Donald Trump’s two eldest sons have taken the witness stand in a civil fraud trial in New York, where they are testifying in a case that poses a significant threat to the Trump family’s real estate business.
Prosecutors allege that Eric and Donald Trump Jr played pivotal roles in inflating the Trump Organization’s assets and falsifying records.
The Trump brothers vehemently denied any wrongdoing and attempted to shift the blame onto the company’s accountants while testifying in court. Their sister, Ivanka, is also expected to provide testimony later in November.
Judge Arthur Engoron, presiding over the case, has already ruled that the Trump Organization engaged in substantial fraud.
The trial’s ultimate goal is to determine the appropriate civil penalty. New York Attorney General Letitia James is seeking a $250 million fine and a prohibition on the former president and his adult sons from conducting business in the state.
Donald Trump Jr frequently asserted that he had not been involved in the preparation of the financial statements at the center of the case and had limited knowledge of how these statements and other critical business documents were created during his testimony on Wednesday and Thursday.
He argued that the responsibility for these documents rested with the company’s accountants, specifically the Mazars firm, and other employees despite being an executive vice-president at the Trump Organization.
When asked if he ever took steps to ensure the accuracy of the documents he signed off on, he replied, “I can’t recall.” In response to Judge Engoron’s direct question about his involvement with the documents, he stated, “No, I did not, your honor.”
His younger brother Eric was notably more reserved and had several tense exchanges with prosecutors while Donald Jr projected confidence and used humor during his court appearance.
Eric often refused to provide simple “yes” or “no” responses to questions, leading to frustration among the prosecutors.
Eric distanced himself from financial documents related to his father and the broader Trump Organization, particularly the statements of financial condition like his brother.
However, during cross-examination, emails were presented in which Eric Trump appeared to contradict his earlier claims of having nothing to do with his father’s financial statements.
Despite this, he maintained that he was not directly involved in preparing the document and did not pay significant attention to how the information was utilized, stating, “I didn’t work on the statement of financial condition. I’ve been very, very clear about that.”
Tensions escalated toward the end of the day over another issue: Judge Engoron’s law clerk. The judge threatened to expand a gag order that had been imposed on former President Donald Trump regarding a social media post related to the clerk, potentially including the family’s attorneys.
This threat arose after Trump attorney Christopher Kise referred to the female law clerk during an objection. The judge suggested the reference “might be misogyny,” which led to objections from the Trumps’ lawyers, who felt the judge was biased against them.
Former President Trump is expected to provide his testimony in the case early next week. He has consistently denied any wrongdoing and has previously attended court proceedings to observe the testimony of his former attorney, Michael Cohen.
Ivanka Trump, who is no longer listed as a co-defendant in the case, is set to testify on November 8, although she has appealed against the order to testify, arguing that she has not lived or worked in New York since 2017.
