ISLAMABAD: The wife of former chief minister Punjab and President Pakistan Tehreek-e-Insaf (PTI) Pervaiz Elahi filed an appeal in the Supreme Court against the decision of the Lahore High Court.

Caretaker Punjab Government, Interior Secretary Punjab, and IG Punjab have been made parties in the petition.

It has been argued in the petition that the Lahore High Court had dismissed Pervaiz Elahi’s petition as ineffectual, and he was re-arrested despite orders for his release.

The High Court did not examine the facts related to the arrest of Pervaiz Elahi.
In the appeal, the Supreme Court has been requested to release Pervaiz Elahi and prevent him from being arrested in any future case.

SC fixes Punjab election review appeal for hearing

ISLAMABAD: The Supreme Court(SC)  fixed a review appeal of the Election Commission of Pakistan (ECP) against the decision to hold an election in Punjab on May 14 for a hearing.

A three-member special bench headed by the Chief Justice of Pakistan Umar Ata Bandial will hear on August 31.
Justice Ijaz-ul-Ahsan and Justice Muneeb Akhtar will be part of the bench while notices have been issued to the parties.

It should be noted that the Supreme Court had ordered on April 4 that elections should be held in Punjab on May 14.
The Election Commission had filed a review petition against the court decision.

Earlier, the SC bench clubbed together pleas against the recently enacted Review Act, 2023, with the ECP’s petition against its April 4 order of holding polls to the Punjab Assembly on May 14.

LAHORE: Jamaat-e-Islami(JI)  has decided to approach the Supreme Court on the issue of delay in the general election.

Jamaat-e-Islami Deputy Ameer Liaquat Baloch and former MNA Abdul Akbar Chitrali have prepared an petition, through Justice (Retd) Ghulam Mohiuddin. The petition will be filed in the Supreme Court next week.

In the petition prepared by Jamaat-e-Islami, the position has been taken that the delay in the general elections by the caretaker federal government is a violation of Article 224 of the Constitution. It is clear, but the election is being delayed on the basis of the meeting between the representatives of the Council of Common Interests(CCI) and the caretaker Chief Ministers.

In the petition, the position has been taken that in the meeting of the Council of Common Interests(CCI), the two Chief Ministers have completed their first term of the caretaker government, now the status of these governments is illegal and unconstitutional.

During the hearing held in the Supreme Court, Justice Athar Minallah said that the Broadsheet had asked to open volume ten for international arbitration. The matter has been settled there and now your application has become ineffective,” the justice said.

During the hearing, Broadsheet’s counsel Latif Khosa said that the matter has not yet become ineffective, let it be known what is in volume ten to keep it secret.

ISLAMABAD: Supreme Court has constituted a bench to hear appeals of Chairman Pakistan Tehreek e Insaf (PTI) in the Toshakhana case.

Chief Justice of Pakistan Umar Ata Bandial has fixed Toshakhana appeals for hearing and a three-member bench headed by him will hear on August 23.

Justice Mazahar Naqvi and Justice Jamal Mandokhail will be part of the bench.

Chairman Pakistan Tehreek-e-Insaf challenged the decisions of the Islamabad High Court on August 3. The Islamabad High Court sent back the issue of Toshakhana being admissible to Judge Humayun Dilawar.

PTI filed an appeal in the Supreme Court against the decision of the Islamabad High Court on August 5.

ISLAMABAD: Minority leader Samuel Pyare filed a separate petition in the Supreme Court for notice on the Jaranwala incident.

In the petition, the Supreme Court has been requested to take notice of the Jaranwala incident, saying that a church was set on fire along with religious documents in Jaranwala on August 16. Court  was pleaded to approves the petitions and appoints the case related to the rights of minorities for hearing.

On the other hand, the blasphemy case regarding the alleged desecration of the Holy Quran in Jaranwala was heard in the Anti-Terrorism Court, where both the arrested accused appeared in the court through a video link.

The court approved the 7-day physical remand of the accused. Both the accused were arrested by CTD Lahore.

A case has been registered against the accused at Jaranwala city police station.

The matter, related to the audio leaks commission headed by Justice Isa, was heard by the Chief Justice of Pakistan Umar Ata Bandial in his chamber.

Lawyer Riaz Hanif Rahi had filed a contempt of court petition against Justice Faiz Isa.

Lawyer Riaz Hanif Rahi withdrew his plea, on the basis of which the matter was disposed of.

It should be noted that recently the Supreme Court of Pakistan had stopped the Audio Leaks Inquiry Commission established under the chairmanship of the nominated Chief Justice Qazi Faez Isa from working.

On May 20, the federal government formed a three-member judicial commission on the issue of audio leaks. The commission headed by the senior-most judge of the Supreme Court, Justice Qazi Faez Isa, included the chief justices of Balochistan High Court and Islamabad High Court.
