Federal Govt to give tax excellence awards to top taxpayers

ISLAMABAD: The Federal Government has decided to encourage taxpayers across the country and tax excellence awards will be given to the highest gross taxpayers.

Prime Minister Shahbaz Sharif will give tax excellence awards to around 59 people. Awards will be given to the highest gross taxpayers, highest tax-paying individuals, companies, and exporters will be encouraged.

In this regard, the list has also been released which includes the 11 highest income taxpayers in Individuals, AOPs, and Companies while the list also includes the 11 taxpayers who pay the highest in all taxes.

Among the awardees are 2 new taxpayers with the highest tax payers, 3 taxpayers from small and medium industries are also shortlisted for the award.

Similarly, among the exporters, 6 IT, 3 textile, and 14 people in other important sectors will be awarded, and 3 people will be awarded among the exporters of one million dollars or more.

3 women exporters of unconventional and innovative products and 3 women exporters will also also among the recipients of the award.

Govt increases prices of petrol, diesel by Rs 35 per litre

ISLAMABAD: The Federal government on Sunday announced increasing the price of petrol and diesel by Rs35 per litre.

Federal Minister for Finance Ishaq Dar while addressing a press conference, announced increasing the price of petrol and diesel by 35 per litre.

Following the changes in the prices, petrol will now be available for Rs249.80  and diesel for 262.80 per litre.

Meanwhile, there has been an increase of Rs18 in the price of high-speed diesel, and Kerosene  oil.

The new prices of high-speed diesel are Rs 187 and Kerosene Oil are Rs 189:83.

Ishaq Dar said that the prices of petroleum products were not increased in the past four months, adding that prices of diesel and kerosene oil also decreased during the period.

The minister went on to say that the speculations had also led to an artificial shortage of petroleum products in the market.

ISLAMABAD: The federal government has restored the previous status of the Pakistan Medical Council (PMC) after receiving assent from the President of Pakistan on the Pakistan Medical and Dental Council Act, 2022 sent by the Parliament.

Spokesperson of the council said, after official signing of gazette notification, the PMDC bill has become now fully functional.

He said that now all matters of the PMDC will be handled as per the guidelines given in the passed bill which was signed by the President of Pakistan to reconstitute the Pakistan Medical and Dental Council in order to establish a uniform minimum standard of basic and higher qualifications in medicine and dentistry, reported the state news agency.

It is pertinent to mention here that the Joint Session of the parliament (Majlis-e-Shoora) passed the Pakistan Medical and Dental Council Bill, 2022 on December 20, 2022. The bill was returned and raised objections by the President of Pakistan Dr. Arif Alvi for further amendments.

MNA Dr. Mehreen Razzaq Bhutto from Pakistan Peoples Party (PPP) presented the bill to reconstitute the Medical and Dental Council in Pakistan (The Pakistan Medical and Dental Council Bill, 2022).

As per the commencement Pakistan Medical and Dental Council Act, 2022, shall stand dissolved and the Minister-in-charge of the Division shall look after the affairs of the council till the constitution of the new council under this act is elected by the council.

The Minister-in-charge of the Division shall exercise the powers of the council during the transitory period.

SHC dismisses petition against tax on foreign assets

KARACHI: The Sindh High Court dismissed petitions that challenged the imposition of tax in respect of foreign assets of a resident individual, including moveable and immovable properties.

The petitioners have assailed the vires of section 8 (2) (b) of the Finance Act 2022, whereby a tax has been levied on the value of assets for the tax year 2022 and onwards in respect of foreign assets of a resident individual which includes moveable and immoveable properties.

The petitioners’ counsel submitted that the parliament is not competent to levy the impugned tax on immovable properties located abroad and the powers of the parliament pursuant to the 18th amendment to the Constitution are now curtailed in respect of levying any tax on immovable properties.

They submitted that the imposition of tax on foreign assets was not within the competence of the parliament as it cannot even legislate in respect of properties outside the territorial limits of Pakistan.

The federal government and the FBR counsel submitted that the petitioners have availed amnesty under the Foreign Assets Act, which was also legislated by the parliament in respect of immovable properties. Therefore, the petitioners cannot object to the competence of the parliament that the capital value of a property located abroad can be taxed by the parliament pursuant to Articles 141 and 142 read with Article 97 of the Constitution.

They submitted that the federal government can levy such tax as provinces cannot legislate in respect of immovable properties located abroad.

The SHC’s bench headed by Justice Mohammad Junaid Ghaffar, after hearing the arguments of the counsel, observed that the concept of taxation in respect of foreign income is now a worldwide phenomenon and the majority of the countries have incorporated the provisions relating to taxing incomes of resident persons.

The court observed that admittedly, the foreign income is not earned within the territorial jurisdiction of Pakistan but in terms of constitutional provisions which empower the parliament to levy taxes on the income of a resident person as his income abroad is also taxed and such tax has never been disputed before the court.

The court observed that the petitioners as well as other taxpayers availed amnesty under the Foreign Assets (Declaration and Repatriation) Act, 2018, and after paying the requisite tax, they declared these properties under their Wealth Tax Returns.

The court observed that these assets are now part of the Wealth Tax Returns of the resident taxpayers, therefore, even otherwise there is a nexus of these properties with the income and wealth of the resident taxpayers and there appears to be no impediment for the parliament to levy the tax in question.

ISLAMABAD: President Dr. Arif Alvi has summoned the session of National Assembly at Parliament House Islamabad on Thursday.

The session has been called under Article 54-1 of the Constitution which will be held at 5 pm. The eleven-point agenda has been released in this regard.

The federal government has included the Islamabad Local Government Elections Amendment Bill 2022 in the agenda to escape from the local body elections in Islamabad, while the Group Insurance Bill 2022 for employees is also included in the agenda of the National Assembly session.

On the other hand, 123 members of the national assembly of Pakistan Tehreek e Insaf (PTI ) have decided to appear before the speaker on the issue of resignation from the membership of the National Assembly.

In this regard, the sources said that the PTI members of the assembly will gather in KP House Islamabad on December 22, while the members will probably come to the parliament under the leadership of Shah Mahmood Qureshi.

ISLAMABAD: Federal Government has announced to close of markets and restaurants at 8 pm to under an energy conservation plan.

Federal Defence Khawaja Asif, Minister for Information and Broadcasting Marriyum Aurangzeb, and Minister of Kashmir Affairs and Northern Areas Qamar Zaman Kaira while holding a news conference in Islamabad said that marriage halls should be closed at 10 pm while markets and restaurants will be closed at 8 pm.

Defence Minister Khawaja Asif said that 20 percent of the workforce in government offices has been proposed to work from home, while this process will save 56 billion rupees annually.

He said that the measures will save a lot in terms of fuel, and will inform the four provinces on various issues in two days.

Khawaja Asif said that 61 percent of the country’s water is used for agriculture. He said in the morning country markets open at noon as nation we don’t make the most of the daylight.

He said that the country is currently suffering from serious economic problems. He said, “If we want to live within our means, then we have to spread our feet by looking at the chador.”

The defense minister said that Pakistan is the only country where markets are open till late at night and it is a long story that will be known in the coming days.

He said that he will discuss the policy with all the provinces tomorrow and the day after tomorrow. The Prime Minister has confirmed the statement of Foreign Minister Bilawal Bhutto. The Foreign Minister has expressed the sentiments of the entire nation in his statement against India.
