IHC seeks comments in petition regarding capital’s senate seats

ISLAMABAD: The Islamabad High Court (IHC) sought comments from respondents in a petition seeking to declare domicile of federal capital as compulsory for the candidates contesting elections against the senate seats of Islamabad.

Chief Justice Aamer Farooq heard the petition filed by the former president IHC Bar Council Nayab Gardezi through his counsel Barrister S.M Yawar.

During the course of proceeding, the petitioner’s counsel pleaded that two seats of the upper house have been allocated for the federal capital.

The petitioner prayed the court to declare compulsory for the candidates, contesting senate elections against Islamabad’s seats, for holding a domicile from the federal capital.

IHC restores Bushra Bibi’s appeal for shifting to Adiala Jail

ISLAMABAD: The Islamabad High Court (IHC) restored Bushra Bibi’s appeal for shifting from Bani Gala Sub Jail to Adiala Jail, Rawalpindi.

Justice Miangul Hasan Aurangzeb heard Bushra Bibi’s petition for restoration and accepted the petition for restoration.

The Islamabad High Court accepted Bushra Bibi’s miscellaneous petition for restoration of plea.

The Islamabad High Court dismissed Bushra Bibi’s petition for non-compliance two days ago, on which Bushra Bibi’s lawyers submitted a request to restore the petition on the same day.

The court adjourned the hearing on the application till 22nd while calling for final arguments on the transfer request of Bushra Bibi to Adiala Jail.

ISLAMABAD: The Islamabad High Court (IHC) dismissed Bushra Bibi’s request for transfer to Adiala Jail for non-compliance.

Islamabad High Court Judge Justice Miangul Hasan Aurangzeb heard Bushra Bibi’s request to transfer her from Bani Gala to Adiala Jail and expressed her displeasure over the non-appearance of the petitioner’s lawyers.

Justice Miangul Hasan Aurangzeb said that Bushra Bibi’s lawyer did not appear in the court. Shoaib Shaheen came, but he also left and did not return, even his lawyers do not want Bushra Bibi to go to jail.

Justice Miangul Hasan said, “They are playing politics with the court and it is a joke. They also said that they will decide the case after hearing it today, but they have not come to ask for relief”.

On this occasion, the State Council said that a meeting was held between PTI founder Imran Khan and Bushra Bibi on Eid, on which Justice Miangul Hassan said that this site is also not working well and you are also not doing well.

On the other hand, Bushra Bibi’s lawyer came to the court after the application was dismissed and said that there were obstacles on the way and they were lying down. Justice Mian Gul Hasan said, your application has been dismissed for non-compliance and now you can submit application to reinstate.

Ex-federal minister Fawad Chaudhry released on bail

RAWALPINDI: Former Federal Minister and leader of Istehkam-e-Pakistan Party (IPP) Fawad Chaudhry was released from Adiala Jail after the Islamabad High Court (IHC) approved his bail.

Fawad Chaudhry was granted bail 2 days ago, after which he has now been released.

Fawad Chaudhry reached home after his release from Adiala Jail, upon reaching home his daughters were happy and welcomed their father.

It should be noted that Fawad Chaudhry was imprisoned in Adiala Jail on judicial remand in National Accountability Bureau(NAB) case related to land in Jhelum.

Fawad Chaudhry had approached the Islamabad High Court for bail after his arrest, after which the Islamabad High Court ordered the release of the former federal minister on bail.

The former minister had been behind bars since November 4, 2023, in multiple cases, after he was arrested from his Islamabad residence in connection with a complaint filed against him at Aabpara Police Station.

IHC orders removal of Shireen Mazari’s name from ECL

ISLAMABAD: The Islamabad High Court(IHC) ordered the removal of the name of former Federal Minister for Human Rights Shireen Mazari from the Exit Control List (ECL).

Justice Saman Rafat Imtiaz heard the request to remove Shireen Mazari’s name from ECL in Islamabad High Court, where Shireen Mazari appeared along with her lawyer.

National Accountability Bureau(NAB) Prosecutor Rafay Maqsood said that we had recommended removing Shireen Mazari’s name from ECL in March itself.

According to Rafay Maqsood, Shireen Mazari is not an accused in the 190 million-pound scam case.

