PHC
  • A petition against Arshad Hussain’s appointment filed by senior lawyer.
  • Ex-CMs Mahmood Khan , Akram Durrani and others were made parties.
  •  Petitioner said Mahmood Khan is not the Chief Minister at moment.

PESHAWAR: The appointment of Khyber Pakhtunkhwa Caretaker Chief Minister Arshad Hussain has been challenged in the Peshawar High Court(PHC).

A petition against Arshad Hussain’s appointment was filed by senior lawyer Wali Khan Afridi and Shah Faisal Ilyas Advocate, in which Mahmood Khan, Akram Durrani, the provincial government, and the caretaker chief minister were made parties.

The petitioner contended that there is no such provision in the Constitution for the manner of appointment, Articles 224 and 224 A for appointment in the circumstances.

It was said in the petition that the current situation is not normal and the appointment could not have been made. Mahmood Khan is not the Chief Minister at the moment and Akram Durrani is not the leader of the opposition. Both of them do not have positions and they are ordinary people.

In it, it was requested that the court declare the process of appointment of caretaker chief minister as illegal.

It should be remembered that after the sudden death of former interim Chief Minister Azam Khan, Justice (R) Arshad Hussain was appointed as caretaker Chief Minister.
