ISLAMABAD: PTI senior leader Fawad Chaudhry has challenged the appointment of the Election Commission of Pakistan (ECP) member from Sindh Nasir Ahmed Durrani.
The PTI leader has filed a petition in the Islamabad High Court to declare the appointment of ECP member from Sindh as unconstitutional. He maintained that Nasir Durrani is performing his duties as the principal of a law college under the Government of Sindh
The petition stated that ECP member is working in an institution falling under the control of the Sindh Government and is therefore not eligible to be part of the election commission.
The petitioner urged the court to declare the appointment unconstitutional. IHC Chief Justice Athar Minallah will hold the hearing on Monday, September 19.
It must be mentioned the ECP has reserved its verdict in the contempt case against PTI leaders including its Chairman Imran Khan, General Secretary Asad Umar, and Senior Vice President Fawad Chaudhry.
On September 14, a four-member bench of the ECP headed by Nisar Durrani conducted the proceedings and reserved verdict.
PTI’s lawyer Faisal Chaudhry appeared before the commission and contended that the ECP did not specify the violation purportedly committed by the PTI leaders in its notices.
The commission said that it had specified the violation committed by the PTI leaders. The counsel claimed that the notice was not issued by the ECP.
ECP member Durrani asked him to first submit the replies of PTI leaders on the notices and then the commission would hear him out.
The lawyer the commission that the high court had already barred from issuing the final order in the contempt proceedings. The ECP member said that they were not issuing the final order.
The lawyer also raised an objection to presence of Nisar Durrani on the bench. He said Nisar Durrani was mentioned in the speeches of PTI leaders and ‘a member who is case to the case cannot be part of the bench’.
During the hearing, the PTI lawyer submitted Fawad Chaudhry and Asad Umar’s replies. The commission said that it would announce its verdict after examining the replies and Imran Khan should also submit his reply.
