In a criminal defamation lawsuit, Indian opposition leader Rahul Gandhi was sentenced to two years in prison.

Mr Gandhi was found guilty by a Gujarat court in 2019 for remarks against Prime Minister Narendra Modi’s surname during an election rally.

He will not go to jail right away because he was given bail for 30 days and will appeal his verdict.

The Congress party MP was present in court for the sentence, which took place a year before the general election.

Mr Gandhi asked during an election rally in Karnataka state in April 2019, before of the previous general election: “Why do all of these thieves have the surname Modi? Narendra Modi, Nirav Modi, Lalit Modi.”

Nirav Modi is a wanted Indian diamond tycoon, whereas Lalit Modi is a former Indian Premier League commissioner who was banned for life by the country’s cricket body. Mr Gandhi claimed that he made the remark to highlight corruption and that it was not intended at any particular community.

Purnesh Modi, a politician from India’s ruling Bharatiya Janata Party, launched the action against him, claiming that Mr Gandhi’s words had defamed the whole Modi community.

Nonetheless, some people are perplexed by the sequence.

Legal scholar Gautam Bhatia tweeted that “references to a generic class of persons” – surnames in this case – are not “actionable unless an individual can show a direct reference to themselves”.

“If a man says ‘all lawyers are thieves’, then I, as a lawyer, cannot file a case against him for defamation unless I can show its imputation aimed at me,” Mr Bhatia said.

The criminal defamation law in India is British-era legislation, with a maximum jail penalty of two years, a fine, or both.

Free speech activists have frequently complained that the law violates free speech principles and is utilised by governments to muzzle their opponents.

In 2016, several prominent Indian politicians, including Mr Gandhi, filed court petitions calling for defamation to be decriminalised. Nonetheless, India’s Supreme Court affirmed the law’s legality, stating that the “right to free speech cannot mean that a citizen can defame the other.”

The Congress party tweeted that Mr Gandhi would appeal and said “we will fight and win”.

Mr Gandhi has not commented publicly yet but has tweeted a quote in Hindi from India’s independence leader Mahatma Gandhi: “My religion is based on truth and non-violence. Truth is my God, and non-violence the means to get it.”

According to his counsel, Kirit Panwala, Mr Gandhi told the judge after the ruling that he delivered the statement “in favour of democracy.”

He also said that their defence of Mr Gandhi was based on four points: “Firstly, Mr Gandhi is not a resident of Gujarat and so, before the complaint, an inquiry should be conducted. Secondly, there is no community named Modi. Thirdly, there is no association of people with Modi as their surname and lastly, there was no ill intention behind Mr Gandhi’s speech.”

After the conviction, some have questioned Mr Gandhi’s standing as a member of parliament.

In India, defamation cannot be used to disqualify someone. An MP can be removed from office for offences ranging from inciting hatred to election-related fraud. They can, however, be disqualified if they are sentenced to two years or more in prison for an offence.

Mr Gandhi is a descendant of the Nehru-Gandhi political dynasty, which has provided India three prime ministers. Jawaharlal Nehru, his great-grandfather, was India’s first and longest-serving prime minister. His grandmother, Indira Gandhi, was the country’s first female prime minister, and his father, Rajiv Gandhi, was the country’s youngest prime minister.

Their party, the Congress, controlled India virtually constantly – with the exception of a few years – from independence in 1947 until 2014, when Narendra Modi’s BJP won a resounding victory. Since then, the Congress has deteriorated into a ghost of its former self, and it was defeated once more by the BJP in the 2019 general election.

Rahul has previously interacted with Swara. She had accompanied him during his Bharat Jodo Pilgrimage in the previous year.

In another video that just surfaced online, Derek O’Brien, the TMC’s leader, and actor and Samajwadi Party leader Jaya Bachchan were also visible. She met and shook hands with Shashi Tharoor when she arrived at the location.

