ECP challenges PHC judgement on PTI’s intra-party polls in SC

ISLAMABAD: The Election Commission of Pakistan (ECP) approached the Supreme Court against the Peshawar High Court (PHC) verdict that annulled the electoral body’s decision to declare PTI’s intra-party polls unconstitutional and stripping the party bat electoral symbol.

“The Peshawar High Court decision should be declared illegal. PTI did not hold intra-party elections as per the Election Act,” the ECP stated in its plea submitted to the top court.

The Election Commission held an important meeting regarding the decision of the Peshawar High Court on the symbol of the bat.

The meeting was held under the chairmanship of Chief Election Commissioner Sikandar Sultan Raja at the Election Commission Secretariat, in which four members of the commission and special secretaries participated.

In the meeting, the decision of the Peshawar High Court was consulted, after which it was decided to challenge the verdict of the Peshawar High Court in the Supreme Court.

It was decided in the meeting that the Election Commission will prepare the petition soon.

Earlier, the Peshawar High Court suspended the decision of the Election Commission of Pakistan and ordered the restoration of PTI’s election symbol. The court also ordered the ECP to upload the notification on the website.

The court said that the ECP should publish the party certificate under Article 209 of the Election Act, 2017 and the Election Commission should allot the election symbol to PTI under Article 215.

SC to hear PTI’s plea for bat as election symbol on Jan 10

ISLAMABAD: The Supreme Court has fixed the  Pakistan Tehreek e Insaf (PTI) petition filed for the restoration of the bat symbol for hearing on January 10.

During the hearing of the petition related to the PTI level playing field in the Supreme Court, PTI leader Hamid Khan was summoned by the court on which he came to the rostrum.

The Chief Justice asked Hamid Khan whether the PTI plea should be fixed tomorrow. On this, Hamid Khan requested that the hearing be fixed today.

Chief Justice Qazi Faez Isa said that today there is a 9-member bench and there is also a special bench, Hamid Khan said that our priority is today, if not, then tomorrow.

The Chief Justice “asked whether you came against the decision or is there a request for 184/3, Hamid Khan said that he has come to the Supreme Court in 185/3 against the order of the Peshawar High Court”.

The Chief Justice said that if the matter did not go to the Judges Committee then the case was fixed the day after tomorrow.

Later, the court fixed the bat symbol case for hearing on January 10.

ISLAMABAD: The Election Commission of Pakistan(ECP) has decided to file a review appeal against the restoration of Pakistan Tehreek e Insaf’s bat symbol by the Peshawar High Court.

The Election of Commission of Pakistan (ECP) sources said the ECP will file a review appeal in the Peshawar High Court against the decision of the High Court on the issue of bat election symbol.

It should be noted, that the ECP had withdrawn the election symbol of the bat from Pakistan Tehreek-e-Insaaf for not conducting the intra-party election by the party constitution.

However, on December 26, the Peshawar High Court issued a stay order against the Election Commission’s decision to cancel the PTI intra-party elections and withdraw the party symbol.
