Karachi: The Sindh Government’s decision to purchase double cabin vehicles for assistant commissioners(ACs) has been challenged in the Sindh High Court.

Jamaat-e-Islami Member of Sindh Assembly Muhammad Farooq approached the Sindh High Court on the issue of purchase of double cabin vehicles for Assistant Commissioners and filed a petition through Usman Farooq Advocate.

Jamaat-e-Islami Member of Sindh Assembly Mohammad Farooq said that SGA & CD has written a letter for the release of funds for vehicles. Two billion rupees is being released for 138 double-cabin vehicles. This decision of Sindh government is unnecessary and misuse of treasury.

In the petition, it was said that despite the country’s economy being under severe pressure, luxury vehicles are being purchased for Sindh government officers.

The petitioner said that the money of the taxpayers of the province should be spent on the welfare, treatment and education of the people of the province. The vehicle purchase system is also not transparent.

Usman Farooq Advocate said that the notification issued by the Sindh government should be suspended and the purchase of vehicles should be stopped until the final decision and the fund should be ordered to be spent on public welfare projects.

Justice Shafi Siddiqui appointed as permanent Chief Justice of SHC

KARACHI: The Judicial Commission of Pakistan (JCP) has approved the permanent appointment of Acting Chief Justice Sindh High Court Justice Muhammad Shafi Siddiqui.

Justice Shafi Siddiqui will be the 27th Chief Justice of Sindh High Court.

Justice Muhammad Shafi Siddiqui was born on 12th August 1965, obtained his LLB degree after B.S. and started his career in 1992 as an Advocate Subordinate Courts.

Justice Muhammad Shafi Siddiqui was enrolled as a High Court Advocate in 1994 and enrolled as an Advocate in the Supreme Court in 2008.

He was sworn in as a judge of the Sindh High Court in 2012, while former Chief Justice Aqeel Ahmad Abbasi was serving as Acting Chief Justice since his appointment to the Supreme Court.

Now Justice Muhammad Shafi Siddiqui will take oath as the 27th Chief Justice of Sindh High Court after the approval of the Judicial Commission of Pakistan and the Parliamentary Committee.

Justice Shafi Siddiqui as a judge of Sindh High Court has delivered judgments in 4205 cases so far, more than 1000 cases have been published in various law journals.

Justice Shafi Siddiqui’s judgments include Constitutional, Taxation, Customs and High Court Appeals.

JCP recommends names of six SHC judges for permanent

ISLAMABAD: Judicial Commission of Pakistan(JCP) has recommended six names of judges for permanent appointments in the Sindh High Court (SHC).

A meeting of the Judicial Commission was held under the chairmanship of the Chief Justice of Pakistan, Justice Qazi Faiz Isa, in which six additional judges were recommended to be made permanent in the Sindh High Court.

According to sources, the 6 judges unanimously recommended by the Judicial Commission to be permanent include Justice Abdul Rehman, Justice Jawad Sarwana, Justice Sana Minhas, Justice Khadim Soomro, Justice Ijaz and Justice Amjad.

Sources say that in the Judicial Commission meeting, it has also been recommended to appoint Acting Chief Justice Balochistan High Court Justice Hashim Khan Kakar as the permanent Chief Justice of Balochistan.

Court awards life imprisonment to man over killing three children

KARACHI: The local court of Karachi sentenced the accused to life imprisonment for strangulating three minor children.

In the court of Additional District and Sessions Judge West, the case of strangulation of 3 minor children was heard.

After being found guilty, the court sentenced the accused Hasnain to life imprisonment and a fine of RS 1.5million.

According to the prosecution, the accused killed 12-year-old Nimra, 7-year-old Ali, and a 4-year-old child by strangulation in 2016.

According to the police, the children’s father, Sharifuddin, had registered a case at the Mominabad police station.

According to the lawyer of the plaintiff Liaqat Gabol, the accused Hasnain used to work at the food center of the plaintiff’s case, the accused has killed three children, and he should be sentenced to death.

Karachi: The Sindh High Court(SHC) rejected the petition against the appointment of Caretaker Chief Minister Sindh Justice (R) Maqbool Baqar as inadmissible.

In the Sindh High Court, a petition was heard against the appointment of caretaker Chief Minister Sindh Justice (r) Maqbool Baqar, in which the petitioner stated that under Article 207 of the Constitution, Justice (r) Maqbool Baqar cannot become the caretaker chief minister.

On the stand of the petitioner, Justice Yousuf Ali Sayeed said that the petitioners are quoting the wrong law and he should refer to the Pakistan Services Rules.

Ibrahim Abro advocate said in his arguments that Justice (r) Maqbool Baqar has retired from the Supreme Court on April 4, 2022.

During the hearing, Chief Justice Sindh High Court Ahmed Ali Sheikh clarified that Maqbool Baqar is a retired judge of the Supreme Court and the lawyer should speak respectfully.

After hearing the arguments of the parties, the Sindh High Court dismissed the petition against the appointment of caretaker Chief Minister Sindh Justice (R) Maqbool Baqar as inadmissible.

