ISLAMABAD: The Supreme Court of Pakistan has fixed December 14 as the date for hearing the appeal of former Islamabad High Court (IHC) judge Shaukat Aziz Siddiqui against his dismissal by the Supreme Judicial Council (SJC) in 2018.

A 5-member larger bench of the Supreme Court will hear Shaukat Aziz Siddiqui’s petition on December 14.

Chief Justice Qazi Faez Isa will head the five-member larger bench, comprising Justice Aminuddin, Justice Jamal Mandookhel, and Justice Hasan Azhar Rizvi.

Apart from this, Justice Irfan Saadat Khan is also included in the five-member bench.

It should be noted that Islamabad High Court Judge Shaukat Aziz Siddiqui was removed from office on October 11, 2018, for speaking against secret agencies.

The then-senior judge of the Islamabad High Court, Justice Shaukat Aziz Siddiqui, during his speech at the Rawalpindi Bar on 21 July 2018, accused the state institutions of interfering in the judicial work.

Former judge Shaukat Aziz Siddiqui’s statement also drew a reaction from different segments of society, demanding an investigation into the allegations leveled against state institutions.

ISLAMABAD: The Islamabad High Court (IHC) ordered the Federal Investigation Agency (FIA) to conduct forensics on the audio leak of senior lawyer Latif Khosa and former first lady Bushra Bibi.

In the case related to the audio leak of Latif Khosa and Bushra Bibi, the Court said that an investigation should be conducted as to where the audio was released in the first place.

Justice Babar Sattar said the Pakistan Electronic Media Regulatory Authority (PEMRA) should tell how private conversations of people are being aired on TV channels.

Justice Babar Sattar inquired what is the objection of the registrar’s office on the petition.

Latif Khosa said that there is an objection to filing a separate application, how can you file a separate application?

Justice Babar Sattar asked who was recording the audio. Which Latif Khosa said that everyone knows who records, Justice Babar Sattar said that they cannot go on the assumption.

Justice Babar Sattar inquired and said the audio had come on social media, on which Latif Khosa said that the audio was also broadcast by all the TV channels.

Justice Babar Sattar ordered to send a copy of the application to DG ISI and said that DG ISI should also report who released the audio.

The court issued notices to FIA, PEMRA, and PTA on the issue of audio leak of Bushra Bibi and Latif Khosa and adjourned the case till December 11 for further hearing.

KARACHI: Muttahida Qaumi Movement (MQM) Pakistan has started considering filing a petition in the Islamabad High Court(IHC) on delimitation.

MQM-Pakistan raised objections on Malir, Keamari, Baldia, and Korangi constituencies of Karachi in a meeting with the Chief Election Commissioner Sikandar Sultan Raja.

The MQM also raised objections to the merger of the urban section with the rural population in Hyderabad, Sukkur, Mirpur Khas, and Nawabshah.

MQM expressed its serious reservations about the Provincial Election Commissioner and demanded the Chief Election Commissioner remove him from the post.

MQM Pakistan has started considering filing a petition in the Islamabad High Court on the delimitation of constituencies.

“There is a strong possibility that very soon a petition will be filed in the Islamabad High Court after taking a final decision on behalf of MQM Pakistan”.

It should be remembered that on July 6, 2018, Islamabad’s accountability court sentenced Nawaz Sharif to 11 years in prison in the Avenfield reference.

Also, on December 24, 2018, the Accountability Court of Islamabad sentenced former Prime Minister Nawaz Sharif to 7 years in prison and a fine in the Al-Azizia Steel Mills reference.

Earlier, the Islamabad High Court had restored the appeals against the sentence in the Avenfield and Al-Azizia references at the request of PML-N supremo Nawaz Sharif.

A few days ago, the Islamabad High Court acquitted former Prime Minister Nawaz Sharif in the Avenfield reference by annulling his 11-year prison sentence.

During the hearing, the court inquired that there are criminal cases against many people in Islamabad, and why only Shireen Mazari’s name was included. On this, the lawyer said that there are 7 cases registered against Shireen Mazari, and her travel history is quite high.

The court said that it did not matter whether the cases were registered or the travel history was high.

Later, after hearing the arguments of the parties, the court reserved its decision on Shireen Mazari’s request.

ISLAMABAD: Pakistan Tehreek-e-Insaf Vice Chairman Shah Mahmood Qureshi has filed petition in Islamabad High Court for obtaining cipher rules and guidelines.

