According to The Guardian, an employment tribunal has ruled that calling men “bald” is sexual harassment.
The decision was made by a panel of three men who lamented their lack of hair.
It all began when Tony Finn was sacked from the company where he had worked for 24 years. He claimed that his boss, Jamie King, had referred to him as a “bald c*nt.”
Finn informed the tribunal that he was more upset by the statement about his appearance than by the insults.
The claim spurred debate about whether calling someone bald is merely offensive or constitutes harassment. Judge Jonathan Brain presided over a panel that was formed.
“We have little doubt that being referred to in this disparaging manner was undesired behaviour in [Finn’s] opinion,” the panel said, according to The Guardian.
“In our opinion, King crossed the line by making personal remarks regarding the claimant’s appearance, “The panel stated.
According to the panel, there is a link between calling someone bald and their gender.
“King’s purpose, according to his own admission, was to intimidate and insult [Finn].” There is, in our opinion, a link between the word ‘bald’ on the one hand and the protected sex feature on the other.”
They claimed the insult was “inherently tied to sex.”
The supervisor made the statement in order to harm the claimant by commenting on his appearance, which is common among men.
“As a result, the tribunal concludes that by referring to the claimant as a ‘bald c*nt’… King’s actions were unwelcome, they were a violation of the claimant’s dignity, they produced a threatening environment for him, they were done for that purpose, and they were related to the claimant’s sex.”
