ECP files review plea to seek SC clarification on reserved seats

ECP

ISLAMABAD: The Election Commission of Pakistan (ECP) has filed a review petition in the Supreme Court (SC), seeking clarification on some points after the detailed order in the reserved seats case.

Since the detailed order has been issued, additional grounds have been added in the already filed review petition, said a press release issued here Thursday.

The parliament introduced new provisions regarding reserved seats in the  Act, and the ECP wants to know whether to follow the new law or the Supreme Court’s order so CMA has been filed, it further said.

The ECP has been deliberating on the situation after the SC’s detailed order and the amendment of the Election Act by the Parliament for the last  few days.

It should be noted that a few days ago Speaker National Assembly Sardar Ayaz Sadiq had written a letter to the Chief Election Commissioner in which it was said that reserved seats should be allotted according to the Election Act Amendment Bill while maintaining the independence of the Parliament.

In his letter, he had written that a member of parliament who did not submit a party certificate along with his nomination papers would be considered an independent and independent members who became part of a political party could not be allowed to change parties.

PPP files review petition on SC reserved seats’ judgment

PPP

ISLAMABAD:  Pakistan People’s Party (PPP) filed a review petition against the Supreme Court’s July 12 verdict on reserved seats allotted to the Pakistan Tehreek-e-Insaf (PTI) after the Pakistan Muslim League-Nawaz (PML-N) had filed review plea.

On behalf of the PPP, Lawyer Farooq H. Naek filed a review appeal in the Supreme Court, in which 11 persons, including Hamid Raza, the Election Commission of Pakistan and the Sunni Ittehad Council, have been made parties.

In PPP’s appeal, it has been argued that the Chairman Sunni Ittehad Council Hamid Raza participated in the elections as an independent candidate, if no one from the SIC contested the election, reserved seats cannot be given.

It has been said in the appeal that PTI did not file an application, neither became a party. The PTI cannot be given reserved seats and PTI has been given seats without asking.

The People’s Party raised the question whether specific seats can be left vacant or given to a party that has contested the elections. “Can specific seats be given to a party whose candidate has not won a national or provincial seat”.

In its review appeal, the PPP has requested to withdraw the July 12 judgment on reserved seats.

It should be noted that earlier, PML-N has filed an appeal to review the decision on specific seats, while no decision has been taken by the government in this regard.

On July 12, the Supreme Court upheld the petition of the Sunni Ittehad Council regarding the reserved seats and annulled the decision of the ECP and the Peshawar High Court.

PML-N files review plea against SC’s reserve seats verdict

PML-N

ISLAMABAD: The Pakistan Muslim League-Nawaz (PML-N) has filed a review petition against the Supreme Court’s decision to give reserved seats to Pakistan Tehreek-e-Insaf(PTI).

PML-N in the petition filed by the League, 11 parties, including the Sunni Ittehad Council, Hamid Raza and the Election Commission of Pakistan, have been made parties, while in the petition, a stay order injunction has been requested on the decision of the Supreme Court on July 12.

It has been argued in the petition that the decision of the Supreme Court is completely silent on a few points, should the Sunni Ittehad Council get specific seats. The decision is silent, should such a party get reserved seats which has not submitted the list itself.  The verdict is silent.

The petition states that whether an independent candidate can join a party whose one winning candidate is not present in the assembly. Should the seats be left vacant or distributed among the parties that contested the elections. The Supreme Court heard a lot of points but the short judgment is silent on many important points.

The matter was referred to the Judges Committee for interpretation of the constitutional point under the Practice and Procedure Act and constitution of a larger bench.

Speaker Khyber Pakhtunkhwa Assembly had filed appeals against the Peshawar High Court’s decision while the Election Commission of Pakistan had given a decision not to give reserved seats to the Sunni Ittehad Council, which was upheld by the Peshawar High Court.

ECP postpones Senate election in Khyber Pakhtunkhwa

ECP

PESHAWAR: The election Commission of Pakistan (ECP) notified postponement of Senate polls to the extent of Khyber Pakhtunkhwa till the administration of oath to the elected members against the reserved seats.

A notification issued here said that the commission was of the considered view that all the standards of honesty, justness, and fairness of election could not be fulfilled due to non administration of oath to elected members.

It added that non administration of oath was tantamount to disenfranchisement of lawful voters and denial of level playing field to them. Thus the electoral college was incomplete for the purpose of the Senate elections in Khyber Pakhtunkhwa.

The opposition members in Khyber Pakhtunkhwa assembly on Tuesday submitted a request to the provincial election commission for postponement of elections in the province.

MPA Ahmed Karim Kundi submitted the request, signed by 25 members, on behalf of the opposition. He maintained that the KP assembly speaker had not administered oath to the elected members against reserved despite verdict of Peshawar High Court.

It is worth mentioning here that the KP assembly speaker had already filed a review petition on the PHC verdict.

Earlier, the teams of Election Commission reached the House here on Tuesday for the polls well before time but the proceedings couldn’t start as per the scheduled time of nine o’clock.

The Provincial Election Commissioner contacted the Chief Election Commissioner on the request of the opposition for postponement of elections.

PHC issues written order on petition regarding reserved seats

PHC

PESHAWAR: The Peshawar High Court(PHC) has issued a detailed decision in the case filed by the Sunni Ittehad Council (SIC) about allocation of reserved seats.

The five-member bench of the Peshawar High Court had given a brief verdict on March 14, but now Justice SM Ateeq Shah of the High Court has issued a detailed verdict containing 30 pages, in which it has been said that the decision of the Election Commission  of Pakistan(ECP) to distribute certain seats is in violation of Article 51.

Accordingly, the High Court has jurisdiction to hear cases of reserved seats up to the province.

The judgment said that the petitioner objected that the reserved seats cannot be distributed to other political parties, the Sunni Ittehad Council is not entitled to the reserved seats for women. The list of reserved seats cannot be submitted after the prescribed time, so the petition is dismissed.

The court further said in its judgment that a political party participating in the election is entitled to reserved seats but a party that does not win a single seat in the general election is not eligible for reserved seats.

SIC moves LHC over denial of reserved seats

SIC

LAHORE: Chairman Sunni Ittehad Council (SIC) has challenged the Election Commission of Pakistan’s (ECP) decision to deny them reserved seats in the Punjab Assembly in the Lahore High Court.

In the petition filed by the Chairman Sunni Ittehad Council, the Election Commission of Pakistan has been made a party, in which it has been said that the ECP is neither a tribunal nor a court.

In the petition, the stand was taken that the Sunni Ittehad Council should get reserved seats according to the proportion of seats in the Punjab Assembly, it does not matter whether the Sunni Ittehad Council contested the election or not.

In the application of Sahibzada Hamid Raza, it is also said that the action of the ECP is equivalent to amending the Constitution, the decision of the ECP is beyond its powers.

It should be remembered that a few days ago, the Election Commission Pakistan (ECP) rejected the Sunni Ittehad Council’s request for specific seats by four to one.

The party lost 77 reserved seats due to the rejection of the Sunni Ittehad Council’s request and these seats went to the Pakistan Muslim League-Nawaz(PML-N), Pakistan People’s Party, Muttahida Qaumi Movement and Jamiat Ulema-e-Islam(JUI).
