Elon Musk’s legal team has accused Philadelphia’s progressive district attorney, Larry Krasner, of creating a “phony emergency” to interfere with his pro-Trump super PAC’s daily $1 million giveaway to registered voters.
This accusation was made in a court filing on Friday, as Musk and Krasner are engaged in a legal battle in federal court regarding the sweepstakes, which has been ongoing for two weeks amidst significant legal scrutiny.
Musk’s lawyers argued that the lawsuit reflects Krasner’s intention to impose a prior restraint on core political speech, which they claim is protected by federal election law and the First Amendment, simply because the district attorney disagrees with Musk’s views.
The case has moved to federal court after Musk sought to transfer it from state court, where Krasner had initiated the lawsuit. This transfer occurred late Wednesday, disrupting a scheduled hearing in Pennsylvania state court that was set to decide whether Musk’s giveaway should be halted.
As Election Day approaches on Tuesday, Musk is gaining an advantage from the ongoing legal wrangling. Krasner had requested a state judge to immediately stop Musk’s daily giveaway on Monday. In response, Musk’s lawyers have urged the federal judge overseeing the case to proceed cautiously.
For context, the sweepstakes is operated by Musk’s super PAC, America PAC. Musk, who endorsed Trump in July, has contributed over $118 million to the super PAC, which is awarding $1 million daily to registered voters in swing states who sign a petition supporting the Constitution.
