IHC seeks details of provided facilities to PTI founder

ISLAMABAD: The Islamabad High Court (IHC) sought report from administration of Central Jail Adiala Rawalpindi regarding the provided facilities to PTI founder Imran Khan in prison.

Chief Justice Aamer Farooq heard the case seeking provision of facilities to PTI founder Imran Khan in jail as per the rules.

During the course of proceeding, the chief justice questioned that what facilities are being given to the PTI founder. He said that let the court first ask the Adiala Jail officials about the facilities being provided to PTI founder.

The court directed the jail authorities to tell the ground realities and submit the report by August 22.

On the occasion, PTI founder’s lawyer Azhar Siddiq adopted the stance that his client was not given permission to talk to his sons through WhatsApp.

The lawyer said that the PTI founder lacks refrigeration facilities, which affects the quality of his food.

At this, the chief justice remarked that let the jail authorities submit the report so that things could get cleared.

The court adjourned further hearing of the case till August 22, while seeking report from jail administration.

Court acquits PTI founder, Bushra Bibi in Iddat case

ISLAMABAD: An Additional District and Sessions Court acquitted Pakistan Tehreek e Insaf (PTI) founder Imran Khan and Bushra Bibi in the iddate case.

Additional district and sessions court Judge Muhammad Afzal Majoka pronounced the reserved verdict and declared the trial court verdict null and void.

The court accepted ex-PM Imran Khan and Bushra Bibi’s pleas seeking annulment of conviction in the iddat case.

Judge Afzal Majoka ordered the release of Imran Khan and his wife Bushra Bibi if they are not wanted in any other case and also dismissed the medical board’s plea.

Justice Afzal Majuka pronounced verdict on the appeals against the convictions of Imran Khan and Bushra Bibi in the Iddat case, in which the court said that both the appeals related to the opinion of the medical board and the scholars are rejected.

The court declared the sentences of both as null and void and ordered acquittal.

The court issued orders for the release of Imran Khan and Bushra Bibi.

The court allowed the appeals against the sentence of Imran Khan and Bushra Bibi in the Iddat case and declared the sentence null and void and acquitted both of them from the case.

New York: The United Nations(UN) Human Rights Working Group has termed the decision to detain Pakistan Tehreek e Insaf founder Imran Khan as arbitrary and against international law.

The legal opinion of the UN Working Group has come out on the petition filed in the United Nations by the eminent law firm of Zulfi Bukhari against the arrest of founder PTI Imran Khan, in which the immediate release of Imran Khan has demanded.

A report by the United Nations Human Rights Working Group said that there was no legal justification for the arrest of the PTI founder, apparently aimed at disqualifying him.

The report called on the government to allow the working group to visit Pakistan and conduct an independent investigation into the conditions in the PTI founder’s prison.

The working group has expressed concern that the founder PTI was not given the right to defend itself while the right to cross-examine the lawyers was taken away and given to the government lawyers.

ISLAMABAD: Pakistan Tehreek e Insaf(PTI) founder and former prime minister Imran Khan stopped the return of leaders who had deserted the party.

A 7-member committee under the direction of founder PTI will decide the return of the leaders who left the party in difficult time.

The committee will be headed by Shah Mahmood Qureshi, while the committee will include Asad Qaiser, Hamid Khan, Shehryar Afridi, Barrister Gohar Khan and Shibli Faraz.

Shandana Gulzar has also been included in the committee and she will report on the cases of women and their reasons for leaving the party. After which the committee will send the final list of names to the founding PTI and he will take the final decision.

The party leadership has blocked the return of any leader to the party until the release of Imran Khan and the decision to return the leaders will be made only after the release of the PTI founder.

After May 9, 2023 incidents ,  a big number PTI leaders had announced to quit the party as a crackdown was launched against them for their incendiary speeches and attacking state installations.

IHC rejects plea seeking PTI founder disqualification in Tyrian White case

ISLAMABAD: The Islamabad High Court(IHC) dismissed the plea seeking Pakistan Tehreek e Insaf (PTI) founder Imran Khan’s disqualification in the Tyrian White case.

A three-member larger bench of the Islamabad High Court heard the disqualification petition for hiding the alleged daughter of PTI founder Taryn Jade White in the nomination papers, in which Imran Khan’s lawyer Naeem Panjutha gave arguments.

Naeem Panjutha said that this matter has already been decided and the judgment has also been uploaded on the website, after the decision was removed from the website, the bench was reconstituted through a press release.

Justice Tariq Jahangiri asked Naeem Panjutha “Who are you? Are you a lawyer in this case?”. On this, Naeem Panjutha said, “I am the proxy counsel, the case is also mentioned in the letter of 6 judges”.

The court said that two judges Justice Mohsin Akhtar Kayani and Justice Arbab Muhammad Tahir gave an opinion. On this, Hamid Ali Shah said that it was the opinion of two judges, the decision of the Chief Justice was not signed.

Justice Tariq Jahangiri said that two members of the bench said that the petition should not be heard and it should be dismissed. Chief Justice Aamer Farooq had recused himself from the bench.

Hamid Ali Shah said that you should give a date so that he can assist. On this Justice Tariq said the petition has already been dismissed and how the court gave relief in this plea.

Lawyer petitioner Hamid Shah said, “I need some time to assist, I can assist the court only after seeing the verdict”.

Justice Tariq Jahangiri said that two judges had given their decision, and that judgment was opened in front of everyone today in a sealed envelope.

SC starts investigation as PTI founder picture goes viral on social media

ISLAMABAD:  The Supreme Court administration has started an investigation into Imran Khan’s photo going viral on social media.

PTI founder Imran Khan appeared on a video link from Adiala Jail in the NAB amendments case, the picture of which appeared on social media.

