ISLAMABAD: Islamabad High Court (IHC) adjourned the hearing in a case related to the disqualification of Chairman PTI Imran Khan in the Toshakhana reference by the Election Commission of Pakistan

Imran Khan’s lawyer Ali Zafar, along with Election Commission lawyers, League leader Mohsin Shahnawaz Ranjha appeared before the court along with his lawyer.

Chief Justice Amir Farooq, while conducting the hearing, said that Ali Zafar should start his arguments first.

Barrister Ali Zafar said in arguments that the Election Commission is not a court of law and it cannot give the declaration of 62 (1)(F). He argued that the Election Commission does not have the authority to disqualify any member. There are decisions of the Supreme Court that the Election Commission is not a court of law.

The court inquired whether the disqualification under Article 63(F) was a matter of Sadiq and Amin. Lawyer of Imran Khan said that the Election Commission has given a decision against his client keeping in mind the Faisal Vawda case. The speaker referred the application to the Election Commission.

Barrister Ali Zafar further argued that the Election Commission has referred the case to the relevant trial court where a regular trial will be held.  He said “If the trial court decides against it, then the Election Commission will decide on disqualification. Imran Khan received gifts after 20 percent payment, copy of the challan has been provided” he added.

Barrister Ali Zafar, the lawyer of Chairman PTI Imran Khan, argued that the decision of the Speaker National Assembly was illegal and unconstitutional due to a lack of declaration under 62(1)(F).

Mohsin Shahnawaz Ranjha’s lawyer has sought one week for arguments from Islamabad High Court (IHC) in the Tosha Khana case.

Lawyer of the Election Commission has adopted the position that it has started the process of removal from the presidency of the party and added that decision has been reserved when the criminal case against Imran Khan is cognizable in the session court.

The Chief Justice of Islamabad High Court said that he will decide after the hearing in two to three weeks.

During the hearing of the Toshakhana case in the Islamabad High Court, the decision of the Supreme Court in the Faisal Vawda case was mentioned.

 

PML-N leader Mohsin Shahnawaz Ranjha’s lawyer sought a week time for arguments.
