Mr Gandhi was found guilty by a Gujarat court in 2019 for remarks against Prime Minister Narendra Modi’s surname during an election rally.

He will not go to jail right away because he was given bail for 30 days and will appeal his verdict.

The Congress party MP was present in court for the sentence, which took place a year before the general election.

Mr Gandhi asked during an election rally in Karnataka state in April 2019, before of the previous general election: “Why do all of these thieves have the surname Modi? Narendra Modi, Nirav Modi, Lalit Modi.”

Nirav Modi is a wanted Indian diamond tycoon, whereas Lalit Modi is a former Indian Premier League commissioner who was banned for life by the country’s cricket body. Mr Gandhi claimed that he made the remark to highlight corruption and that it was not intended at any particular community.

Purnesh Modi, a politician from India’s ruling Bharatiya Janata Party, launched the action against him, claiming that Mr Gandhi’s words had defamed the whole Modi community.

Nonetheless, some people are perplexed by the sequence.

Legal scholar Gautam Bhatia tweeted that “references to a generic class of persons” – surnames in this case – are not “actionable unless an individual can show a direct reference to themselves”.

“If a man says ‘all lawyers are thieves’, then I, as a lawyer, cannot file a case against him for defamation unless I can show its imputation aimed at me,” Mr Bhatia said.

The criminal defamation law in India is British-era legislation, with a maximum jail penalty of two years, a fine, or both.

Free speech activists have frequently complained that the law violates free speech principles and is utilised by governments to muzzle their opponents.

In 2016, several prominent Indian politicians, including Mr Gandhi, filed court petitions calling for defamation to be decriminalised. Nonetheless, India’s Supreme Court affirmed the law’s legality, stating that the “right to free speech cannot mean that a citizen can defame the other.”

The Congress party tweeted that Mr Gandhi would appeal and said “we will fight and win”.

Mr Gandhi has not commented publicly yet but has tweeted a quote in Hindi from India’s independence leader Mahatma Gandhi: “My religion is based on truth and non-violence. Truth is my God, and non-violence the means to get it.”

According to his counsel, Kirit Panwala, Mr Gandhi told the judge after the ruling that he delivered the statement “in favour of democracy.”

He also said that their defence of Mr Gandhi was based on four points: “Firstly, Mr Gandhi is not a resident of Gujarat and so, before the complaint, an inquiry should be conducted. Secondly, there is no community named Modi. Thirdly, there is no association of people with Modi as their surname and lastly, there was no ill intention behind Mr Gandhi’s speech.”

After the conviction, some have questioned Mr Gandhi’s standing as a member of parliament.

In India, defamation cannot be used to disqualify someone. An MP can be removed from office for offences ranging from inciting hatred to election-related fraud. They can, however, be disqualified if they are sentenced to two years or more in prison for an offence.

Mr Gandhi is a descendant of the Nehru-Gandhi political dynasty, which has provided India three prime ministers. Jawaharlal Nehru, his great-grandfather, was India’s first and longest-serving prime minister. His grandmother, Indira Gandhi, was the country’s first female prime minister, and his father, Rajiv Gandhi, was the country’s youngest prime minister.

Their party, the Congress, controlled India virtually constantly – with the exception of a few years – from independence in 1947 until 2014, when Narendra Modi’s BJP won a resounding victory. Since then, the Congress has deteriorated into a ghost of its former self, and it was defeated once more by the BJP in the 2019 general election.

Indian authorities have restricted internet connection for roughly 27 million people in the state of Punjab for the third day in a row, one of the country’s most widespread blackouts in recent years, while police hunt for a fugitive Sikh separatist.

On Saturday, the Punjab government ordered a 24-hour internet restriction as authorities launched an operation to apprehend Amritpal Singh, a popular leader in the separatist Khalistan movement that aspires to establish a sovereign state for Sikhs.

The administration extended the internet shutdown, which affects everyone in the northern Indian state, to midday Monday under a rule that enables the connection to be interrupted to “prevent any incitement to violence and any disturbance of peace and public order.”

Maintaining law and order

Punjab police have justified the internet shutdown as a method of maintaining law and order and preventing the spread of “fake news.”

Hundreds of Singh fans, some brandishing swords and weapons, were seen strolling through the streets of Punjab in dramatic scenes captured on film and shown on local media. In order to maintain peace and order, police and paramilitary personnel were deployed across many districts in the state.

At least 112 people have been arrested, Punjab police reported Sunday, while Singh remains on the run.

For decades, some Sikhs have advocated for the creation of an independent nation called Khalistan in the state of Punjab for adherents of the minority faith. Several lives have been lost in violent battles between adherents of the movement and the Indian government over the years.

The violence peaked in June 1984, when the Indian army attacked the Golden Temple in Amritsar, Sikhism’s holiest shrine, to apprehend armed separatists, killing hundreds and razing much of the structure. The carnage enraged the Sikh community, and Indira Gandhi, who had ordered the operation, was slain by her Sikh bodyguards in the aftermath.

The Khalistan movement is illegal and considered a serious national security danger by the Indian government, yet it retains some support among Sikhs both in India and abroad.

In a statement Sunday, the World Sikh Organization of Canada (WSO) condemned the “draconian” operation to arrest Singh and said it feared “Singh’s detention may be used to orchestrate a false encounter and facilitate his extrajudicial murder.”

