will be provided to the citizens of Islamabad and it has been decided to transfer the emergency services from Metropolitan Corporation Islamabad to CDA.

According to the Minister of Interior, the establishment of Capital WASA will also be implemented soon and the related issues for the establishment of Capital Waste Management Company will be finalized soon.

ISLAMABAD: The Islamabad High Court (IHC) reserved judgment on the petition against the sealing of the Pakistan Tehreek e Insaf(PTI)  central secretariat and the operation of the Capital Development Authority (CDA).

Islamabad High Court Justice Saman Rafat Imtiaz heard the petition in which lawyers Shoaib Shaheen and Umeer Baloch appeared in the court on behalf of PTI leader Omar Ayub.

CDA lawyer Hafiz Arafat and the State Council appeared on behalf of the district administration.

During the hearing, PTI’s counsel argued that CDA had placed notices in its records but did not mention the current notice and that CDA had committed fraud. The CTD did not send notices to PTI but to Sartaj Ali.

Shoaib Shaheen said that it was stated in the media that we were handing over land to Sartaj Ali, at the time of the operation he also told the media that we did not notify PTI.

The CDA lawyer said in the court that he believed that he bought the commercial plot and changed its use. The commercial plot was used for the party, which affected the people there. They built more on it as much as was allowed.

On this, the court asked the CDA lawyer who noticed it had been said that this plot could not be used for any other purpose.

The court said, “We have seen several cases in which the CDA sometimes gives notice to one and sometimes to the other. You don’t give notice to the landlord and the tenant in such cases so that the matter ends at once.”