Swara posted images of herself and Fahad from their Qawwali night on Twitter on Thursday. Akhilesh Yadav, the head of the Samajwadi Party and a former chief minister of Uttar Pradesh, attended. Swara tweeted about sharing the images, “Glad and honored to invite Shri Akhilesh Yadav ji to the “Swaad Anusaar” celebrations… Qawwali evening. used the chance to fulfill his brother Pradeep bhaiya’s (brother’s) wish for a photo with his leader. The couple recently stated to Times of India in regards to their marriage, “We are both very conscious and proud of our identities and nobody wants to change anyone. Things that fit both of our traditions were on our agenda. Haldi is a phenomenon that occurs in both. Muslims refer to it as ubtan. There is mehendi on both sides. There is sangeet on both sides. A non-converting interfaith couple in India can only be legally wed in a courtroom under the Special Marriage Act. That’s what we did. We are currently working to establish a shared celebrational culture.

On February 16, Swara made her engagement to Fahad Ahmad public. They chose a judicial marriage, according to the actor’s sharing of their court-issued images.

Rahul Gandhi, the leader of the Congress, attended Swara and Fahad’s wedding celebration in Delhi. Rahul posed for the paparazzi while standing next to Swara, Fahad, and their family members in a video that was posted online. He was spotted conversing with Ira as well. Swara chose a pink and gold lehenga for the event, while Fahad wore a cream sherwani and white pajamas.

On Friday, Swara posted several pictures from her reception to Instagram, some of which also included Fahad. The couple grinned for the camera and displayed various expressions in the photos. In one of the pictures, Swara was given a kiss by Fahad as she grinned. Swara captioned the images, “Presenting Mr. and Mrs. #SwaadAnusaar.”

Swara announced her engagement on Twitter on February 17 and included images of herself and Fahad signing the documents to officially register their marriage. She had penned, “We applaud the #SpecialMarriageAct (despite notice period etc.) It exists at least, and it gives love a chance. @FahadZirarAhmad The right to love, the freedom to select your life partner, the right to marry, and the right to agency shouldn’t be privileges.”

The last time we saw Swara was in the buddy comedy Jahaan Chaar Yaar (2022). Meher Vij, Pooja Chopra, and Shikha Talsania were also featured in the movie. Swara’s upcoming movie appearance is Mrs. Falani.

Together with Dharmendra, Shabana Azmi, Alia Bhatt, and Ranveer Singh, Jaya will appear in the upcoming love drama Rocky Aur Rani Ki Prem Kahani. The movie, directed by Karan Johar, will be released in theaters in July.

At least six people were injured in two blasts in IIOJK on Saturday, ahead of the arrival of Indian opposition leader Rahul Gandhi on a cross-country march, police said.

The blasts occurred in India illegally occupied Jammu’s transport yard in the Narwal area, according to regional police chief Mukesh Singh, as security has been increased ahead of Gandhi’s march, which is expected to arrive in the city on Monday.

Thousands have joined his march against “hate and division,” which aims to turn around the fortunes of the leftist Congress party after it was thrashed by Prime Minister Narendra Modi’s Hindu-nationalist Bharatiya Janata Party in the 2019 election.

Modi wishes to seize control of the Muslim-majority Himalayan region of IIOJK, which is hotly contested by Muslim-majority Pakistan. It has been ruled almost entirely by Muslim prime ministers.

Gandhi’s march, which has been better received by the public than expected, is expected to culminate in Srinagar later this month.

The first blast occurred around 0445 GMT, followed by another explosion, said another police official, who asked not to be named because he is not authorized to speak to the media.

“The whole area has been cordoned off and a search operation is underway,” he said.

Jaswinder Singh, who saw the first blast, said it occurred in a vehicle that was sent to a workshop for repairs.

“There was a big bang and when I came out, I saw a blast had ripped apart a car. Another explosion occurred nearby fifteen minutes later. “The majority of those injured are car mechanics,” he said.

Some of the comments on Vivek’s tweet shared the filmmaker’s views. One Twitter user responded to Rahul’s statement that the pilot had to be ahead of the plane, writing, “If this is what pilots do I am scared! Next time I take a flight I would like to first ensure that the Pilot is firmly seated in the cockpit and is not ahead of the plane.”