Several of Singh’s followers defaced the Indian High Commission in London over the weekend, leading UK authorities to denounce the crime.

Alex Ellis, the British High Commissioner to India, branded the actions “disgraceful” and “totally unacceptable.”

The Indian Ministry of Foreign Affairs said late Sunday that it is “anticipated that the UK government will take immediate action to identify, arrest, and prosecute” individuals involved in the event.

“There is no place in our city for this kind of behaviour. An investigation has been launched by the Met into today’s events,” London mayor Sadiq Khan tweeted Sunday.

India’s internet cuts

Internet outages have become more regular in India, which has over 800 million internet users and is the world’s second biggest digital population, after only China.

According to a report released earlier this month by Access Now, a New York-based advocacy group that analyses internet freedom, India implemented 84 internet shutdowns in 2022, marking the sixth year in a row that the world’s largest democracy of more than 1.3 billion people topped the global list.

The disruptions “impacted the daily lives of millions of people for hundreds of hours,” the report said.

The internet has become a key social and economic lifeline for huge segments of the population, connecting the country’s isolated rural areas with its expanding cities.

The administration has regularly attempted to justify limiting internet access by citing public safety concerns about mob violence. Yet, critics argue the shutdowns are just another blow to the country’s commitment to free expression and information access.

Although both sides’ forces have disengaged from numerous places, Jaishankar stated that conversations are still ongoing on the remaining issues.

“We have made it very clear to the Chinese that we cannot have a breach of peace and tranquility, you can’t violate the agreement and want the rest of the relationship to continue as though nothing happened. That’s just not tenable.”

On the margins of a conference of G20 foreign ministers hosted by India this month, Jaishankar said he discussed the matter with China’s new foreign minister, Qin Gang.

On India’s chairmanship of G20 this year, Jaishankar expressed hope that New Delhi can make the gathering “more true to its global mandate”.

“The G20 should not be a debating club or an arena only of the global north. The entirety of global concerns need to be captured. We have already made that point very forcefully,” Jaishankar said.

Colombia is proposing to move at least 70 hippopotamuses living near Pablo Escobar’s former ranch – descendants of four illegally smuggled from Africa by the late drug lord in the 1980s – to India and Mexico as part of a population control strategy.

The “cocaine hippos,” which may weigh up to 3 tonnes, have expanded well beyond the Hacienda Napoles property, which is located approximately 125 miles from Bogota along the Magdalena River. According to environmental authorities, there are approximately 130 hippos in the Antioquia province area, and their population might reach 400 in eight years.

Escobar’s Hacienda Napoles — and the hippos — have become a sort of local tourist attraction in the years since the kingpin was killed by police in 1993. When his ranch was abandoned, the hippos survived and reproduced in local rivers and favorable climatic conditions.

Experts warn that hippos lack a natural predator in Colombia and are a possible threat to biodiversity because their excrement modifies the chemistry of rivers, threatening the habitat of manatees and capybaras. Colombia’s authorities labeled them a dangerous invasive species last year.

A federal court determined in 2021 after the Colombian government was sued over its plan to sterilize or kill the animals, that the hippos can be regarded as people or “interested persons” with legal rights in the United States. According to a legal expert, the ruling is meaningless in Colombia, where the hippos live.

Hippos kill more people in Africa than any other huge animal. Thus yet, no assaults have been reported in Colombia. But, David Echeverri, who works for the environmental organization in charge of tracking and controlling hippos in the area, told Bojorquez that it’s only a matter of time before someone is injured.

Lina Marcela de los Ros Morales, director of animal protection and welfare at Antioquia’s environment ministry, said the idea to transfer them to India and Mexico had been in the works for more than a year.

The hippos would be coaxed with food into enormous iron containers and transported by truck to Rionegro’s international airport, 150 kilometers distant. They would then be flown to India or Mexico, where there are sanctuaries and zoos that can take in and care for the creatures.

“It is possible to do, we already have experience relocating hippos in zoos nationwide,” said David Echeverri López, a spokesman for Cornare, the local environmental authority that would be in charge of the relocations.

The aim is to send 60 hippos to the Greens Zoological Rescue & Rehabilitation Kingdom in Gujarat, India, which will cover the cost of the containers and airlift, according to De los Ros Morales. Another ten hippos would be sent to Mexican zoos and sanctuaries, such as the Ostok in Sinaloa.

“We work with Ernesto Zazueta, who is the president of sanctuaries and zoos in Mexico, who is the one who liaisons with different countries and manages their rescues,” said the official.

The aim is to concentrate on the hippos that live in the rivers surrounding the Hacienda Napoles ranch, rather than those that live within the ranch because they are in a controlled habitat and do not pose a threat to the local ecosystem.

The relocations would help reduce the hippo population, and while the animals’ native home in Africa, they are more humane than exterminating them as an invasive species, according to De los Ros Morales.

According to the Antioquia Governor’s Office, Ecuador, the Philippines, and Botswana have all expressed interest in relocating Colombian hippos to their respective nations.

Alvaro Molina, 57, declared last year that he favours “cocaine hippos,” despite being one of the few Colombians who has been assaulted by one. He was fishing one day when he felt a disturbance beneath his canoe, causing him to fall into the water.

“The female attacked me once – the first pair to arrive – since she had just given birth,” he explained.

Locals claim that hippos occasionally emerge from the river and walk through the town’s streets. When this happens, traffic comes to a halt and people move out of the way.
