Accountability court raises important questions on Mir Shakil’s acquittal petition – “Streets and roads are owned by the people. How did Mir Shakil include the streets of Johar Town in the plots? How can Mir Shakil ask for acquittal because of the delay in taking action against him?” The court summoned the NAB prosecutor on August 5 for final arguments.

Accountability Court Judge Asad Ali started hearing the illegal allotment reference of plots against Mir Shakeel, the owner of Jang and Geo. Special Prosecutor NAB Asim Mumtaz requested to adjourn the hearing of the case. Unable to appear today due to illness, Judge Asad Ali remarked that the court had specially directed the NAB prosecutor to complete his arguments before the holidays.

The NAB prosecutor said that if he had been aware of the details of the trial, he would have given arguments. The accountability judge questioned the lawyer of the accused Mir Shakil that after the letter of additional land price sent to the accused by LDA in 1992, all the file is silent, can any concession be given to the accused due to delay by the department?

Amjad Pervez Advocate admitted that the accused does not have the right to acquit due to delay but some facts of the case are on record. NAB Prosecutor Asim Mumtaz objected to further arguments of Amjad Pervez Advocate and said that the accused’s lawyer completed his arguments. Now they should wait for NAB’s arguments and then give their arguments if any point comes up, the NAB prosecutor added that it is surprising that the court also allowed the accused’s lawyer to give arguments after adjourning the case.

Accountability Court Judge Asad Ali remarked that Amjad Pervez Advocate has started his arguments on the judicial inquiry. A and B were presented but how were some parts of these two suggestions combined at the time of allotment, Amjad Pervez Advocate said that when accused Mir Shakil was allotted then no streets and roads were built in the area.

Judge Asad Ali remarked that the map of Johar Town has been presented in the court which has streets and roads while streets and roads are the property of the people. After 3 years, the street map was approved and the competent authorities had given approval to Mir Shakil to add streets and roads with plots.

Judge Asad Ali remarked that for this, one would have to read the exemption policy. The court questioned Mir Shakil’s lawyer that the accused had replied to the letter of the LDA of 1992 or that he had found the letter in its entirety. Refusing to believe it again, Amjad Pervez Advocate argued that it is alleged that Mir Shakil got the allotment with the connivance of LDA employees but the staff is not a witness here.

In his reference, the superior judge wrote that if there is an allegation of allotment with the connivance of officers and employees, then the officers have appeared for testimony. It is to be noted that after the NAB reference was presented, the co-accused Nawaz Sharif has been declared a fugitive for not appearing despite the summons. In the NAB reference, Mir Shakil, former DG LDA Humayun Faiz Rasool, and Bashir Ahmad have been declared guilty. ,

Accused Mir Shakil-ur-Rahman obtained 54 plots of 1, 1 Kanal on exemption with the connivance of then Chief Minister Nawaz Sharif.

Accused’s acquisition of all the plots in the same area is a violation of the Exemption Policy 1986: NAB prosecutor.

Accused Mir Shakil also included 2 streets in allotted plots with the connivance of Nawaz Sharif. The accused transferred the plot in the name of his wife and minor children to cover up his crime, the NAB prosecutor said.
