ISLAMABAD: The Islamabad High Court (IHC)’s Justice Aamer Farooq has sent notices to the Election Commission of Pakistan in a plea filed by the Pakistan Tehreek e Insaf (PTI) against the commission’s decision on reserved seats of Punjab Assembly.
Adjourning the hearing till June 21, the IHC judge directed the ECP to submit its reply in the case. He ordered PTI lawyer Barrister Ali Zafar to make PML-N as well a defendant.
The application was lodged by PTI leaders Asad Umar, Saira Raza and two others.
Ali Zafar apprised the court that 25 defected members of the PTI violated the orders of the leadership by casting votes in favour of Hamza Shahbaz in the Punjab Assembly on April 16 during the election of Punjab chief minister. Hence, he said, they violated the Constitution’s Article 63A. He said that they were liable be disqualified on the grounds of defection.
The counsel said through an ECP order those politicians’ membership of the Punjab Assembly was canceled and the seats became vacant. He said three of the Punjab Assembly MPAs de-notified by the ECP were occupying reserved seats.
As per Article 224(6), he said, the party whose member was occupying the seat would fill the seat with its member who is the next person in order of precedence in the party list.
The PTI lawyer said the ECP deferred the matter till by-elections on rest of the general seats. He prayed to the court to direct the commission to immediately fill the seats.
