PTI moves ECP against interim governments

ISLAMABAD: Pakistan Tehreek e Insaf (PTI) has field a joint application against caretaker governments in Elections Commission of Pakistan (ECP).

The federal and four provincial governments, 17 District Returning Officers and National Database & Registration Authority(NADRA)  have been made parties in the application of 54 candidates of PTI. Incidents in 49 constituencies have also been mentioned in the petition.

The petition states that PTI is being deprived of its constitutional right by caretaker governments. Candidates, endorsers and recommenders are being arrested from Returning Officers offices.

The candidates said in the application that PTI has submitted the details of the incidents in 49 constituencies. On behalf of PTI, the petition was submitted by lawyer Intizar Panjotha.

It should be noted that the Election Commission of Pakistan has rejected the nomination papers of several PTI leaders from across the country including the Chairman Pakistan Tehreek-e-Insaaf.

On the other hand, the scrutiny of the nomination papers filed by the candidates to contest general elections 2024 concluded on December 30.

Appeals against the acceptance or rejection of nomination papers can be submitted until January 3 and decisions on these appeals will be made by January 10.

The list of candidates will be displayed on the 11th of January, and candidates will have the option to withdraw by January 12.

ISLAMABAD: The Election Commission of Pakistan(ECP) has decided to file a review appeal against the restoration of Pakistan Tehreek e Insaf’s bat symbol by the Peshawar High Court.

The Election of Commission of Pakistan (ECP) sources said the ECP will file a review appeal in the Peshawar High Court against the decision of the High Court on the issue of bat election symbol.

It should be noted, that the ECP had withdrawn the election symbol of the bat from Pakistan Tehreek-e-Insaaf for not conducting the intra-party election by the party constitution.

However, on December 26, the Peshawar High Court issued a stay order against the Election Commission’s decision to cancel the PTI intra-party elections and withdraw the party symbol.

ISLAMABAD: The Election Commission of Pakistan (ECP) has issued guidelines for coverage of general elections scheduled on February 8, 2024.

The ECP has issued a letter to all Returning Officers(ROs) in which SOPs have been issued regarding accreditation cards for domestic observers and media.

According to the letter, all media representatives can apply for the accreditation card.

The Election Commission said in the letter that representatives of local NGOs, civil society can also get accreditation cards. The ECP will provide maximum facilities for the observation and coverage of the election process.

It should be noted that the ECP has set the date of the general elections in the country on February 8, 2024, for which all the candidates have submitted their nomination papers and scrutiny of papers have also started.

PHC restores PTI’s bat symbol

PESHAWAR: The Peshawar High Court(PHC) suspended the Election Commission of Pakistan(ECP) decision nullifying PTI’s intra-party elections and revoking election symbol and restored bat symbol.

The court issued stay-order on the decision of the Election Commission after the arguments were completed. According to the court decision, the decision of the Election Commission will be suspended until the case is decided.

The court has said that the case should be heard in a double bench first after the holidays are over.

In the petition filed by Pakistan Tehreek-e-Insaf in the Peshawar High Court, the petitioners challenging intra-party election and ECP were also made parties, while the decision of the ECP was requested to be annulled.

On the request of PTI, Justice Kamran Hayat Miankhel heard while PTI’s lawyers Ali Zafar, Babar Awan and Chairman PTI Barrister Gohar himself gave arguments.

Earlier, Peshawar High Court (PHC) started hearing the Pakistan Tehreek e Insaf(PTI) plea challenging the Election Commission of Pakistan (ECP) verdict over declaring the intra-party election illegal and revoking its electoral symbol, Bat.

The PHC Judge Justice Kamran Hayat Miankel is hearing the case.

Led by Barrister Gohar and Ali Zafar, PTI’s legal team including Barrister Gohar and Sher Afzal Marwat filed the plea in the Peshawar High Court (PHC), seeking the suspension of the ECP decision.

Lawyer Ali Zafar said the party was given 20 days for holding elections and it held internal party polls on December 2 in Peshawar.

