Key suspect of kidnaping Michigan governor gets sentence break

A federal judge cut the sentence of a man who pleaded guilty to being part of a failed plan to kidnap Michigan’s governor. His testimony last month helped get the plotters convicted.

Ty Garbin, who is 26, was given a new prison sentence of 30 months, which is less than half of the 75 months he got in August 2021. Garbin’s testimony helped the U.S. government get two men convicted last month for planning to kidnap Governor Gretchen Whitmer in 2020 from her vacation home in northern Michigan.

U.S. District Judge Robert Jonker in Grand Rapids cut Garbin’s sentence because he gave federal lawyers “substantial help.” This is what the judge said in a written order.

Mark Satawa, Garbin’s lawyer, asked for a new sentence, and prosecutors agreed.

Adam Fox and Barry Croft Jr. were found guilty of kidnapping conspiracy and other charges in an August retrial, after a jury couldn’t decide in April. Garbin was a witness against them. In the first trial, two other people were cleared of federal charges.

Prosecutors said that Fox and Croft were part of a right-wing militia. Later this year, they will be given a sentence, which could be life in prison.

Kaleb Franks, who also pleaded guilty to kidnapping conspiracy and testified at the trial, will be sentenced for the first time on Oct. 6.

Garbin has been in jail for almost two years. He was given a shorter sentence than the 36 months that prosecutors had asked for. Satawa said that he only has six months left in prison.

Garbin was one of 13 men who were arrested in October 2020 and charged with state or federal crimes, including Garbin. In state court, there are charges against seven people.

The U.S. Attorney’s Office in western Michigan could not be reached for comment.
