JCP recommends names of six SHC judges for permanent

ISLAMABAD: Judicial Commission of Pakistan(JCP) has recommended six names of judges for permanent appointments in the Sindh High Court (SHC).

A meeting of the Judicial Commission was held under the chairmanship of the Chief Justice of Pakistan, Justice Qazi Faiz Isa, in which six additional judges were recommended to be made permanent in the Sindh High Court.

According to sources, the 6 judges unanimously recommended by the Judicial Commission to be permanent include Justice Abdul Rehman, Justice Jawad Sarwana, Justice Sana Minhas, Justice Khadim Soomro, Justice Ijaz and Justice Amjad.

Sources say that in the Judicial Commission meeting, it has also been recommended to appoint Acting Chief Justice Balochistan High Court Justice Hashim Khan Kakar as the permanent Chief Justice of Balochistan.

SHC orders to not count reserved seats votes in presidential election

KARACHI: The Sindh High Court(SHC) has issued an order to not count the votes of three reserved seats in the presidential election.

The court issued a short verdict on Sunni Ittehad Council’s (SIC) petition for reserved seats.

PPP’s Smita Afzal, MQM Fauzia Hameed and PPP’s minority seat Surendar Valasai took oath yesterday.

However, today the SHC issued a written order in the case of not giving reserved seats to the Sunni Ittehad Council in the Sindh Assembly.

The court order states that in the presidential election, the court does not want to interfere in the process of voting by the members of the Sindh Assembly in favor of their favorite candidate, however, these three votes of the Sindh Assembly should not be considered as decisive votes. Until the final decision of the application is made.

According to the order, Advocate General Sindh has objected to the admissibility of the petition.

The court has asked the Election Commission of Pakistan (ECP), MQM Pakistan, PPP to respond on March 28.

On the other hand, the Sindh government is of the opinion that the three members of the Sindh Assemblies have taken oath on March 7 and the petition has become ineffective.

SHC orders PTA to restore social media site ‘X’

KARACHI: The Sindh High Court(SHC) has ordered the Pakistan Telecommunication Authority (PTA) to restore the suspended social media site X across the country.

In the statement released by the court, it has been said that the X service should be restored without any interruption or shutdown.

The petitioner’s lawyer said that the Minister of Interior has stated that the directive to close X has not been issued. The Prime Minister, the Interior Minister, and the Minister of IT are using X by installing a VPN and telling the nation that X is not closed.

Chief Justice of Sindh High Court Aqeel Ahmed Abbasi inquired about who closed the sites and who ordered to keep them closed.

The petitioner’s lawyer said that only the PTA has the authority to shut down the X, to keep the service slow.

The petitioner’s lawyer added that journalists and those whose livelihoods are linked to X are facing serious difficulties. The millions of people associated with media and research are facing difficulties due to the closure of X.

Justice Aqeel Ahmad Abbasi asked how many days X service is closed. We have already ordered to open internet service in a petition.

The petitioner’s lawyer said that this application is different from the case. The day Commissioner Rawalpindi stated how we rigged X has been closed since that day.

SHC orders removal obscene content from social media

KARACHI: The Sindh High Court(SHC) has ordered the immediate removal of obscene content from all social media platforms.

Sindh High Court Chief Justice Aqeel Abbasi heard the petition against obscene content on social media, during which the petitioner’s lawyer said in his arguments that obscenity is being promoted in the name of family vlogging.

During the hearing, Pakistan Telecommunication Authority’s counsel told the court that PTA does not have the authority to remove content on Facebook, YouTube, or any other website, and to remove objectionable content, it has to write to the concerned authorities.

Meanwhile, PTA’s counsel sought time to submit the reply, on which the court said that obscene content should be removed from Facebook, Tik Tok, and other apps, whatever the order, the orders should be fully implemented and all objectionable content should be removed from websites.

The court ordered to take immediate action against immoral content on social media and to prepare a complete chart and submit a report.

SHC upholds stay-order ordering uninterrupted internet access till elections

KARACHI: The Sindh High Court(SHC) has upheld the stay order to continue uninterrupted internet and mobile phone services across the country until the general elections.

Chief Justice Sindh High Court Aqeel Ahmad Abbasi heard the petition against the repeated shutdown and interruption of internet service in the country, during which the court expressed its annoyance over the shutdown and interruption of internet service.

The Chief Justice of Sindh High Court said that if our internet does not work, what will work elsewhere, it seems that it will be fixed after the election.

Later, the court adjourned the hearing till February 21 due to the absence of the Pakistan Telecommunication Authority’s counsel and the court has ordered to maintain the stay order regarding uninterrupted restoration of internet service across the country.

The court has also maintained the order to continue the mobile internet service without interruption.

PS-110’s independent candidate and rights activist Advocate Jibran Nasir had filed the petition in the SHC against the frequent suspension of internet services in the country ahead of the general elections.

KARACHI: Sindh High Court (SHC) allowed former home minister Sindh Zulfikar Mirza and former federal minister Fahmida Mirza to contest the general election.