The ECP admitted the veracity of the intra-party elections and issued a certificate to the party.

He said that later the ECP withdrew the electoral symbol objecting to the party’s election commissioner.

ISLAMABAD: President Dr Arif Alvi has approved the removal of Ahad Khan Cheema from his post of Advisor to the Prime Minister for Establishment.

The Caretaker Prime Minister Anwar ul Haq Kakar had sent a summary of the removal of Ahad Cheema from the post on the instructions of the Election Commission of Pakistan (ECP) to the President.

According to the President’s House, the President approved the removal of Ahad Cheema from the post. The President approved the removal of Ahad Cheema from the post on the advice of the Caretaker Prime Minister.

It should be noted that the Election Commission of Pakistan (ECP) had ordered the removal of Ahad Cheema, Advisor to the Caretaker Prime Minister for Establishment.

The Election Commission had asked for the implementation report regarding his removal and had taken notice of the non-receipt of the report, which is to be heard tomorrow.

ISLAMABAD: The Election Commission of Pakistan (ECP) has constituted appellate tribunals to hear the objections on the nomination papers for the upcoming general elections 2024.

According to the notification, five judges of Peshawar High Court will hear objections as tribunal judges while nine judges of Lahore High Court will hear objections on nomination papers as tribunal judges.

Two judges of Islamabad High Court will hear the objections as tribunal judges while two judges of Balochistan High Court will hear the objections as tribunal judges.

According to the notification issued by ECP, six judges of the Sindh High Court will hear the objections on the nomination papers.

It should be noted that the scrutiny of nomination papers for general elections will start from December 25 and the days for scrutiny of papers have been reduced from 7 to 5 days.

Scrutiny will be done till December 30 while appeals against acceptance or rejection of nomination papers can be made till January 3. The Election Tribunal will decide on these appeals till January 10.

ISLAMABAD: The Federal Government has removed Inspector General (IG) Islamabad Akbar Nasir Khan and Deputy Commissioner Irfan Nawaz Memon on the directives of the Election Commission of Pakistan(ECP).

The ECP had ordered the removal of both the IG Islamabad and DC Islamabad from their posts on the complaints of the political parties. However, the ECP summoned the Secretary Establishment on December 26 for not removing them from their posts despite clear orders.

Now, in the announcement issued by the Establishment Division, it has been stated that IG Islamabad Akbar Nasir Khan and Deputy Commissioner Islamabad Irfan Nawaz Memon have been removed from their posts.

In the letter written by Khurram Agha, Secretary of Caretaker Prime Minister Anwarul Haq Kakar to the Secretary Establishment Division, it has been said that the Establishment Division should recommend a panel of officers to replace IG and DC Islamabad.

The Caretaker Prime Minister has also sent the summary of the removal of Ahad Cheema to President Arif Alvi.

ISLAMABAD: The Election Commission of Pakistan (ECP) has established an online facilitation center for the scrutiny of the nomination papers of the candidates participating in the general elections.

ECP spokesperson said the online facility center has been set up at the Election Commission Secretariat in which the National Database & Registration Authority(NADRA), National Accountability Bureau(NAB), Federal Investigation Agency(FIA), Federal Board of Revenue(FBR), and State Bank of Pakistan(SBP)  are assisting.

The spokesperson of the ECP said that the online facility center is working 24 hours a day, and the details of the candidates are being sent to the relevant institutions for necessary action.

The spokesperson of the ECP said that the Secretary of Power Division, Secretary of Petroleum Division, Secretary of National Telecommunication, Secretary of Housing, Chief Secretaries of the four provinces, and Chairman of CDA should get the list of candidates from the returning officers. The list of candidates will be published on December 24, 2023.

The Election Commission said that the defaulting candidates should contact the returning officers between 25 and 30 December during the scrutiny of the documents and all institutions should ensure the collection of dues from the defaulting candidates.

PESHAWAR: Pakistan Tehreek-e-Insaf(PTI) has decided to approach to Peshawar High Court against the Election Commission of Pakistan(ECP) decision on the election symbol case.

