The Dubai Civil Court has ordered an employee, found guilty of embezzlement, to repay the sum of 899,930 dirhams to his employer, along with an additional compensation of 30,000 dirhams.

This order was issued following a final judgement against the employee by the Penal Court, which he decided not to contest.

The legal proceedings began when the aggrieved company lodged a complaint against one of its employees, alleging that the employee had unlawfully diverted funds intended for the company’s use for his own personal gain.

In response, the Dubai Public Prosecution initiated an investigation into the matter, accusing the employee of embezzling funds or securities entrusted to him with the intention to harm the rightful owners or violate trust. Following due process, the Misdemeanour Court found him guilty based on witness testimonies and case documents, sentencing him to two months in prison and levying a fine of 899,930 dirhams, along with deportation upon completion of his sentence.

Simultaneously, the company pursued civil litigation, launching legal proceedings against the accused and demanding restitution of the misappropriated amount plus a 9% legal interest from the date of default. The company also sought compensation totaling 500,000 dirhams for the damages and lost earnings resulting from the defendant’s actions, in addition to litigation costs and attorney fees.

The company argued that the accused, being its employee, had committed embezzlement to its detriment, and cited the criminal verdict from the misdemeanour court as the basis for its civil claim. As the accused did not challenge the ruling within the specified period, the company obtained a certificate from the Public Prosecution confirming the finality of the judgement.

After reviewing the case materials, the Civil Court of First Instance upheld the legal validity of the criminal ruling in civil proceedings, stressing the prohibition against re-examining dismissed criminal cases. As a result, the court ordered the defendant to repay the misappropriated sum of 899,930 dirhams and set a 5% interest rate for late payment. Additionally, it granted the company compensation of 30,000 dirhams for the proven damages caused by the defendant’s actions.
