ISLAMABAD: Chief Justice of Pakistan (CJP) Qazi Faez Isa remarked that the baseless litigation used to waste the courts’ time and lead to an increase in the number of pending cases.

Chief Justice Qazi Faez Isa in a case related to property distribution in the Supreme Court remarked that after the death of a 75-year-old man, a land dispute was litigated.

The Chief Justice said “We know how litigation happens, courts waste time due to such baseless and fabricated litigation, the number of pending cases is increasing due to baseless litigation”.

A claim was filed in the Supreme Court in 2006 over a property dispute which was disposed of by the court.

Federal Govt to increase number of SC’s judges to 23

ISLAMABAD:  The federal government has decided to increase the number of Supreme Court judges to 23 including the Chief Justice.

The government has submitted the Supreme Court (Number of Judges) Amendment Bill to the National Assembly Secretariat by amending the 1997 Act while deciding on important legislation related to the Judiciary.

The contents of the proposed bill of Barrister Daniyal Chaudhry, a member of the government, have also been revealed, according to which the increase in the number of Supreme Court judges is necessary due to the backlog of cases and the increase in the number of judges will ensure timely hearing and decisions of cases.

According to the text of the bill, there is a need for experts in cybercrime, environmental law and global trade cases. By appointing judges with expertise in various fields, accurate decision-making will be possible.

TLP leader booked for threatening CJP Isa

LAHORE: A case has been registered against Vice Amir of Tehreek-e-Labaik Pakistan (TLP) Pir Zaheer Ul Hasan Shah for threatening to Chief Justice of Pakistan Qazi Faez Isa.

According to the police, 1,500 TLP workers have also been named in the case, while provisions of the Anti-Terrorism Act, religious hatred, sedition and putting pressure on the judiciary have been included in the case.

The case also includes the provisions of contempt of the higher judiciary, interference in government and obstruction of legal duties.

Police said that in the protest outside the press club, Pir Zaheer ul Hasan spread hatred against the Supreme Judiciary, which has registered a case against 1,500 workers, including the TLP vice-chairman.

Lahore Police registered the case in Qila Gujjar Singh police station on the complaint of SHO Hammad Hussain against the TLP leader and 1500 party workers for issuing death threats to the chief justice.

The case refers to a speech made by Shah during a protest rally outside the Lahore Press Club during a demonstration against the SC verdict in the Mubarak Sani case.

JCP approves elevation of BHC Chief Justice to SC

ISLAMABAD: The Judicial Commission of Pakistan(JCP) has given its nod to appoint the Chief Justice of the Balochistan High Court, Justice Naeem Akhtar Afghan, as a judge of the Supreme Court.

A meeting of the Judicial Commission of Pakistan was held under the chairmanship of Chief Justice Qazi Faez Isa in which important decisions were taken regarding the appointment of judges in the Supreme Court.

In the meeting, it was decided to make Chief Justice Balochistan High Court Naeem Akhtar Afghan a judge of the Supreme Court, for which the Judicial Commission has approved the name of Justice Naeem Akhtar Afghan.

Apart from this, the Judicial Commission has also decided to make Justice Shahzad Ahmed Malik the Chief Justice of Lahore High Court, for which the name of Justice Shahzad has also been approved.

The Judicial Commission has approved both the names and sent the matter to the Parliamentary Committee.

ISLAMABAD: Minister for Defence Khawaja Muhammad Asif demanded the Chief Justice Umar Ata Bandial to form a full court to hear the suo motu notice case regarding delay in the announcement of a date for elections in Punjab and Khyber Pakhtunkhwa.

Speaking here in National Assembly, the minister said that a bench comprising nine judges is hearing this case but the matter is of utmost importance and the full court must consider it. “I do not want to give the impression that Parliamentarians are trespassing in the jurisdiction of the judiciary but I, as a political worker, demand to resolve this complicated situation which is being faced by the country during the last 7-8 months,” he added.

Asif said that a full court must start from the Panama case and give a decision which would have a great impact on the future of the country. All the stakeholders must be listened and such a solution be given which should be a roadmap for all.

“ There are some ex-judges like Justice Muneer Hussain and Riaz Sheikh who are criticized but others like Saeed uz Zaman Siddiqui and Nazim Siddiqui are known for their dignity,” he said and appealed to the judiciary to review why some amongst them are criticized yet.

He said that the territory of parliamentarians was trespassed in past and our leadership was also victimized. “We would also say that some of them (judges) had not fulfilled responsibilities assigned to them”, he added.

Khawaja Asif said that a constitutional crisis was being faced because of re-defining Article 63-A of the constitution. He recalled the decision of the apex court about lifetime disqualification of the ex-Prime Minister Muhammad Nawaz Sharif and said that there would be no precedent of disqualification of a person of an institution by another institution.

The minister said there have been direct and indirect confessions by the people who remained involved in disqualification case of Nawaz Sharif and the full court of the apex court should start from the Panama case.

Asif said that politicians are always blamed who serve the people by considering it as `worship’ but other elites are not named who enjoy during their services.
