PHC appoints KP Governor for reserved seat oaths; Assembly session suspended over quorum

Peshawar:  Chief Justice of  Peshawar High Court has appointed Khyber Pakhtunkhwa Governor Faisal Karim Kundi to administer the oaths to members elected on reserved seats in the KP Assembly.

According to the notification of Election Commission, polling for the Senate elections will begin tomorrow at 11:00 am.

The Chief Justice of Peshawar High Court has delegated the authority to the Governor KPK to take the oath.

The decision comes in response to a petition filed by opposition parties, including the Pakistan Peoples Party (PPP), which argued that members elected on reserved seats had yet to take their oaths. The petition, submitted to the court’s Registrar on behalf of opposition representatives, sought the court’s intervention to ensure proper oath-taking procedures.

The Additional Secretary General of PPP Khyber Pakhtunkhwa stated that the petition emphasized the importance of completing the oath-taking process for reserved seat members to facilitate the smooth functioning of the assembly.

Following the court’s directive, the Governor of KP has been designated to oversee the oath-taking ceremony for these members.

PESHAWAR: Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur has challenged the Election Commission of Pakistan (ECP)’s notice in assets case.

The Chief Minister of Khyber Pakhtunkhwa filed petition in Peshawar High Court through the lawyer of Syed Sikandar Hayat Shah Advocate.

It has been contended in the petition that all the assets have been disclosed in the nomination papers and the Returning Officer(RO) has scrutinized the papers carefully.

It has been said in the petition that the election has taken place, Ali Amin Gandapur has become the Chief Minister, now the Election Commission of Pakistan has no authority to take action, if anyone is affected, he can approach the Election Tribunal.

According to the petitioner’s lawyer, the Election Commission has summoned the Chief Minister yesterday regarding the assets.

Earlier, Election Commission of Pakistan (ECP) accepted a plea seeking the disqualification of Khyber Pakhtunkhwa (KP) Chief Minister Ali Amin Gandapur for hearing.

ISLAMABAD: The Election Commission of Pakistan (ECP) approached the Supreme Court against the Peshawar High Court (PHC) verdict that annulled the electoral body’s decision to declare PTI’s intra-party polls unconstitutional and stripping the party bat electoral symbol.

“The Peshawar High Court decision should be declared illegal. PTI did not hold intra-party elections as per the Election Act,” the ECP stated in its plea submitted to the top court.

The Election Commission held an important meeting regarding the decision of the Peshawar High Court on the symbol of the bat.

The meeting was held under the chairmanship of Chief Election Commissioner Sikandar Sultan Raja at the Election Commission Secretariat, in which four members of the commission and special secretaries participated.

In the meeting, the decision of the Peshawar High Court was consulted, after which it was decided to challenge the verdict of the Peshawar High Court in the Supreme Court.

It was decided in the meeting that the Election Commission will prepare the petition soon.

Earlier, the Peshawar High Court suspended the decision of the Election Commission of Pakistan and ordered the restoration of PTI’s election symbol. The court also ordered the ECP to upload the notification on the website.

The court said that the ECP should publish the party certificate under Article 209 of the Election Act, 2017 and the Election Commission should allot the election symbol to PTI under Article 215.

PESHAWAR: The Peshawar High Court(PHC) suspended the notification of by-elections on the constituencies of the National Assembly in Khyber Pakhtunkhwa (KP).

The Pakistan Tehreek-e-Insaf(PTI) had moved PHC last week seeking the suspension of the Election Commission of Pakistan’s by-election schedule on 24 NA seats scheduled to be held on March 16 and 19.

A two-member bench comprising Justice Syed Muhammad Attique Shah and Justice Syed Arshad Ali announced the short verdict.

The Peshawar High Court reserved the decision today after the arguments of the lawyers were completed.

The court also sought the response regarding the acceptance of PTI’s resignations and fixed the date of March 7 for the next hearing.

The by-elections were scheduled to be held in the constituencies of NA-4 Swat, NA-17 Haripur, NA-18 Swabi, NA-25 and NA-26 Nowshera, NA-32 Kohat, NA-38 Dera Ismail Khan (DI Khan) and NA-43 Khyber.

PESHAWAR: Pakistan Tehreek-e-Insaf(PTI) has challenged the transfers and postings by the caretaker government of Khyber Pakhtunkhwa in the Peshawar High Court(PHC).

PTI leader Asad Qaiser filed a petition in the Peshawar High Court on the matter of transfers and postings on behalf of the caretaker government.