Pakistan Tehreek-e-Insaf Vice Chairman Shah Mahmood Qureshi has approached the High Court to obtain the cipher rules and guidelines.

Shah Mahmood Qureshi also filed plea to obtain cabinet decisions related to the cipher, both petitions were filed by lawyer Ali Bukhari and lawyer Faiza Asad Malik.

The petition said that petitions were filed in the special court for cipher rules, cabinet decisions. The special court rejected the petitions without using judicial mind and the trial court’s decision not to provide cipher lines, cabinet decisions is against Article 10A.

In the petition, it was requested that the court should set aside the judgments of the trial court dated October 27, November 7 and direct the special court to provide cipher guidelines and rules.

ISLAMABAD: The Islamabad High Court (IHC) has fixed appeals of former prime minister Nawaz Sharif in Avenfield and Al-Azizia references for hearing on November 21.

Chief Justice Amir Farooq and Justice Miangul Hassan Aurangzeb will hear the references.

The court had restored Nawaz Sharif’s appeals on his return from abroad.

It should be noted that Nawaz Sharif was sentenced by the accountability court in Al-Azizia and Avonfield references, while Nawaz Sharif has challenged the verdicts since 2018.

Earlier, Islamabad High Court had reinstated Nawaz Sharif’s appeals against his sentence in the Al-Azizia and Avonfield references.

According to President District Bar Islamabad Qaiser Imam, there was no legal complication in the restoration of appeals, Nawaz Sharif’s appeals had to be restored, and the law is clear, but what is in the decision on Nawaz Sharif’s bail issue has to be seen.

ISLAMABAD: The Islamabad High Court(IHC) rejected the bail plea of Pakistan Tehreek-e-Insaf Vice Chairman and former foreign minister Shah Mahmood Qureshi in the cypher case.

Islamabad High Court Chief Justice Amir Farooq reserved the decision on November 8 after hearing the arguments of the parties.

The prosecution requested Shah Mahmood Qureshi’s bail petition to be rejected.

Earlier, Judge Abul Hasnat Zulqarnain of the Special Court of Official Secrets Act rejected the bail application of Chairman PTI and Shah Mahmood Qureshi, after which Chairman PTI approached the Supreme Court and pleaded for release on bail. Chief Justice Amir Farooq had also rejected PTI chairman’s bail request.

Today, the court rejected Shah Mahmood Qureshi’s bail plea while giving a brief verdict.

ISLAMABAD: The Islamabad High Court (IHC)  reserved its judgement petitions of PTI’s vice chairman Shah Mehmood Qureshi against his indictment and seeking his post-arrest bail in a cipher case.

Prosecutor Raja Rizwan Abbasi and Shah Mahmood’s lawyer Ali Bukhari appeared in the court.

Prosecutor Raja Rizwan objected to Shah Mahmood’s bail petition and said that it was essential for the petitioner to submit the certificate as per the judgment of the top court.

On this, Justice Amir Farooq rejected the objection of the prosecution and asked the FIA to give arguments in the case.

During the hearing, Shah Mahmood’s lawyer said that the trial court had rejected his client’s bail and this is the first petition for bail in the High Court after the trial court rejected the bail. He said, “We attached a photocopy of the document as the original copy was not provided to us”.

Special Prosecutor Raja Rizwan Abbasi argued that the trial court had indicted the accused on October 23, after completing legal requirements. The copies of the case record had also been shared with the defense, he said.

He prayed the court to dismiss the bail petition of the accused.

ISLAMABAD: The Islamabad High Court (IHC) rejected the Pakistan Tehreek e Insaf chairman’s plea against the appointment of a judge who heard the cypher case and upheld the appointment of Judge Abul Hasanat Muhammad Zulqarnain as a special court judge under the Official Secret Act.

Apart from this, Chairman PTI’s plea against jail trial has also been rejected.

Islamabad High Court Chief Justice Aamer Farooq issued a 10-page written decision on the PTI chairman’s request.

According to the decision of the Islamabad High Court, Chairman PTI challenged the notification of the appointment of Judge Abul Hasanat Zulqarnain dated June 27, 2023. There is no legal validity in the appointment of a special court judge under the Official Secrets Act.

The judgment said that under Section 13 a Magistrate or higher court can be appointed under the Official Secrets Act. The assignment of an ATC judge to the Official Secrets Act Special Court is not inconsistent with Section 13.

The verdict further said that the reasons for the jail trial of Chairman PTI are genuine as he is facing security concerns and his decision to jail trial is not based on malice.

