ECP adjourns hearing of PTI intra-party elections case

ECP

ISLAMABAD: The Election Commission of Pakistan (ECP) adjourned the hearing of the PTI intra-party elections case until April 8.

The case pertains to the legitimacy of PTI’s internal elections and their compliance with ECP regulations.

A three-member bench, headed by Member Sindh Nisar Durrani, heard the case, with PTI Chairman Barrister Gohar Ali Khan, Akbar S. Babar, and others appearing before the commission.

ECP member from Khyber Pakhtunkhwa raised questions about who is managing PTI’s internal affairs, noting that the media has repeatedly mentioned Salman Akram Raja, sparking concerns about his role in the party.

PTI’s intra-party elections have also faced criticism for alleged controversy and a lack of transparency, fueling debates over the party’s internal management.

Barrister Gohar stated that the party is currently managing its affairs under indoor management and emphasized that the issue would be resolved once the ECP provides the necessary certification.

In response, an ECP member urged PTI to vacate the stay order obtained from the high court, to which Barrister Gohar clarified that no stay order exists regarding the proceedings of this case.

An ECP member further remarked that the case is not a trial and that it is not feasible to reserve a decision while waiting for a judicial ruling.

The member also pointed out that the documents submitted by PTI are incomplete, raising questions about the adequacy of the evidence provided.

Akbar S. Babar, a founding member of PTI, emphasized that the matter is of significant public importance. He urged the commission to announce its decision immediately, stressing the need for a timely resolution.

Speaking to the media after the hearing, Babar went further, calling PTI an illegal organization and demanding that its accounts be frozen.

SC dismisses PTI’s review plea about intra-party elections

SC

ISLAMABAD: Supreme Court (SC) dismissed Pakistan Tehreek-e-Insaaf (PTI) petition regarding intra-party elections.

A three-member bench, headed by CJP Qazi Faez Isa, and comprising Justice Muhammad Ali Mazhar and Justice Musarrat Hilali, was hearing the PTI’s plea to review its judgement on its intra-party election.

PTI’s counsel Hamid Khan pleaded for the constitution of a larger bench for the review petition and asked that the case be referred to the committee for constitution of a larger bench.

Speaking to Hamid Khan, Chief Justice Qazi Faez Isa said that there is a matter of revision and court have to look at the law.

Justice Qazi Faez Isa said why you did not raise this point earlier, you should proceed with the case.

Hamid Khan said that the court should see the paragraph of the decision of the Sunni Ittehad Council and Election Commission case, on which the Chief Justice of Pakistan said why should court look at that decision.

PTI’s lawyer Hamid Khan objected to the bench and said that the present 3-member bench cannot hear the case as a 13-member bench has already given its verdict in the Sunni Ittehad Cuncil case.

Hamid Khan said that it is being said that PTI has not conducted intra-party elections but party has conducted elections, however court declared it null and void.

Justice Muhammad Ali Mazhar said PTI’s election constitution is very transparent, either you should change such constitution or hold intra-party elections accordingly.

The Supreme Court, while upholding the January 13 decision regarding the PTI intra-party election, dismissed the review petition and said that no error could be identified in the decision.

PTI responsible for delay in intra-party election case: ECP

PTI

ISLAMABAD: The Election Commission of Pakistan (ECP) has said that under Sections 208 and 209 of the Elections Act 2017, all political parties are required to hold intra-party elections within five years in accordance with their party constitution.

Initially, Pakistan Tehreek-e-Insaf (PTI) was supposed to conduct its intra-party elections by June 13, 2021, but were not held on time.

The ECP served repeated reminders on PTI and before serving a show-cause notice on July 27, 2021, it further said. In response, PTI requested a one-year extension, citing COVID-19 pandemic.

The ECP granted extension on the request of PTI, extending the deadline to June 13, 2022.

However, PTI submitted incomplete intra-party election documents under Form 65 in June 2022 to the ECP and despite repeated reminders, the party continued to delay the submission of required documents.

Despite inordinate delay, the ECP has shown flexibility throughout the process and granted many opportunities to PTI to meet its constitutional requirements.

“However, the responsibility for the slow progress rests with the PTI, as the ECP continues to work to legally resolve the matter,” the statement further said.

PTI held its recent intra-party elections on March 3, 2024, but the process was marred by several shortcomings.

The ECP served a notice regarding these issues on April 23, 2024, with the first hearing on April 30, 2024. Between April and October 2024, the case has been heard six times. However, PTI has requested adjournments including hearing on October 2, 2024, seeking more time.