The Sindh High Court heard the constitutional petitions filed against the rejection of the nomination papers of Zulfikar Mirza and his wife, Fahmida Mirza.

Fahmida Mirza and Zulfiqar Mirza submitted nomination papers from National Assembly Constituency NA 223 while Zulfiqar Mirza also submitted papers from PS 70, 71, and 72.

The nomination papers of both were rejected by the Returning Officers(ROs) and the Election Tribunal accusing them of being bank defaulters.

However, the Sindh High Court approved the constitutional petitions of both candidates and allowed them to contest the elections.

KARACHI: The Sindh High Court(SHC)has restrained the provincial authorities from processing the recruitment in government departments from grade one to 15 across Sindh.

Justice Zafar Ahmad Rajput of Sindh High Court heard the case of providing grade one to 15 government jobs across the province, during which the court gave strong remarks on the way government jobs were given by the previous government.

He remarked that the government was going to give government jobs to the deputy commissioners on open and blank appointment letters.

Justice Zafar Rajput said that the people were told to collect the blank appointment letters from the office of the Deputy Commissioners, while the public prosecutor supported the court’s remarks.

Justice Zafar Rajput said, “We have to ensure merit and transparency in government jobs, earlier there was SRTC, the transport organization, but it was also destroyed”.

The court said, “If the institutions are run under the system, everyone will benefit, if they are run without the system, only those who do government jobs will benefit”.

The court ordered Sindh Institute of Child Health and Dawood University of Engineering & Technology to issue clear advertisements again for contract employees.

The court expressed its displeasure over the giving government jobs in SESSI despite the stay order and asked how to release government jobs when the injunction was issued.

Lawyer MQM Farogh Naseem stated that the Section Officer in the transport department released 40 jobs. He said action should be taken against the Chief Secretary of Sindh and others.

KARACHI: The Sindh High Court(SHC) has rejected the report of the police and Joint Investigation Team regarding the missing persons and has ordered to trace the missing persons from every angle.

Sindh High Court Justice Naimatullah Phulpoto heard the late petitions for the recovery of the missing persons. During this, the court also expressed anger at the JIT officials for not tracing the missing persons and summoned the JIT chief and the provincial task force chief.

The court said that if the missing persons cannot be traced in the JIT then this action is futile.  Court remarked even after 26 JITs meeting if it cannot be traced, then everything is futile.

During the hearing, the Sindh High Court rejected the police report and ordered the release of the JIT report three days after the hearing.

The court also expressed dissatisfaction with the report of the Federal Ministry of Interior and Defense and said that this will not work now, the missing persons have to be traced or action will be taken against the investigating officer.

In the report of the Ministry of Interior, it was stated that the said missing persons are not in the detention center of any federal institution.

The court ordered to trace of the missing persons from every angle and said that immediate steps should be taken to recover the missing Noor Zaman, Haider, Talha, Khair ur Rehman, and others.

Acting Chief Justice of Sindh High Court Aqeel Abbasi heard the petition of Jamaat-e-Islami regarding the empowerment of local bodies, in which the court ordered to give immediate budget and financial powers to towns and UCs.

The court asked which elections were left and why is this process not being completed.

The court said that according to the Local Government Act, towns and UCs should be given immediate financial powers, and the process of assigning responsibilities to UCs employees should also be completed immediately.

Later, the court disposed of the petition of Jamaat-e-Islami’s Hafiz Naeem-ur-Rehman and others.

KARACHI: The Sindh High Court (SHC) has expressed its displeasure over the charging of entry and parking fees in the city’s public parks and playgrounds.

A hearing was held in the Sindh High Court on the petition against a collection of entry and parking fees in public parks and playgrounds in Karachi.

During the hearing, Acting Chief Justice Irfan Saadat said that the city government institutions have kept everyone busy and the court will not allow commercial work in public parks and playgrounds.

In the hearing, the petitioner’s counsel told the court that the Supreme Court had ordered the abolition of entry fees in public parks and playgrounds, on which the court had given the details of the parks and playgrounds run by Karachi Metropolitan Corporation(KMC), District Municipal Corporations (DMCs) and other institutions.

The court said that if the public parks have been leased to anyone, the list should also be submitted.

Sindh High Court Justice Nimatullah Phulpoto heard the petition related to the disappearance of PTI leader Usman Dar, during which Barrister Ali Tahir said that the court had ordered to register a case of Usman Dar’s disappearance on the previous hearing.

Expressing annoyance at the delay, the court asked why the case of Usman Dar’s disappearance was not registered.

The court said that the police should register a case of Usman Dar’s disappearance today.  The court observed, “If a case is registered, there will be an investigation and everything will be revealed”.

The court ordered the police to file a case and submit a report on October 18 and asked the Sindh Home Secretary for a written response on October 18.

KARACHI: The Sindh High Court(SHC) ordered the private school administration not to increase the fees.

A hearing was held on the petition of the parents against the private school, in which the petitioner said that the new branch of the school was inaugurated in August 2022, and the school management wanted to give a 50% discount on the lifetime fee.

The petitioner said that while other facilities including air-conditioned classrooms were assured, gradually the attitude of the school management changed, and the children started sitting under a tin roof.

