On Wednesday, over 50 House Republicans pressured Attorney General Merrick Garland to charge protesters demonstrating outside Supreme Court justices’ residences in anticipation of a judgment overturning Roe v. Wade. Members of Congress, led by Rep. Claudia Tenney, R-NY, cite a federal statute that makes it unlawful to “picket or parade” before a courthouse or a judge’s residence “with the goal of influencing… the performance of his duties.”

“We thus pose a simple question: do you plan to execute the law when Supreme Court Justices are being unjustly targeted at their homes?” Republicans wrote a letter. “Your inaction is a blatant and tacit support of mob rule in America.” The letter was signed by 47 House Republicans, including House Republican Conference Chair Elise Stefanik, R-NY, and GOP Conference Vice-Chair Mike Johnson.

They join a chorus of voices decrying the protests at the justices’ residences, including Senate Minority Leader Mitch McConnell, R-Ky., and Judiciary Committee Ranking Member Chuck Grassley, R-Iowa. Protesters picketed outside the houses of Justice Brett Kavanaugh and Chief Justice John Roberts over the weekend. Protesters gathered outside Justice Samuel Alito’s house on Monday.

“Among the most precious liberties, we retain as Americans is the freedom to peaceful assembly,” the GOP members wrote. “Nonetheless, our cherished freedom to congregate peacefully has never allowed Americans to intimidating judges, jurors, or court employees. “We ask you to uphold US laws and put an end to the mob,” they said. “You must give a clear and unequivocal message to all Americans.

Protests outside the justices’ residences are not formally condemned by the White House. However, White House press secretary Jen Psaki stated on Monday that intimidation is unacceptable.

“@POTUS firmly believes in the freedom to protest guaranteed by the Constitution. However, violence, threats, or vandalism should never be tolerated “Psaki took to Twitter. “Judges serve an extremely essential role in our society, and they must be free to do so without fear of personal harm.”

“So, I know there’s an indignation right now, I think, over nonviolent protests to date, and we absolutely continue to encourage that outside of judges’ houses,” Psaki explained on Tuesday. “And that is the president’s stance.” Other Democrats, including House Democratic Whip Steny Hoyer, D-Md., and House Democratic Conference Chair Hakeem Jeffries, D-N.Y., criticized the justices’ harassment on Wednesday.
