SC to hear intra-court appeals against ‘civilian military trial’ verdict on Dec 13

The Supreme Court is set to hear a series of intra-court appeals challenging the October 23 verdict against civilian trials in military courts on December 13.

The earlier Supreme Court decision, with a majority of 4-1, ruled against civilian trials in military courts.

In the widely praised ruling, a five-member SC bench — comprising Justices Ijazul Ahsan, Munib Akhtar, Yahya Afridi, Syed Mazahar Ali Akbar Naqvi and Ayesha Malik — had declared that trying 103 civilians in military courts for their alleged role in attacks on army installations during the riots that followed ex-premier Imran Khan’s arrest on May 9 was ultra vires the Constitution.

The appeals were filed by individuals, including the PTI chairman, contesting the military trial of civilians involved in the May 9 riots sparked by the arrest of PTI chief Imran Khan in the Al-Qadir Trust case.

The government has submitted a report to the court, stating that 102 individuals were arrested after the May 9 incidents.

The federal government, defence ministry, and provincial governments of Punjab, Khyber Pakhtunkhwa, and Balochistan have moved intra-court appeals requesting the suspension of the October 23 short order during the pendency of the appeals.

The petitioners are urging the court to nullify its verdict until a decision on the review plea, as the accused seek trial in military courts.

The hearing will be conducted by a six-member bench headed by Justice Sardar Tariq.
