Justice Sarfaraz Dogar appointed as acting IHC CJ

ISLAMABAD: Justice Sarfaraz Dogar has been appointed as the acting Chief Justice of the theIslamabad High Court (IHC) following the elevation of judges to the apex court.

The Ministry of Law and Justice has issued a notification stating that Justice Sarfaraz Dogar will perform duties till the appointment of a permanent Chief Justice.

It is to be noted that the Judicial Commission of Pakistan has approved the appointment of Chief Justice Islamabad High Court Aamer Farooq to the Supreme Court in the past, and approved the appointment of Justice Miangul Hassan Aurangzeb as acting judge.

In addition, a notification for the appointment of six permanent judges and a temporary judge of the Supreme Court was also issued.

The Ministry of Law and Justice issued a notification after the approval of the President, according to which Justice Hashim Kakar, Justice Shafi Siddiqui, Justice Salahuddin were appointed judges of the Supreme Court.

According to the notification, Justice Shakeel Ahmed, Justice Aamer Farooq and Justice Ishtiaq Ibrahim were also appointed judges of the Supreme Court.

The notification stated that Justice Miangul Hassan Aurangzeb has been appointed under Article 181 and 175A Acting Judges while Justice Ejaz Swati has been appointed acting Chief Justice Balochistan High Court.

According to the notification, Justice Ejaz Swati will perform duties till the appointment of Permanent Chief Justice Balochistan High Court.

Ministry of Law prepares summary of appointment of 7 new judges

ISLAMABAD: The Ministry of Law has prepared a summary of the appointment of seven new judges in the Supreme Court.

According to sources, the Ministry of Law will send the summary of the appointment of the judges to the government for final approval and Law Ministry will issue notification after approval from President of Pakistan.

Sources said that the summary of the appointment of new judges in the Supreme Court will be sent to the President today.

On the other hand, three rooms have been set up for the courts on the appointment of new judges in the Supreme Court. All arrangements for hearing of the cases have been finalized in the new courts.

Earlier,  Judicial Commission of Pakistan (JCP) has approved  the appointment of six judges in the apex court.

Pakistan Tehreek-e-Insaf (PTI) lawmakers and two Supreme Court judges boycotted the Judicial Commission of Pakistan’s meeting for the appointment of new judges to the supreme court.

A Judicial Commission meeting chaired by Chief Justice Yahya Afridi was held.  The meeting demanded the postponement of the meeting till the decision on the 26th Constitutional Amendment, but voting on this objection, the majority decided that the meeting would be continued.

Registrar SC sends three names for new CJP appointment

ISLAMABAD: Registrar Supreme Court (SC) has send three names for the new Chief Justice of Pakistan to Special Parliamentary Committee.

The Registrar of the Supreme Court has sent three names to the Special Parliamentary Committee on behalf of Chief Justice of Pakistan Qazi Faez Isa.

Sources said that a letter was written to the Registrar Supreme Court on behalf of the Ministry of Law, in which the names of three senior judges were sought for the new Chief Justice.

The names of Justice Mansoor Ali Shah, Justice Muneeb Akhtar and Justice Yahya Afridi have been sent for the new Chief Justice.

After the implementation of the 26th constitutional amendment, the parliamentary committee meeting for the appointment of the new Chief Justice will be held today and the appointment of the new Chief Justice will be done three days before the retirement of the current Chief Justice Qazi Faez Isa.

Chief Justice Qazi Faez Isa has moved to chamber work before retirement where he will write judgments these days.

Shariat Court moved to make 2nd marriage easy

ISLAMABAD: A petition was filed in the Federal Shariat Court Lahore Registry to declare the law of seeking the permission of the first wife for second marriage null and void.

In the plea filed in the Federal Shariat Court Lahore Registry, it has been held that the law of permission from the first wife for second marriage is not only against the Constitution but also against the Shariat.

In the petition, it has been argued that according to the Pakistani constitution, no law can be made against Islamic principles, according to the constitution, anti-Islam law can be challenged in the Federal Shariat Court.

It has also been said on behalf of the petitioner that according to the research, there are a lot of women above 35 years of age waiting for marriage in Pakistan. The court should declare the law of permission from the first wife to be null and void as it is against Islam.

The Ministry of Law, Council Islamic Ideological and others have been made parties in the petition.

It should be remembered that some time ago, the Family Court of Lahore sentenced a person 7 months imprisonment who married a second wife without the permission of his first wife.