ISLAMABAD: The Election Commission of Pakistan (ECP) announced a verdict in the alleged rigging case and ordered the recounting of the votes in six Union Councils (UCs) of Karachi.

Jamaat-e-Islami filed a petition against the alleged rigging and irregularities in Sindh Local government (LG) elections. Following the plea, the ECP directed the recounting of votes in six Union Councils (UCs).

JI had challenged the result of six UCs which include Mominabad UC-3, Manghopir UC-12, Gulshan-e-Iqbal UC-1, Orangi UC-3, 7 and 8.

It is pertinent to mention here that the Sindh High Court(SHC) served notices to parties over a petition of Hafiz Naeem ur Rehman for election in the remaining 11 union committees of Karachi.

Jamaat Islami Karachi’s chief Hafiz Naeem ur Rehman had filed a plea in the high court seeking an order for election in the remaining union committees of the city.

The court has summoned a reply from the respondents within 10 days.

Hafiz Naeem said that local council elections were not held at 11 seats of UC chairman and vice chairman in Karachi owing to the demise of candidates or for some other reasons.

ISLAMABAD: The Supreme Court (SC) has sought a response from the Sindh Excise and Taxation Department regarding the vacant posts.

A three-member bench headed by Justice Ijaz ul Ahsan heard the case.

During the hearing of the details in the Supreme Court, Justice Ijaz ul Ahsan asked the Sindh Excise and Taxation Department for an answer regarding the vacant posts and asked them to tell how the recruitment was done when there was a ban on appointments.

Justice Ijaz ul Ahsan said why those who had completed the interview, test, and other stages in 2007 were not appointed.

The Secretary of Excise Department Sindh told the court that restrictions were imposed on the appointments during that time, Justice Ijaz ul Ahsan asked that there be a ban in 2007, so how the recruitments took place in 2008.

Secretary Excise and Taxation Sindh said that the ban was lifted in 2008, the court then inquired why the 2007  were not recruited when the ban was lifted in 2008.

The lawyer of the petitioner Shams Larik stated that the Sindh High Court ordered the appointment of those qualified in 2007 in 2011. The petition of the Sindh government against the decision of the Sindh High Court has been pending in the apex court for 12 years.

Justice Ijaz ul Ahsan said how many posts are vacant in Sindh Excise and Taxation Department and those who cleared all the stages for jobs in 2007 are still fighting in the courts. He remarked, “We sought all records from the department and then we will see what to do.”

Abdul Waheed, Ghulam Shabir Mallah, Bahadur Khan, Shakeel Bhatti, and Nadeem Ahmed Samoo have approached the Supreme Court.

The Sindh High Court accepted the petition of the residents of Burns Road and instructed that Burns Road and surrounding roads should not be closed during evening hours.

Court remarked that basic rights of citizens cannot be removed for food street and ordered to immediately remove all encroachments from roads and footpaths.

The petitioner stated that even the ambulance cannot allow to pass due to road closure.

The petitioner further stated that residents face severe hardship during evening hours.

The lawyer said closure of Burns Road does not affect the specific area but also disturbed the traffic of Liaquatabad as well as from Malir to Tower.

KARACHI: A petition has been filed in the Sindh High Court (SHC) against the increase of fuel prices as well as the mini-budget presented in the National Assembly.

Moulvi Iqbal Haider claimed in the petition that the federal government had illegally presented the mini-budget in the NA on February 15, increasing the general sales tax from 17 per cent to 18 per cent, besides imposing further tax on luxury items and increasing the prices of petroleum products.

He also claimed that presenting the mini-budget at the end of the financial year was not only a deviation from the constitution but also in violation of the law because Pakistan’s residents would directly or indirectly be affected from the unlawful act.

He said the Centre had presented the mini-budget on the instructions of the International Monetary Fund for implementing its policies, adding that it showed that the federal government had failed to run the state’s affairs in accordance with the provisions of the country’s constitution.

He also said the Centre was competent to impose a financial emergency in terms of the constitution’s Article 235, under which the state could be secured from any default. But the federal government is not willing to sacrifice their expenses and lavish lifestyle, he added.

Haider said policies must be formulated with the intention to strengthen the state and its citizens, adding that policies should always be formulated for the betterment and welfare of the citizens who are facing extra burden.

He said that it is the government’s duty to provide all the necessities to the citizens, but the present government has completely failed to control their expenditures and expenses.

He requested that the court declare the mini-budget as well as the increase in the prices of petroleum products a gross violation of articles 5, 8, 9, 18, 70, 77 and 80, read with Article 25, of the constitution.

The FIA cyber crime circle Karachi arrested the former wife of Aamir Liaquat Hussain, Dania Shah, from Lodhran in the obscene video leak case in December 2022.

The SHC while accepting bail of late Aamir Liaquat’s wife against surety bonds of Rs200,000, ordered police to release her from jail.

Advocate Liaquat Gabol said there is no evidence against Daniya Shah and FIA has done a poor investigation in this case.

It is pertinent to mention here that the late anchor Aamir Liaquat Hussain’s widow Dania Shah challenged her arrest in the SHC in an objectionable video case.

