Morocco sues Spain reporter over spyware bugging claim

Morocco has filed a lawsuit against a Spanish journalist who claimed his phone was targeted by Pegasus spyware planted by Rabat, according to judicial sources.

A court in Madrid accepted the complaint against Ignacio Cembrero, an expert on Spain-Morocco relations who works for the news website El Confidencial, according to a spokesman for the regional court authority.

Last year, an investigation by 17 media organizations accused Morocco of using Israeli-made spyware, which infiltrates mobile phones in order to extract data or to activate a camera or microphone to spy on their owners. Rabat has denied the allegations.

According to a copy of the complaint seen by AFP, Morocco is demanding that Cembrero withdraw his allegations and pay Morocco’s legal costs.

“The Kingdom of Morocco is not involved in spying on Ignacio Cembrero nor on any other citizen” and “does not have the Pegasus programme”, the lawyer representing Rabat said.

Cembrero had also flagged the lawsuit on his Twitter account.

“Morocco is taking me to court for accusing it of spying with Pegasus,” he tweeted on Monday.

He has said it is “the fourth time” Morocco had sued him in Spain but the first time it had demanded he “retract” claims Rabat was responsible for spying with Pegasus software.

“It’s a political trial to curtail journalists’ freedom of expression,” he tweeted.

A vast investigation by more than 80 reporters in 10 countries revealed in July 2021 that Pegasus spyware had been used against at least 50,000 people around the world.

They included at least 180 journalists as well as human rights defenders, politicians and military top brass.

The information was first leaked to Amnesty International and French NGO Forbidden Stories who then shared it with more than a dozen media organizations.

Morocco was singled out as one of the countries that had purchased the programme from Israel’s NGO Group and had used the spyware against journalists.

According to Forbidden Stories, Cembrero’s phone was one of several phones targeted “for targeting” by Pegasus.

President Joe Biden on Thursday said the United States should go ahead with the delayed sale of F-16 warplanes to Turkey but noted that Congress needs to give approval.

“We should sell them the F-16 jets and modernize those jets as well,” Biden said, adding there was “no quid pro quo” linking the sale to Turkey’s approval for Finland and Sweden entering NATO.

Biden added that for the sale, “I need congressional approval to do that and I think I can do that”.

The declaration of support from Biden comes after Turkey surprised fellow NATO members at a summit in Madrid by suddenly dropping weeks of opposition to the Finland and Sweden applications to join the alliance.

Unanimous consent by NATO members is required for enlargement.

Turkish President Recep Tayyip Erdogan said he would send a delegation to the United States “without delay” to convince lawmakers to swiftly approve the sale.

“It’s necessary to get support from both Democrats and Republicans. Despite all this, Mr Biden is confident. I hope that we will get a result that fits our friendship and solidarity,” Erdogan told a news conference in Madrid.

Turkey is an important NATO member in a strategically sensitive location, but it has had often tense relations with its European partners and Washington, which is the alliance’s main military force.

“In politics, yesterday was yesterday, today is today,” Erdogan said.

“In politics, a lot can change in 24 hours… There were good days and bad days but Turkish-US relations have continued,” he said.

A plan to equip Turkey with state-of-the-art US F-35 stealth fighters fell through after Turkey bought Russia’s S-400 anti-aircraft missile system.

Washington saw Ankara’s purchase as potentially threatening the security of the F-35 program.

Turkey then set out to purchase new F-16s as well as upgrade its existing but outdated fleet of the same planes.

However, that agreement is also on hold, and there has been speculation that Turkey is delaying the two northern European countries’ NATO accession bids in order to gain concessions.

Russian troops abandoned their positions on a captured Ukrainian island on Thursday, a major setback to their invasion effort that weakens their blockade of Ukraine’s ports, defence officials said.

The Black Sea news came as NATO leaders concluded their summit in Madrid, intent on demonstrating their unity and determination to provide advanced weapons to Kyiv in the face of Moscow’s assault.

Snake Island became a symbol of Ukrainian resistance in the first days of the war, when the rocky outcrop’s defenders told a Russian warship that called on them to surrender to “go f*ck yourself,” an incident that spurred a defiant meme.

It was also a strategic target, sitting aside shipping lanes near Ukraine’s port of Odessa. Russia had attempted to install missile and air defence batteries while under fire from drones.

Now, however, Ukraine has begun to receive longer range missiles and military gear from its Western backers, and the Russian position on Snake Island seems to have become untenable.

“In the end, it will prove impossible for (President Vladimir) Putin to hold down a country that will not accept his rule,” British Prime Minister Boris Johnson said, stressing that any eventual peace deal would be on Ukraine’s terms.

“We’ve seen what Ukraine can do to drive the Russians back. We’ve seen what they did around Kyiv and Kharkiv, now on Snake Island.”

The Russian defence ministry statement described the retreat as “a gesture of goodwill” meant to demonstrate that Moscow will not interfere with UN efforts to organise protected grain exports from Ukraine.

But Kyiv claimed it as a win.

“They always downplay their defeats this way,” Ukraine’s Foreign Minister Dmytro Kuleba said on Twitter.

“I thank the defenders of Odessa region who took maximum measures to liberate a strategically important part of our territory,” Valeriy Zaluzhny, the Ukraine military’s commander-in-chief, said on Telegram.

In peacetime, Ukraine is a major agricultural exporter, but Russia’s invasion has damaged farmland and seen Ukraine’s ports seized, razed or blockaded — threatening grain importers in Africa with famine.
