SC conditionally allows military courts to pronounce verdict of 85 civilians

ISLAMABAD: The Supreme Court of Pakistan (SCP) on Friday allowed the military courts conditional permission to pronounce verdicts in the cases against 85 civilians alleged involved in the May 9, cases.

The Constitutional Bench of the Supreme Court, headed by Justice Aminuddin Khan, heard the intra-court appeals against the decision of the military courts. The bench also included Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, Justice Syed Hasan Azhar Rizvi, Justice Naeem Akhtar Afghan, Justice Musarrat Hilali and Justice Shahid Bilal Hassan.

Announcing a short verdict on permission for the military courts to announce verdicts in the cases. Khawaja Haris, counsel for the Ministry of Defence, gave arguments.

At the beginning of the hearing, Jamal Khan Mandokhail remarked that the invalid provisions of the Army Act are in accordance with the Constitution. “Can the Army Act be amended to bring everyone under its category and asso take into account the fact that the Army Act predates the 1973 Constitution.

Justice Muhammad Ali Mazhar asked, “First tell us what are the reasons for canceling the provisions in the court decision”.  Khawaja Haris replied that there are flaws in the Supreme Court’s decision.

Justice Musarrat Hilali, a member of the constitutional bench, asked what will happen to the trial under the provisions which have been declared null and void.

At the end of the hearing, the Constitutional Bench issued an order for today’s hearing in the case and allowed the military courts to pronounce the verdicts of 85 accused.

The Constitutional Bench said that the decisions of the military courts will be subject to the verdict of the case pending in the Supreme Court. The accused who can get a relief in the sentences should be released, and the accused who cannot be released should be sent to prisons.

UNITED NATIONS: Pakistan has warned the international community that the Tehrik-e Taliban Pakistan (TTP), “the largest terrorist group” operating in Afghanistan, could emerge as al-Qaeda’s arm with a regional and global terrorist agenda.

“Terrorism within and from Afghanistan poses the single most serious threat to the country, to the region, and to the world,” Ambassador Usman Jadoon, acting permanent representative of Pakistan to the United Nations, told the UN Security Council.

“While the AIG (Afghan Interim Government) is fighting ISIL-K (Daesh), the threat from various other terrorist groups such as al-Qaeda, the TTP and others has yet to be addressed,” he said while speaking in a debate on the situation in Afghanistan.

Highlighting the ranking of 6,000-fighters strong TTP as the largest, listed terrorist organization, Ambassador Jadoon said, “With safe havens close to our border, it poses a direct and daily threat to Pakistan’s security.”

“In countering the TTP’s cross border operations, our security and border officials have confiscated some of the modern weapons acquired by the AIG from stocks left behind by foreign forces,” the Pakistani envoy said, adding that the terrorist group also receives external support and financing “from our adversary” — an obvious reference to India.

The TTP, he said, was fast emerging as an umbrella organization for other terrorist groups, aimed at destabilizing Afghanistan’s neighbours.

“We have evidence of its collaboration with other terrorist groups like the Majeed Brigade that is utilizing terrorism to disrupt Pakistan’s economic cooperation with China, especially CPEC,” Ambassador Jadoon said.

“Given its long association with al-Qaeda, the TTP could emerge as Al-Qaeda’s arm with a regional and global terrorist agenda.”

Pakistan, he declared would take all necessary national measures to eliminate these threats, cooperating with regional and international efforts to root out the menace of terrorism.

About Taliban’s new directive prohibiting women and girls from attending public and private medical institutes in Afghanistan, Ambassador Jadoon said the international community expects the AIG to fulfill its declared commitments on human rights and political inclusion.

The Pakistani envoy also called for the Doha Process framework to go beyond counter-narcotics and the private sector; Afghanistan’s challenges, including terrorism, human rights and widespread poverty, are also affecting the region.

Plane carrying 318 stranded Pakistanis in Syria lands in Islamabad

ISLAMABAD: A special chartered plane carrying 318 Pakistani nationals who were repatriated from Syria to Beirut, Lebanon landed Islamabad here early Friday.

Federal Minister for Planning and Special Initiatives Dr Ahsan Iqbal and Chairman National Disaster Management Authority (NDMA) Lt. Gen. Inam Haider Malik received the repatriated nationals at the Islamabad International Airport.

Under the personal supervision of PM Sharif, the comprehensive plan for the safe evacuation of Pakistani citizens was carried out by National Disaster Management Authority (NDMA) in collaboration with the Ministry of Foreign Affairs (MoFA).

In a statement, the prime minister said the safe return of Pakistani nationals from Syria was a top priority of the government.

He appreciated the prompt action taken by MoFA, the Pakistani embassies in Syria and Lebanon, and the NDMA authorities in ensuring the safe return of Pakistani citizens.

He also expressed gratitude to the Prime Minister of Lebanon, Najib Mikati, whose government provided all possible cooperation and assistance for the return of Pakistanis via Beirut.

The Lebanese government also arranged buses for the transfer of passengers.