The Assistant Attorney General said that we also wrote a letter to the Prime Minister on March 27 and informed them that Shireen Mazari is not involved in this case.

Justice Saman Rafat Imtiaz said that the cabinet has many other tasks, and we will do this work.

IHC orders to release Fawad Chaudhry on bail

ISLAMABAD: The Islamabad High Court (IHC)  ordered the release of former federal minister Fawad Chaudhry on bail.

Islamabad High Court Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahangiri heard the bail petition of Fawad Chaudhry, in which lawyer Qaiser Imam appeared in the court on behalf of the former minister.

Later, the court granted Fawad Chaudhry’s bail after the arguments of the lawyers were completed and ordered his release.

On the bail of Fawad Chaudhry, his brother Faisal Chaudhry said that it is feared that Fawad Chaudhry will be arrested in another false case, it is expected that the courts will protect him from illegal arrest.

It should be noted that Fawad Chaudhry is imprisoned in Adiala Jail on judicial remand in National Accountability Bureau(NAB)  case related to land in Jhelum.

IHC suspends PTI founder, Bushra Bibi’s sentences in Toshakhana case

ISLAMABAD: The Islamabad High Court (IHC) suspended the sentence of Pakistan Tehreek e Insaf (PTI) founder Imran Khan and his wife Bushra Bibi’s sentences in the Toshakhana case and ordered them to be released on bail.

A two-member bench headed by Islamabad High Court Chief Justice Aamer Farooq heard PTI founder Imran Khan and his wife Bushra Bibi’s request for suspension of sentence in the Toshakhana case, in which Imran Khan’s barrister Ali Zafar argued.

During the hearing, the court asked whether the appeal was scheduled for hearing today. “Will not initiate an appeal, argue for suspension of the sentence if you wish”.

On this, Ali Zafar said that instead of suspending the sentence, “we will argue on the central appeal”.

Chief Justice Aamer Farooq said that after hearing the Toshakhana case today, we cannot keep it for hearing tomorrow.

During the hearing of the case, the NAB prosecutor said that the decision has been reviewed and this is a case of suspension of sentence. On this, the court said that this is a highly commendable stand of NAB.

Later, the court suspended the sentence of PTI founder Imran Khan and his wife Bushra Bibi in the Toshakhana case and ordered them to be released on bail.
Chief Justice Aamer Farooq said that the appeal against the sentence will be decided after Eid.

It should be noted that the Toshakhana reference against Imran Khan was filed on September 5, 2022, and the court sentenced Imran Khan and his wife to 14 years in prison on January 31, 2024.

ISLAMABAD:  Former Chief Justice of Pakistan Tassaduq Hussain Jillani has refused for chairing  the inquiry commission on the letter issue of six judges of Islamabad High Court(IHC).

Justice (Retd) Tassaduq Hussain Jillani wrote a letter to Prime Minister Shehbaz Sharif and refused for chairing the commission.

In the letter, the former Chief Justice thanked the Prime Minister, Cabinet, Chief Justice of Pakistan Qazi Faez Isa and the most senior judge of the Supreme Court, Justice Mansoor Ali Shah.

Talking to the media , Justice (retd) Tassaduq Jilani said that he had reservations about the Terms of Reference (TOR) of the Commission.  The judges had addressed the Supreme Judicial Council in their letter, therefore, in his opinion, the Commission is not the proper forum for inquiry.

He also said that the allegations made in the letter are not mentioned in the terms of reference and the letter does not come under the ambit of parameter 209.

It should be noted that two days ago, the Federal Cabinet approved the appointment of Justice (R) Tassaduq Hussain Jillani as the head of the inquiry commission on the issue of the letter of the judges of the Islamabad High Court.

ISLAMABAD:  The federal cabinet has approved constitution of an inquiry commission to probe allegations of the Islamabad High Court (IHC) judges.

Former Chief Justice of Pakistan Tassaduq Hussain Jillani will head the inquiry commission which has been approved by the federal cabinet. A one-member commission comprising Justice (Retd) Tassaduq Hussain Jillani will investigate the matter.

Sources said that the inquiry commission will inquire into the allegations of Islamabad High Court judges and submit its report within 60 days.

