The Texas Criminal Appeals Court on Monday granted Melissa Lucio’s execution suspension, suspended the scheduled execution on Wednesday, and remanded her case to the court to consider new evidence.
Lucio’s family lawyer say she was wrongly sentenced for homicide in 2007 for the passing of her child Maria.
“I say thanks to God for my life. I have generally confided in Him,” Lucio said in an explanation shared by her legitimate group. “I’m thankful the Court has allowed me the opportunity to live and defend myself. Mariah is in my heart today and consistently.”
At preliminary, examiners contended Lucio was an oppressive mother who probably caused the wounds that achieved her girl’s demise. Yet, Lucio and her lawyers said Mariah’s wounds stemmed not from misuse but rather from a tumble down a flight of stairs outside the family’s second-floor condo two days preceding her passing.
Of the nine cases Lucio brought up in her habeas application, the investigative court requested the preliminary court to consider four of them, including her affirmations she is honest and new logical proof blocks her conviction. Lucio likewise contended the state depended on bogus declaration and smothered proof ideal for her protection.
