Supreme Court declares Fundamental Human Rights Cell illegal

The Supreme Court of Pakistan has declared the Fundamental Human Rights Cell illegal, with the petition disposed of during the hearing.

Justice Athar Minallah, during the case’s proceedings, noted that this cell was established in 2005 without clear legal grounds.

Chief Justice of Pakistan, Justice Qazi Faiz Isa, emphasized that no amendments were made to the Supreme Court’s rules for this cell, and it was not approved by the full court.

He questioned the ability of the Chief Justice to issue judicial orders while in their chamber, asserting that the existence of the Human Rights Cell in the Supreme Court is not legally valid.

CJP Isa further stated that judicial orders should be issued in an open court, where the Chief Justice has the authority to decide cases.