Sources said that the Attorney General was specially invited in today’s cabinet meeting and legal opinion was taken from him on the matter.

According to the sources, former Chief Justice Tassaduq Jillani has also been officially contacted and the legal team has also been told that the cabinet has agreed on the name of the former chief justice and the cabinet has given him a full mandate that they can take the help of any agency or institution they need in the investigation.

Sources said that the government’s legal team has been instructed to inform the Chief Justice of Pakistan about the decision that the cabinet has implemented what was decided by him in this regard.

Sources said that when this matter came up for consideration in the cabinet meeting, the bureaucracy and irrelevant people were thrown out while the cabinet members gave the authority to appoint the head of the commission to the prime minister and said that he will make the head of the commission.

ISLAMABAD: The Islamabad High Court (IHC) allowed the leader of Pakistan Tehreek-e-Insaf (PTI) Malik Aamir Dogar to go to Umrah.

Islamabad High Court Chief Justice Amir Farooq heard the request of Aamir Dogar, PTI leader Aamir Dogar was allowed to go abroad once because his name was not on any list.

Islamabad High Court allowed Aamir Dogar to go abroad to perform Umrah and said that Aamir Dogar could go abroad to perform Umrah from April 3 to 9.

The Islamabad High Court issued a notice to the parties for April 22 at the request of Aamir Dogar and directed them to submit an affidavit to the Deputy Registrar.

ISLAMABAD: The Islamabad High Court (IHC) has directed authorities concerned to allow Pakistan Tehreek-e-Insaaf (PTI) to hold its public gathering in Islamabad.

Chief Justice of Islamabad High Court, Amir Farooq, while issuing instructions to the district administration, said that administration should fulfill the conditions that you have to impose, no one’s right of assembly can be taken away.

The Chief Justice of Islamabad High Court said that everyone has done the meetings, the administration should fix the rules and regulations and conditions.

PTI’s lawyer leader Sher Afzal Marwat said that PTI now want to hold a meeting on April 6 in Islamabad, on which the Chief Justice of Islamabad High Court said that party should only take care that there is no riot.

The government lawyer said that permission was not given to the rally due to security concerns, the permission given to them had been violated before, on which Justice Amir Farooq said that there is no problem in imposing normal conditions.

IHC rejects bail plea of accused involved in harassment

ISLAMABAD: The Islamabad High Court (IHC) rejected the bail plea of the accused who spread objectionable photos of the woman on social media.

Justice Tariq Mehmood Jahangiri of Islamabad High Court issued a 6-page written decision rejecting the bail petition of the accused Haseeb, saying that according to the technical review report, the accused committed a serious crime.

The court wrote in its decision that this crime has become very common in society, in many cases girls have even committed suicide, and the accused involved in such crimes do not deserve any exemption.

ISLAMABAD: The Islamabad High Court (IHC) suspended the sentence of Deputy Commissioner Irfan Nawaz Memon in the contempt of court case.

A bench comprising Chief Justice Aamir Farooq and Justice Miangul Hasan Aurangzeb issued the order on the intra-court appeal of DC Islamabad Irfan Nawaz Memon, Senior Superintendent of Police(SSP) Operations Malik Jameel Zafar and Station House Officer (SHO) Margalla Police Station.

The court also suspended the punishment of DC Islamabad Irfan Nawaz Memon, SSP Operations Jameel Zafar and SHO.

The court has suspended the sentence of the three petitioners in the contempt of court case till May 7 and directed to fix May 7 for appeal hearing.

ISLAMABAD: The Islamabad High Court(IHC) has ordered a fixing mechanism for meeting the Pakistan Tehreek e Insaf(PTI) founder in Adiala Jail.

Justice Arbab Muhammad Tahir of Islamabad High Court heard the petition against the order banning meetings with the founder of PTI in jail.

Superintendent Adiala Jail Asad Warriach appeared in the Islamabad High Court and said that hundreds of requests for meetings are receiving.

Lawyer Sher Afzal Marwat said that it has been decided in the court of Justice Sardar Ijaz Ishaq Khan, on which the Superintendent of Adiala Jail said that there was an order that six people will be allowed to visit apart from the lawyers.

The court has allowed 6 people to meet PTI founder daily which is not possible for jail administration and there were 7,000 prisoners in the jail.