Sources said the Supreme Court administration has started an investigation after the photo went viral and has been directed to identify the person who made the photo viral by looking at the CCTV cameras.

The photo has been taken in violation of courtroom rules and the police will take action against the person who made the photo viral. The size of the video of the PTI founder in the court has been reduced after the photo went viral.

On the other hand, police identified the person who leaked the photo of the PTI founder. The photo was taken by a lower clerk posted in the Supreme Court and police identified through CCTV footage.

ISLAMABAD: Pakistan Tehreek e Insaf (PTI) founder Imran Khan appeared before Supreme Court through video link in the National Accountability Bureau (NAB) amendments case.

A 5-member bench headed by the Chief Justice of Pakistan Qazu Faez Usa  is hearing the case while Justice Aminuddin, Justice Jamal  Khan Mandokhail, Justice Athar Minallah and Justice Hasan Azhar Rizvi are part of the bench.

PTI founder Imran Khan was appeared in the Supreme Court via video link from Adiala Jail, Imran Khan was wearing a light blue shirt.

At the beginning of the hearing, the Chief Justice asked the Attorney General, has the video link been established. On this, the Attorney General said that the Video link has been established.

A three-member bench of the Supreme Court had declared null and void the NAB amendments, against which the federal and provincial governments had filed intra-court appeals, while the founder PTI had requested to appear on its own in the NAB amendments case. The SC allowed the appearance of founder PTI through video link.

During the hearing, the lawyer was giving arguments to the federal government, during which the Chief Justice directed Makhdoom Ali Khan to give his arguments in a loud voice so that the founder PTI on the video link could also hear.

Makhdoom Ali, the lawyer of the federal government, said that the issue of NAB amendments is pending in the Islamabad High Court.

Justice Athar Minallah asked whether the pending application in the High Court was approved for hearing. On which lawyer Makhdoom Ali said yes, it was declared admissible.

Justice Qazi Faez Isa said that instead of suspending the law, he wanted to hear and decide on a daily basis, suspending the law is also tampering with the system.

PTI removes Sher Afzal, Umair Niazi from focal persons team

LAHORE: Pakistan Tehreek-e-Insaf (PTI) leaders Sher Afzal Marwat and Umair Khan Niazi have been removed from the list of focal persons of the PTI founder.

Chairman PTI Barrister Gohar Khan released the list of new focal persons of founder PTI and the names of Sher Afzal Marwat and Umair Niazi have not been included in the released list.

Barrister Gohar Khan said that the new focal persons have been appointed in consultation with the PTI founder, the new focal persons include Barrister Gohar, Shibli Faraz, Umar Ayub, Intazar Panjutha, and Ali Zafar.

In his response, Sher Afzal Marwat declared the issue of a focal person as a non-issue and said that the focal person is the position of governor of the State Bank which is very important.

Sher Afzal Marwat said that there is a deliberate conspiracy against him and the meeting of the core committee does not end and they tell lies to the media.

IHC adjourns cipher case hearing till April 16

ISLAMABAD: The Islamabad High Court (IHC) adjourned hearing till after the Eid on appeals against the sentence of Pakistan Tehreek e Insaf (PTI) founder and Shah Mehmood Qureshi in cipher case.

A division bench comprising Chief Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb heard the appeals of two accused.

Chief justice said that eight copies of the cipher were prepared after it was decoded and sent to different people.

The former principal secretary has stated that a copies was shared with the then prime minister, which was lost. The court said that the accused could be given only one sentence under 5(1)c or 5(1)d of Officials Secrets Act.

The chief justice remarked that it was admitted fact that the copy of the cipher arrived to Azam Khan. He remarked that if the charges were proved even then more than one year sentenced couldn’t be given in this case.

Defence lawyer Salman Safdar said that he would assist the bench regarding these sections, adding that his client was awarded sentences under the both sections.

He said that usually cipher are returned in a period of one year but prosecution made the criminal case against PTI founder only after seven months.

At this, Justice Miangul Hassan asked the lawyer to give any reference of the document regarding returning period of cipher.

The court said that Azam Khan was the sole witness of handing over of the cipher to PTI founder.

During hearing, Salman Safdar Advocate prayed the court to adjourn the case till after the Eid.

RAWALPINDI: The Special court hearing case has sentenced Pakistan Tehreek e Insaf(PTI)  founder and Shah Mehmood Qureshi to 10 years in prison.

Special Court Judge Abul Hasanat Zulqarnain heard the cipher case against PTI founder Imran Khan and Shah Mahmood Qureshi in Adiala Jail. Imran Khan and Shah Mahmood were present in the court.

The court in its verdict said the prosecution had enough evidence to prove the charges against the former prime minister and ex-foreign minister.

During the hearing, Questionnaire 342 was given to Shah Mehmood Qureshi and founder of PTI, on which both accused said that lawyers are not present, how will we record the statement.

Later, the court recorded PTI founder Imran Khan’s 342 statement, in which Imran Khan said that the cipher had come to his office, but the military secretary was responsible for its security.  He said that no clue was found about the cipher.

The court, after recording the statement of Imran Khan 342 and giving the decision of the case after a short hearing, said that Imran Khan and Shah Mahmood are sentenced to 10 years of imprisonment in the cipher case.

The judge delivered a brief oral judgment on the case.

LAHORE: The Lahore High Court (LHC) annulled the decision to reject bail in seven cases of the former prime minister and Pakistan Tehreek e Insaf(PTI) founder.

In the written decision of the Lahore High Court, it was declared that the PTI founder could not appear in the trial court due to his arrest and the trial court did not properly evaluate the facts.

The court in its written judgment said that the decision to exclude the sureties of the founder PTI is declared null and void.

Along with this, the court also directed the trial court to decide on the bail applications by February 6 through video link.
