ISLAMABAD: The Supreme Court of Pakistan (SC) is likely to hear a presidential reference  next week for revisiting former prime minister Zulfiqar Ali Bhutto’s murder case judgment.

The presidential reference regarding Zulfiqar Bhutto’s execution is likely to be scheduled for a hearing next week. A larger bench will hear the presidential reference related to Zulfikar Ali Bhutto.

The presidential reference will be heard under the supervision of Chief Justice of Pakistan Qazi Faez Isa.

Sources said that a larger bench will hear the presidential reference related to the judicial killing of Zulfiqar Ali Bhutto. A bench headed by the Chief Justice will be formed to hear the reference.

It should be remembered that in 2011, the People’s Party government, through the then President Asif Ali Zardari, filed a reference in the Supreme Court regarding the execution of Zulfiqar Ali Bhutto.

At that time, Supreme Court Chief Justice Iftikhar Muhammad Chaudhry formed an 11-member larger bench under his chairmanship, which conducted six hearings of the case from January 3, 2012, to November 12, 2012, but did not give any decision.

SC accepts appeals against Pervez Musharraf’s execution

ISLAMABAD: The Supreme Court accepted the appeal against the sentence of former President General (retd) Pervez Musharraf for hearing.

A 4-member bench headed by Chief Justice Qazi Faez Isa, Justice Mansoor Ali Shah, Justice Aminuddin Khan and Justice Athar Minallah heard the appeals related to the punishment of late former President Pervez Musharraf, in which the special court annulled the decision.

In the appeal against verdict, Hamid Khan, Abid Saqi on behalf of Pakistan Bar Council, Rashid A. Rizvi on behalf of Sindh High Court Bar and Salman Safdar on behalf of former President Pervez Musharraf appeared in the court.

Former President Pervez Musharraf has filed an appeal in the Supreme Court against the decision pronounced by the special court on December 17, 2019.

At the beginning of the hearing in the Supreme Court, the Chief Justice said “It is good that all the lawyers are present, there was talk about the bench, I want to clarify, I am not in favor of changing the benches. I have heard the case, I do not understand that the cases of 2019 have not been decided till date”.

Meanwhile, Pervez Musharraf’s lawyer Salman Safdar said that after the amendment of the criminal law, an appeal was filed in the Supreme Court against the decision of the special court. The decision of the special court against Pervez Musharraf was not unanimous. Pervez Musharraf was sentenced in his absence.

Later, the Supreme Court accepted the appeal against Pervez Musharraf’s sentence for hearing.

ISLAMABAD: The Judicial Commission of Pakistan(JCP)  recommended the appointment of Justice Irfan Saadat Khan as a Supreme Court(SC) judge.

A meeting of the Judicial Commission was held under the chairmanship of Chief Justice of Pakistan Qazi Faez Isa.

The appointment of Justice Irfan Saadat as a Supreme Court Judge was recommended by the Judicial Commission unanimously.

The Judicial Commission sent the name of Justice Irfan Saadat to the Parliamentary Committee for Appointment of Judges for final approval.

It should be noted that Justice Irfan Saadat Khan is currently the Acting Chief Justice of Sindh High Court(SHC).

ISLAMBAD: The Supreme Court (SC) registrar returned with an objection, a petition, filed by Pakistan Tehreek-e-Insaf (PTI) for holding general elections within 90 days.

According to the sources, the Registrar Supreme Court objected to PTI’s request to hold elections within 90 days and returned it.

In the objections of the Registrar Supreme Court, it is said that the petitioner did not approach any relevant forum before coming to the Supreme Court.

The President of the state cannot be made a party to the petition according to Article 248. It is not stated in the petition that the petitioner which fundamental right is affected.

The requirements of Article 184/3 were not fulfilled in the application.

It should be noted that PTI had filed a petition through Barrister Ali Zafar, in which it was requested to hold elections in 90 days.

The petition also sought to annul the decision of the Council of Common Interests(CCI).

On May 2, 2018, a contempt of court petition was filed against former interior minister Ahsan Iqbal.

In the petition, contempt of court action was requested against the interior minister for making an anti-judiciary statement.

In the petition, it was requested to disqualify Ahsan Iqbal under Articles 63 and 62 of the Constitution.