Justice Arbab Tahir talking to the Superintendent of Adiala Jail said that jail administration comes with a new objection every day.

Superintendent Adiala Jail Asad Waraich said, “I am also following the order of the court, this is also the notification of the Punjab Home Department”.

The court told the superintendent of Adiala Jail that it was decided on your terms that when will it meet, there are already contempt of court petitions against you.

IHC seeks report on presence of Bushra Bibi in Sub Jail

ISLAMABAD: The Islamabad High Court (IHC) ordered the senior officer of the administration to visit the sub-jail Banigala and sought a report on the presence of Bushra Bibi in the sub-jail.

In the Islamabad High Court, a hearing was held on the petition for the transfer of Bushra Bibi from Banigala to Adiala Jail, in which Bushra Bibi’s lawyer said that Bushra Bibi had been locked in a room in Banigala’s house, the court should appoint a bailiff, who should go there and see and give a report today.

The lawyer said that when Bushra Bibi reached Adiala, the Superintendent of Jail had no authority to transfer her to Banigala.

The public prosecutor said in the court that Bushra Bibi is the former first lady, she was transferred to Banigala for her safety.

The court directed to submit the report of the superintendent jail order to the registrar and said that the superintendent jail order should be passed regarding the meeting between Imran Khan and Bushra Bibi.

ISLAMABAD: The appointment of former Caretaker Chief Minister Punjab Mohsin Naqvi as Chairman Pakistan Cricket Board was challenged in the Islamabad High Court(IHC).

The Chief Justice of Islamabad High Court asked the lawyer during the hearing on the petition why are you saying that the appointment was wrong.

The petitioner’s lawyer said that according to the constitution, there is a difference between the elected and the caretaker prime minister, the caretaker prime minister cannot be the patron of the Pakistan Cricket Board, and the authority to appoint the chairman PCB as patron rests with the prime minister.

The Chief Justice said that you are saying that the caretaker prime minister did not have this authority.

During the hearing, Chief Justice Islamabad High Court Amir Farooq got angry when the petitioner’s lawyer spoke while writing the order and said that if you are speaking while writing the order, then he would not write it, and wait for his order.

Later, Chief Justice of Islamabad High Court Amir Farooq reserved the decision as the petition was admissible.

IHC makes notification of 3 constituencies subject to decision of ECP

ISLAMABAD: The Islamabad High Court(IHC) made the notification of the success of three constituencies of the federal capital subject to the decision of the Election Commission of Pakistan (ECP).

Islamabad High Court Justice Miangul Hasan Aurangzeb and Justice Arbab Tahir heard the petitions against the election results and notification of the three constituencies of Islamabad.

During the hearing, Justice Miangul Hasan said that the notification for the formation of election tribunals had come before this court, but the petitioner hid this notification from the court.

The court said that the ECP itself issues a stay order and issues a notification by itself. This situation raises serious questions about the work of the constitutional body. If the commission declares the complaints valid, what will happen to the notification?

The court remarked that the notification is subject to the decision of the Election Commission on the petitions, the returning officer refused the consolidation, and later the notification took place, therefore the court issued a notice to the ECP by injunction.

The court upheld the suspension of the notification of successful candidates in the three constituencies of Islamabad and said that the notification will remain suspended till the decision of the applications pending in the ECP.

ISLAMABAD: The Islamabad High Court was approached for the medical check-up of the wife of Pakistan Tehreek e Insaf(PTI) founder Bushra Bibi.

Founder PTI’s sister Uzma Khan approached the Islamabad High Court for the medical checkup of Bushra Bibi.

The petition stated that Bushra Bibi is confined in Banigala’s residence after being convicted in the Toshakhana case, requesting that the family physician Dr. Asim Yusuf be allowed to conduct a medical check-up of Bushra Bibi.

In the plea, it was requested that the senior doctors of the Pakistan Institute Of Medical Sciences(PIMS) should also be given orders for medical examination in the presence of Dr. Asim Yusuf.

It should be remembered that a few days ago Maryam Watto, the sister of the former first lady, claimed that Bushra Bibi was given something to eat six days ago, after which her health deteriorated, she is in pain and has not been able to eat anything for six days.