The judgment said that according to the record, Chairman PTI was heard in jail given the threat to his life, it is not correct to say that there was abuse of power while issuing the NOC.

In the decision of the Islamabad High Court, it was further said that the petitioners have been mentioning security concerns before the court.

The judgment held that the petition against the jail trial of Chairman PTI is disposed of as not on merit, he can approach the trial court if he has jail trial concerns.

ISLAMABAD:  The Islamabad High Court (IHC) halted the regularization of government employees on the recommendation of a special committee of the National Assembly.

The case against the restoration and regularization of government employees was heard in the IHC on the recommendations of the National Assembly Committee.

The court stopped the ministries and departments from implementing the recommendations of the committee and asked them not to follow the recommendations of EOBI, CDA, Overseas Pakistan Foundation Committee, Pakistan Steel, and FIA Special Committee.

In the court decision, it was said that Pakistan Steel and FIA also should not follow the recommendations of the special committee. If the recommendations of the committee for the rehabilitation of the employees are followed, then the department should cancel these orders.

The court accepted all the requests of the petitioners against the recommendations of the special committee and declared the disciplinary action against the officers illegal for not following the recommendations of the committee.

In the decision, it was said that under the National Assembly Rules of Business, the special committee cannot exceed its powers. The federal government also did not support the recommendations of the special committee.

The High Court said that the recommendations of the special committee had no legal status and the committee had a mandate to send recommendations to the Parliament. The committee had started sending instructions directly to the institutions.

The court said in the judgment that the committee ordered EOBI to reinstate 358 employees in defiance of the court order and all the actions of which gave the impression that the committee was above the law and beyond the constitutional mandate.

There was an impression from the work of the special committee that it was working against the scheme of distribution of authority in the institutions. It was not legal to issue show-cause notices to the FIA ​​officers for criminal proceedings. The court was told that there was nothing in the rules that the committee called the institutions.

ISLAMABAD: The Islamabad High Court(IHC) has fixed the plea of the former Prime Minister and Chairman of Pakistan Tehreek e Insaf(PTI) for a hearing on Monday to suspend the judgment in the Toshakhana case.

Chairman PTI’s miscellaneous petition was decided by the Registrar High Court with objections.

A two-member bench was constituted to hear the petition. Chief Justice Amir Farooq and Justice Babar Sattar are included in the bench.

The district branch of the Islamabad High Court has raised three objections how two types of pleas can be made in one petition, how relief can be sought again in the petition that has already been decided, and in the first petition for suspension of sentence. How can you ask for relief if you have not asked for it?

Chairman PTI has requested to suspend the decision of the Toshakhana case and to make the state a party in the appeal.

Earlier, the former prime minister approached the Islamabad High Court to suspend the disqualification order in the Toshakhana case.

In the petition filed on his behalf, it was contended that the Election Commission had issued a disqualification notification after the conviction in the case and declared him ineligible to contest the elections.

A hearing was held in the Islamabad High Court on the request of Sher Afzal Marwat, a member of the PTI legal team, during which the High Court asked the police and other parties for the details of the cases filed against Sher Afzal Marwat.

Chairman PTI’s wife Bushra Bibi had filed a separate petition against the FIA ​​investigation on the alleged audio leak, arguing that the main case was already pending in this court and the court on September 18 directed FIA ​​to take legal action according to law.

IHC gave inquiry orders over the elevator closure issue

ISLAMABAD: The Islamabad High Court (IHC) ordered the Pakistan Public Works Department (PWD) to conduct an inquiry into the malfunctioning of an elevator in which senior lawyer Latif Khosa got trapped.

The Registrar IHC ordered the DG PPWD to conduct an inquiry into the elevator malfunction and submit a report within two days. Registrar instructed that all lifts of the High Court Building should be inspected and repaired immediately if required.

The registrar ordered that PWD-trained and skilled lift operators should be posted for the High Court Building to avoid any untoward incident in the future.

In the letter written by the Registrar to the DG PWD, it was stated that on August 25, the elevator of the Judges Block broke down and got stuck on the second floor. Senior Lawyer Latif Khosa, other lawyers, and some media representatives were also stuck in the lift.

When the technical staff of PWD was called for checking the lift was showing an overloading error. The technical staff failed to remove the error and evacuate the people trapped in the lift despite several attempts.

Capital Development Authority(CDA)rescue personnel later broke the lift door and pulled out the trapped people.