The parents of the children took the stand in the court that the school was asked to remove the complainants from the school, on which parents approached the court.

On the stand of the petitioner, the court observed that the school administration can only increase the old fee by five percent until the decision is taken, the school administration should not increase the fee by more than five percent.

The court also stopped the school administration from collecting a Rs 30,000 fee from the parents while the court summoned the school administration and DG Private Schools for the next hearing.

KARACHI: The Sindh High Court(SHC) has extended the stay order regarding the ban on government jobs in the province.

The petition of the Muttahida Qaumi Movement(MQM) regarding the ban on jobs was heard.

Farogh Naseem appeared in the court on behalf of MQM and he presented the details of the appointment after the court order.

Farogh Naseem said that appointment letters were made on previous dates and this work continued for ten days. He said the law has been made a joke.

Meanwhile, Farogh Naseem requested the Chief Secretary Sindh to call for a detailed report and said that the AGPR should be ordered to stop the salaries and benefits because they have violated the court orders thus a contempt of court has been filed against them.

Farogh Naseem said that the job is being given based on a walk-in interview through the Deputy Commissioner. The medical certificates of previous dates were produced in the hospitals and no party received notice and copy of the application.

During the hearing, Faizan Memon submitted an advocacy letter on behalf of Jinnah Sindh Medical College. He said JSMU has not given any job after the approval of the syndicate and there have been no walk-in interviews. He said jobs have been given to teaching and non-teaching persons.

Elderly man approaches SHC for possession of home

KARACHI: An 83-year-old senior citizen from Karachi approached the Sindh High Court(SHC)  against the occupation of his house.

On the senior citizen’s request, the Sindh High Court accepted the plea for an urgent hearing issued notices to the parties, and sought their responses.

The senior citizen stated in the petition that his younger brother forged the house and got the house in his name. The court also canceled the allotment but the possession is not being given.

The petitioner said that the trial court is giving date after date at this age, the brother who committed the forgery also died.

He said that now his wife is not ready to give possession. He further stated the house was in his uncle’s name and he had brought up the brother.

The court adjourned further hearing of the petition till September 15.

The court while remarking said that the parking plaza was built and it has been heard that ghosts are living there. He said that millions of rupees have been spent on the construction of this building.

The KMC counsel told the court that the parking was charged by the KMC on the roads under the KMC.

According to the details, on the issue of Dow International Medical College charging fees in dollars, the students approached the Sindh High Court(SHC) against charging fees in dollars.

The lawyer petitioner Shahab Sarki said that the fee challan was started from 1.5 million and now it has been increased to 3.2 million. The university is in Pakistan and students are being charged in dollars.

The lawyer said that the university is C category, in one month someone has been given a challan of 3.2 million and someone has been given a challan of 2.8 million. Justice Adnan Iqbal Chaudhry said that still there are fewer fees in the country compared with other countries.

Shahab Sarki Advocate said that it is in the regulation that they cannot increase their fees, on which the court issued a notice to the parties for July 26.

Justice Adnan Iqbal said, “If you(students) want to fill the challan, fill it, you will see later if it is illegal, then you will return the money, to which the petitioner’s lawyer said that we cannot afford the fee.”

SHC orders PIA to ensure provision of drugs to retired staff

KARACHI: Sindh High Court (SHC) has directed the Pakistan International Airlines (PIA) competent authority to ensure provision of actual medicines as prescribed by the doctors to the retired employees of the national flag carrier and their families as per rules.

Court warned the PIA that in case of failure to comply with the order, proceedings shall be initiated against the delinquents in terms of the Article 204 of the Constitution without providing further opportunity on the subject issue.

The direction came on a contempt-of-court application filed by retired PIA employee Javed Iqbal against non-compliance with court directives with regard to provision of medicines to him as prescribed by specialist/general cadre doctors.

The applicant had submitted that alleged contemnors of the PIA had wilfully disobeyed the court directives and failed to ensure the provision of actual medicines to him as prescribed by the specialist/general cadre doctors as per the rules.

The SHC asked an assistant attorney general with regard to non-compliance with court directives. The law officer submitted that a senior medical officer of the PIA had contacted the applicant for providing medicines to him but he did not respond.

He assured the court that the petitioner shall be provided required medicines at any time.

The applicant, however, refuted the stance of the PIA and submitted that the court order had not been complied with in letter and spirit. He asked the high court to initiate contempt of court proceedings against the alleged contemnors.

A division bench of the SHC comprising Justice Mohammad Iqbal Kalhoro and Justice Adnan-ul-Karim Memon after hearing the counsel observed that since the competent authority of the PIA had already been directed to ensure the provision of actual medicines as prescribed by the specialist/general cadre doctors to the retired employees of PIA.

Court directed the competent authority of the PIA to comply with the directions contained in the order on October 12, 2021, in its letter and spirit, without fail.

The bench made it clear that in case of non-compliance, proceedings shall be initiated against the delinquents in terms of the Article 204 of the Constitution without providing further opportunity on the subject issue.