The sister of the former first lady said that Bushra Bibi is given jail food while home food is not allowed.

She demanded that the authorities concerned investigate the matter.

ISLAMABAD: The Islamabad High Court(IHC) summoned the Caretaker Prime Minister Anwarul Haq Kakar again following his skip from hearing in Baloch missing students case.

The hearing of Baloch missing student’s case was headed by Justice Mohsin Akhtar Kayani.

Justice Mohsin Akhtar Kayani said that it took two years to recover the citizens of the country and there is no case against them, including fights, narcotics, and other sensitive cases of missing persons. The children could not be recovered in 24 months.

Justice Mohsin Akhtar Kayani inquired whether the 12 missing students have not been recovered yet. On which Attorney General Mansoor Usman said that according to his information, 8 students have not been recovered yet.

The court asked where are the caretaker ministers, defence secretary and interior secretary. The Prime Minister did not come for the second time.

ISLAMABAD: The Islamabad High Court(IHC) restrained the caretaker government from restructuring the Federal Board of Revenue (FBR).

Islamabad High Court Justice Miangul Hasan Aurangzeb heard the petition of the FBR officer in which the petitioner took the position that the restructuring of the FBR is not the mandate of the caretaker government. The caretaker government should be prevented from restructuring the FBR.

The petitioner’s lawyer said that the committee was formed despite the Election Commission of Pakistan(ECP) stopping it under the Election Act 2017.

After hearing the arguments of the counsel, the court suspended the notification of setting up the restructuring committee of FBR.

ISLAMABAD: Former first lady Bushra Bibi, wife of Pakistan Tehreek e Insaf (PTI) founder, approached the High Court (IHC) for transfer to Adiala Jail.

Imran Khan’s wife Bushra Bibi filed a petition in the Islamabad High Court for transfer to Adiala Jail, in which it is said that all citizens are equal in the eyes of the law, so she wants to serve the sentence in Adiala Jail like any common prisoner. Political workers are in prisons with ordinary prisoners, and transfer to the Banigala sub-prison is against equal rights.

Bushra Bibi has further stated in her plea that after waiting in Adiala Jail from 10 am to 9 pm on January 31, she was moved to Sub Jail.

Bushra Bibi has requested in her petition that the notification of January 31 of the Chief Commissioner Office Islamabad and the notification of the administration declaring Banigala as a sub-jail should also be annulled.

ISLAMABAD: Islamabad High Court restored the 10-year disqualification period for National Accountability Bureau(NAB) convicts.

Islamabad High Court Justice Mohsin Akhtar Kayani and Justice Saman Rafat Imtiaz heard the appeal of NAB in which Senior Special Prosecutor NAB Muhammad Raffay appeared in the court.

At the beginning of the hearing, Justice Mohsin Akhtar Kayani asked what is written in Articles 62(1) H regarding disqualification, On this, the NAB prosecutor argued in favor of the 10-year disqualification of the convict of NAB, saying that the sentence of Mir Faiq Ali Jamali has been upheld by the Supreme Court and according to the NAB law, the disqualification will remain for 10 years.

After the arguments of the NAB prosecutor, the court suspended the decision of the single bench and issued a stay order on it, while the court restored the 10-year disqualification period for the NAB convict.

ISLAMABAD: Islamabad High Court(IHC) declared the powers given to the Deputy Commissioners to send anyone to jail under Section three of the Maintenance of Public Order (MPO) illegal.

Pakistan Tehreek e Insaf (PTI) leader Shehryar Afridi and Shandana Gulzar were arrested under 3 MPO and the case was heard in Islamabad High Court.

Justice Babar Sattar of the Islamabad High Court gave reserved judgment allowing the pleas of Shehryar Afridi and Shandana Gulzar against the MPO order.

The Islamabad High Court said that the Deputy Commissioner Islamabad does not have the authority to issue three MPOs, this authority should be vested only in the Federal Cabinet.

The Islamabad High Court disposed of the petition of Shehryar Afridi and Shandana Gulzar declaring Section 18 of the 3MPO Act, 1980 as illegal.

Justice Miangul Hasan said that the Islamabad High Court had given a decision on the arrest of a person arrested in one case in another case. He said, “If the decision of this court is not challenged, then it becomes final”.