She stated in her petition that the FIA had illegally arrested her and it did not fulfil the legal requirements despite the submission of replies to the agency.

It should be noted that earlier in the District and Sessions Court East Karachi, the bail application of Dania Shah, who was arrested on the charge of leaking an indecent video of the late Aamir Liaquat, was heard.

The court had rejected the bail application of the accused Dania Shah while giving a verdict on the bail application of the accused Dania Shah.

KARACHI: Sindh High Court (SHC) has issued a written decision  in case of deaths due to the alleged poisonous gas in Ali Ahmed Goth, Keamari Town.

A two-member bench headed by Chief Justice Sindh High Court Ahmed Ali Sheikh issued the written decision.

The court was told that citizen Khadim Hussain has filed a case for the death of four members of the family.

Written order stated that no one has registered the case of death of other 14 persons.

Court asked why the police didn’t take action, why weren’t the cases filed against on the behalf of the state.

The written order said main questions of the court were not answered satisfactorily.

Deputy Commissioner Keamari Mukhtar Ali Abro stated in report that no one was killed apart from Khadim Hussain’s family.

According to the written statement DC Keamari’s statement contradicts IG Sindh’s statement.

Court ordered IG Sindh to conduct a transparent investigation into the incident and file cases on the behalf of state.

KARACHI: Sindh High Court (SHC) suspended till further orders the permission granted by the District South deputy commissioner to a private organisation for holding a festival for a community at the Urban Forest park in Clifton Block 5.

The direction came on a petition filed by a non-government organisation against holding of the musical festival for a ‘marginalised’ community at the park. The petitioner’s counsel, Talha Makhdoom, submitted that the South deputy commissioner had granted the permission for the festival and the South SSP had issued a no-objection certificate (NOC) for holding such an event on an amenity plot, which was reserved for plantation and greenery only and could not be used for any other purpose, including holding such events.

The counsel submitted that the South DC had issued the permission without completing the codal formalities or inviting objections from the public and residents of the area who were preserving and maintaining such a park for the purpose it was reserved for.

He submitted that the petitioners had approached the South deputy commissioner, Karachi Metropolitan Corporation (KMC) parks director general as well as the local police against holding of such an event, which, according to them, aimed at promoting vulgarity in society and was against the various articles of the Constitution including, 2A, 29, 30, 31 and 35.

The counsel submitted that unless restraining orders were issued, there was apprehension that a law and order situation would be created as the proposed event had been advertised on social media in a way that had seriously hurt the religious sentiments of a large number of residents of the area.

The high court was requested to declare that the permission granted by the South DC as well as the NOC issued by the South SSP was unlawful and restrain the KMC from lending park to private parties which were constructed and maintained by public funds for no purpose other than the communal service.

A division bench of the SHC headed by Justice Aqeel Ahmed Abbasi after a preliminary hearing of the petition issued notices to the South DC, Karachi Development Authority, South SSP and others and called their comments on February 9.

Advocate Malik Altaf Javed in his petition stated that the employees are being posted in offices all over the world after being merged into the foreign ministry from the provinces.

The petitioner said that the Supreme Court has stopped the integration of employees from other departments, bringing permanent employment from the provinces is a violation of the order of the apex Court.

Advocate Malik Altaf Javed stated that process of permanent appointments and promotions in the ministry has also stopped due to illegal appointments.

The court sought the report of Secretary Establishment Division, Ministry of Foreign Office and others.

The SHC ordered parties to submit a reply on February 17.

It is requested in the petition that the approval of the increase in the prices of petroleum products should be taken from the Parliament

The petitioner pleaded to the court to restore the old prices of petroleum products.

KARACHI: Sindh High Court (SHC) directed the Sindh government to implement on minimum wage of Rs25,000 for sanitary workers deployed in all the departments across the province.

The direction came on a petition seeking the implementation of the minimum wage law for all the sanitation workers employed by the local government department and Sindh Solid Waste Management Board (SSWMB).

Naeem Sadiq and others had stated in their petition that sanitation workers employed by the local government bodies across the province were currently being paid well below the minimum wage.

They said that many sanitation workers employed by the union councils and the SSWMB, either directly or through a contractor, were not only paid well below the minimum wage but they also got no benefits whatsoever and could be fired at will.

They added that sanitation workers had to handle toxic pollutants, noxious substances, and hazardous biological and chemical agents in the course of their work, making them vulnerable to health risks, and they were also required to climb down sewerage drains, where they were immersed in waste and exposed to poisonous substances.

They said sanitation workers frequently died in the course of performing their duties due to the absences of protective gear and safety protocols, while they received no health care or compensation from their employers in case of injuries or death.

The petitioners called for invoking the Constitution’s articles 9 and 25 that required sanitation workers employed by government bodies across Sindh be entitled to at least the minimum legal wage, and said that sanitation workers had the right to livelihood and equality under the law.

The petitioners’ counsel, Sara Malkani, said sanitation workers were entitled to the minimum wage whether they were directly employed by the local government department or the SSWMB, or through contractors, and the government must ensure that the private contractors to whom it had outsourced sanitation services were complying with the labour laws.