Another user shared, “Are you flying the plane or is the plane flying you….make sure please (laughing face with tears emojis).” Yet another joked, “I am flying on Cloud 9 (wink face emoji).” There were also a few Rahul defenders. One user stated, “I can understand that it is difficult to understand simple English and logic when u have a mindset of hating someone.”

On his Bharat Jodo Yatra, which started on September 7, 2022, Rahul is now through Jammu and Kashmir. Several Indian celebrities, including Kamal Haasan, Amol Palekar, Pooja Bhatt, and Swara Bhasker, marched alongside the Congress leader in an effort to draw attention to the major political challenges facing the nation.

Why do Indian politics appear to be so devoid of issues?

Climate change is one of the reasons for water scarcity in India’s hill states: the amount of rainfall and snowfall in the hills has decreased. This is a lived reality, not a fantasy.

However, no one appears to care. In Himachal Pradesh or Uttarakhand, climate change was not an election topic. Parties were not competing to see who had the greatest strategy to tackle climate change.

Some argue that issues such as climate change and air pollution do not become political issues because most people are preoccupied with economic concerns. People are too preoccupied with making a living to care about complex policy concerns. In such circumstances, unemployment and inflation should be significant concerns. However, they are hardly mentioned in contemporary political discourse.

Is there no concern about air pollution? They would not be purchasing air purifiers if they were not. Many people cannot afford an air purifier but would like to have one. Why don’t people put enough pressure on politicians to push them to propose competing solutions for combating air pollution? This was not an issue in the recently held municipal elections in Delhi, which were held amid the peak of the smog season.

Politicians claim that people aren’t concerned enough about these concerns to influence elections. Voters believe politicians are unconcerned about these concerns. It’s a case of chicken and egg.

The Identity Politics Trap

So, what do politicians believe voters care about? Caste, religion, freebies, and power. When asked voters about this during my electoral travels, they blamed politicians.

Why do you vote based on caste? “Because that’s how politicians see us.”

As a result, the most pressing concerns of our time are relegated to the pages of manifestos that no one reads. The fact that these manifestos are presented a day or two before election day demonstrates how important our politicians believe issues are.

Even the worst populist, such as Donald Trump, will go from state to state, making boasts about how many jobs his programs helped create in that state. Climate change has recently been the most contentious subject in Australian elections, aiding in the fall of the incumbent party. People in the United Kingdom care about whether or not the National Health Service is appropriately funded when they vote.

The traditional explanation was that India’s population is not literate or educated enough to engage in complex policy concerns. That is nonsense: there is a big critical mass of Indians who are educated, engaged, and capable of participating in public policy issues.

Public opinion crystallisation

The answer is that no one is taking the initiative in establishing the agenda. A weakened civic society is unable to capture the attention of the media. Our opposition parties are befuddled in an era of BJP dominance, frequently depressed that the public does not respond to them.

If someone had told you in 2010 that India would see a large anti-corruption campaign demanding a new ombudsman, you would have laughed. Lawmaking is not the material of popular uprisings. But that is exactly what happened in 2011. Similarly, in 2011, you could have been disappointed that women’s safety is not a political issue in India. However, it became one in 2012, so much so that women’s safety became an election issue in 2013-14.

Climate change, air pollution, educational quality, the need to boost public investment in health, the necessity for a data privacy law, and even a re-examination of the misuse of special laws can all become major public problems. All they need is a spark. A party, a leader, a non-profit, or the media could be the catalyst.

Who will bell the cat?

Unfortunately, no one appears to want to attempt. People have determined that we, the people, are uninterested. Nobody likes to ring the bell.

Walking from Kanyakumari to Kashmir, from the southern to the northern tip of the Indian peninsula, Rahul Gandhi has wasted his effort in abstraction. He has gone from the philosophical to the transcendental.

Instead of gaining attention on the topics that matter to the public, he’s creating headlines for training students in martial arts and alleging that ‘Rahul Gandhi has killed Rahul Gandhi’. A typical civilian on the route would have no idea what the Bharat Jodo Yatra was about.

The word “leader” means someone who leads. Indian politicians will have to have faith in the people to start setting the agenda, start talking about things that really matter, and make them the center of our politics.