PTI central spokesperson Moazzam Butt said that he will go to Peshawar High Court tomorrow against the withdrawal of election symbols by the Election Commission, and has prepared a petition related to the case.

Muazzam Butt said that an effort will be made to set the petition for hearing tomorrow, in the petition it is requested to cancel the decision of the Election Commission and it is stated in the petition that the Election Commission has taken an illegal decision.

PTI’s central spokesperson said that it is illegal to withdraw election symbol at the request of an unauthorized person.

It should be noted that the Election Commission of Pakistan withdrew the bat symbol from Pakistan Tehreek-e-Insaaf for not conducting the intra-party elections according to the party constitution.

LAHORE: The Lahore High Court(LHC) has issued directives to the Election Commission of Pakistan’s lawyer and attorney general, instructing them to facilitate PTI leader Hassan Niazi in signing the election nomination papers.

The Lahore High Court issued a 4-page written decision. Justice Ali Baqar Najafi wrote in the written judgment that according to the petitioner, Hassan Niazi wants to participate in the election, but he is not allowed to sign the nomination papers.

In the judgment, it has been said that the Deputy Attorney General has not mentioned any provision of the Army Act under which the under-trial accused cannot participate in the election, so it should be ensured that Hassan Niazi should sign the papers to participate in the election and he should be allowed do so.

PESHAWAR: The Peshawar High Court(PHC) has fixed the hearing of Pakistan Tehreek e Insaf’s petition to conduct an election under the judiciary’s supervision and issued notice to the Election Commission of Pakistan (ECP).

The petition was filed by PTI’s central spokesperson Muazzam Butt, Advocate.

The case was heard by Chief Justice Muhammad Ibrahim Khan and Justice Shakeel Ahmed.

Last day, the court had ordered to challenge the Election Commission’s notice in the hearing of PTI’s request to conduct the elections under judicial supervision. The court said that this is a national issue and directed to submit a supplementary petition.

The Chief Justice said, “We will not allow anyone to delay the election, we will not delay the election by one day more or less than the scheduled date”.

Today, PTI’s counsel amended the petition and sought suspension of the notification.

The High Court fixed the petition for hearing on December 18, the court sought a response from the Election Commission and the Advocate General’s Office.

ISLAMABAD:  The Election Commission of Pakistan (ECP)  issued the election schedule for the forthcoming polls on February 8, 2024.

According to a notification, the Returning Officer will issue a public notice on December 19, and the period for filing nominations with the Returning Officer will be from December 20 to 22.

The Election Commission of Pakistan stated that the names of nominated candidates will be published on December 23, and the scrutiny of their nomination papers will take place from December 24 to 30.

The deadline for filing appeals against the RO’s decisions on accepting or rejecting nomination papers is January 3, and the appellate tribunal is expected to decide on the appeals by January 10.

The revised list of candidates will be published on Jan 11 and the last date for withdrawing one’s candidature is Jan 12.

Election symbols will be assigned to political parties on January 13, and the polls are scheduled for February 8, as per the ECP announcement.

ISLAMABAD: The Pakistan People’s Party(PPP) has demanded the Election Commission of Pakistan release the schedule of general elections as soon as possible.

People’s Party leader Faisal Karim Kundi said in a news conference “We want elections whether we get a level playing field or not”.

Faisal Karim Kundi said that the People’s Party’s position is that the elections should not go ahead even for a day and they will not tolerate any delay in it.

He said that elections should be held on the same date given by the ECP, Muslim League-Nawaz (PML-N), and Pakistan Tehreek-e-Insaf are playing court games to postpone the election as both parties are afraid of going to public court.

He said “If the ordinances can be issued in the dark, the election can be held in the light of day and added that PPP will not tolerate any postponement of the election.

Faisal Karim Kundi said that Asif Ali Zardari will address a public meeting in Turbat on December 18, while Bilawal Bhutto Zardari will address the Lahore High Court Bar on December 18.
