NBC News has learned that the House Jan. 6 committee met Sunday to finalize criminal referrals for former President Trump.

The committee is expected to vote Monday on referrals asking the Justice Department to charge Trump with obstructing an official proceeding, conspiracy to defraud the government, and inciting or assisting an insurrection.

NBC News overheard Rep. Jamie Raskin, D-Md., saying referrals were “warranted.” A source told NBC News about the meeting and its Capitol location.

The committee didn’t comment.

NBC News reported that the committee was considering charging Trump with obstruction, conspiracy, and inciting an insurrection.

The criminal referrals have no legal weight, and it’s up to the Justice Department to charge Trump and anyone else referred.

After the meeting, sources confirmed that the discussions were a review of previous committee decisions to be presented Monday and that the meeting served as a rehearsal.

John Eastman, a conservative lawyer on Trump’s legal team, wrote a memo outlining how Trump could stay in power on Jan. 6.

Eastman’s lawyer didn’t comment.

NBC News has learned that the committee will refer several Republican lawmakers to the House Ethics Committee for defying subpoenas.

Raskin presented the findings of the referrals subcommittee during Sunday’s meetings. “We’re referring four congressmen to the House Ethics Committee for noncompliance.”

Trump campaign spokesperson shared a statement from Friday attacking the committee and said the campaign will have more to say after Monday’s referrals.

The bipartisan committee, which is wrapping up before the end of the year, rushed to file its findings in an eight-chapter report due Wednesday.