Barrister Gohar Ali Khan filed a plea on behalf of Asad Qaiser, in which he stated that the transfers and postings by the caretaker government is illegal, which will affect the conduct of transparent elections.

In the petition on behalf of the leader PTI, it was submitted that transfers and postings of the bureaucracy by the caretaker government are against the election rules, the responsibility of the caretaker government is to conduct transparent elections.

In the petition filed in Peshawar High Court, Barrister Gohar Ali Khan stated that Supreme Court has also issued orders in this context many times. It is requested that the transfers and postings of the caretaker government should be declared null and void.

Former speaker national assembly Asad Qaiser has made the provincial government, election commission, and department administration parties in the petition.

Talking to the media outside the court, PTI Khyber Pakhtunkhwa Spokesperson Shaukat Yousafzai and Barrister Gohar Khan said that the caretaker government is misusing its power. They said that the caretaker government comes to conduct elections.

Shaukat Yousafzai said that the caretaker chief minister has been taken hostage which will affect the holding of transparent elections in the province. He said there is a constant violation of the constitution.

PESHAWAR: The Peshawar High Court (PHC) has ordered the Election Commission of Pakistan (ECP) and the Governor of Khyber Pakhtunkhwa to submit a written response regarding elections in the province.

In the Peshawar High Court, Justice Ishtiaq Ibrahim and Justice Arshad Ali heard the case on behalf of Pakistan Tehreek-e-Insaf (PTI) for the timely elections of the Khyber Pakhtunkhwa Assembly.

Pakistan Tehreek-e-Insaf leaders Azam Swati, Asad Qaiser, Shibli Faraz, and Shah Farman appeared in the court.

At the beginning of the hearing, the Advocate General stated that the Chief Secretary submitted the reply today. On this, the court said that the Governor has not submitted the reply, and the Governor should tell the court why he has not given the date yet.

Advocate General submitted that according to the constitution, the governor has time to give the date. Justice Arshad Ali said that it will be discussed later, first reply in writing was that no date was given in reply to the first letter.

The court inquired what if the Election Commission did not get the date, would be the course of action.

The court also directed the Election Commission to submit a written reply.
On the other hand, the lawyer of Pakistan Tehreek-e-Insaf presented the decision of the Lahore High Court in court.

The PTI lawyer stated that the Election Commission’s letter, the Governor’s reply, and the President’s letter are on record, the Governor does not want to give the date on the basis of excuses.

PESHAWAR: The Peshawar High Court (PHC) served notices to the Election Commission of Pakistan and the caretaker provincial government on Pakistan Tehreek e Insaf’s plea seeking election within 90 days after the dissolution of the Khyber Pakhtunkhawa Assembly.

Earlier, KP Assembly was dissolved on January 18 after Governor Haji Ghulam Ali signed the advice for the dissolution of the provincial assembly sent to him by the then Chief Minister Mahmood Khan a day ago.

Pakistan Tehreek-e-Insaf moved PHC for elections in the province within 90 days of the dissolution of the assembly.

PTI in its plea said as per the constitution, elections are to be held within 90 days but the KP governor has so far not given any date, citing law and order issues.

The governor said elections cannot be held due to the law and order situation, Moazzam But said and asked when the situation is not favorable how come by-elections on 33 seats are being?

The PHC bench comprising Justice SM Atique Shah and Justice Ishtaique Ibrahim remarked elections should be held within 90 as per the law.

Advocate General Aamir Javed in his remarks before the court said the governor can consult with the ECP for 36 days and added PTI filed the plea in haste.

After the announcement to ban TikTok in Peshawar, the Peshawar High Court (PHC) has now ordered to ban the application across the country.

The Pakistan Telecommunication Authority (PTA) has declared directives to all service providers to immediately block access to the TikTok app across Pakistan.

“In respectful compliance to the orders of the Peshawar High Court, PTA has issued directions to the service providers to immediately block access to the TikTok app. During the hearing of a case today, the PHC has ordered for the blocking of App,” the tweet by PTA read.

Earlier in the day, Chief Justice Qaisar Rashid Khan had approached the TikTok officials to ban it over the unethical content.

“Tik Tok videos are spreading obscenity, it [the app] should be shut down immediately,” he added.

Previously on October 19, PTA had restored TikTok after placing a ban for promoting improper content.

PTA had on Twitter wrote, “TikTok is being unlocked after assurance from management that they will block all accounts repeatedly involved in spreading obscenity and immorality. TikTok will moderate the account in accordance with local laws.”
