LHC seeks report on severe water shortage, drought

LAHORE: The Lahore High Court (LHC) expressed displeasure over the Provincial Disaster Management Authority’s performance on the severe water shortage and sought a response on the drought report.

Justice Shahid Karim of the Lahore High Court heard petitions against smog and environmental pollution. During the hearing, Justice Shahid Karim remarked that every work was to be done by the court so this department should be closed.

He further remarked that government should take measures and make a permanent policy for water conservation. He stated that permanent policy should be made, if there is no snowfall this year, it is alarming situation.

The court said that the government should impose immediate water emergency, the water was stopped through the pipes.

Justice Shahid Karim added that underground water levels are decreasing and water recycling plant should be established in 10 Marla or above house.

On this, WASA’s lawyer took the position that they are working on water meters and first phase water meters will be installed in commercial buildings and later meters will be installed at private level.

During the hearing, the member judicial commission said that there is also a problem with car showrooms. The cars are washed there every day and showrooms are using too much water.

LHC makes new schools registration subject to bus policy

LAHORE: The Lahore High Court (LHC) issued an order to make the registration of new schools conditional to the school bus policy.

Justice Shahid Karim heard the petitions filed in the Lahore High Court for the control of smog, during which the relevant officials appeared in the court.

During the hearing, the court questioned why measures were not taken for school buses for children. Why was the court order to start buses for 50 percent children not implemented? Court observed that Secretary Schools violated court orders.

Justice Shahid Karim remarked that by December 30, submit a policy report in this regard and make school buses mandatory in the registration of schools. He further remarked that stop the registration of new schools and every school has to adopt this policy.

Member Judicial Commission said in the court that we asked Managing Director Water and Sanitation Agency (WASA) Lahore to resume the work of water meter.

On this WASA’s lawyer said that we had money problems with the Chinese company, the Chinese company wanted to open an account here. .

Justice Shahid Karim said that the work has been delayed a lot and ordered to start it soon as smog will start again in the next one month.

LHC orders schools to ensure transport for students

LAHORE: The Lahore High Court (LHC) on Monday has issued an order to schools to provide transportation for students after the winter vacation.

Justice Shahid Karim of Lahore High Court issued a 3-page order on smog relief petitions.

The Lahore High Court has ordered the schools to provide transport to the children after the winter vacation as part of measures combat smog, while the court said that the education department is being given final notices in this regard.

During the hearing, the court praised the steps taken by the transport department while the advocate general told the court that the Punjab government is taking steps to control smog and cases are being registered against those who burn crop residues.

On the other hand, Punjab Education Department announced schedule of winter vacations  and vocations will begin in province from December 20.

Secretary Schools Punjab Khalid Nazir Watto said in a statement that winter vacations are taking place in Punjab from December 20.

Secretary Schools Punjab said that till 10 January 2025 there will be winter vacation in schools, there will be 20 days of winter vacation in schools.

Justice Abid Aziz Sheikh to take oath as acting CJ LHC

LAHORE: Justice Abid Aziz Sheikh will take the oath as acting chief justice of the Lahore High Court (LHC) on Saturday.

The oath-taking ceremony will be held in the LHC Judges’ Lounge at 9:00 a.m., where Justice Shahid Karim will administer the oath to the acting chief justice.

The judges working at the LHC Principal Seat will attend the ceremony.

It is pertinent to mention that LHC Chief Justice Miss Aalia Neelum is on a foreign visit.

LHC seeks details of mechanism for POL prices

LAHORE: The Lahore High Court (LHC) directed the federal government to submit the mechanism for fixing petroleum, oil and lubricant prices.

Justice Shahid Karim of Lahore High Court heard the petition against the increase in the prices of petroleum products, in which the Assistant Attorney General and the petitioner’s lawyer appeared in the court.

The petitioner’s lawyer said that the increase in the price of petrol has further increased inflation and the government increases the prices of petroleum products without any reason.

During the hearing, the Assistant Attorney General said that the petrol has been increased according to the international market, on this the lawyer for the petitioner said that Oil & Gas Regulatory Authority (OGRA) and the government’s position is beyond understanding, the public is not even given solid reasons regarding the increase in petrol.

The court said that the federal government should bring on record how the price of petrol is fixed and the procedure for increasing the prices of petroleum products should be clarified.

LHC issues SOPs to stop interference of agencies in judiciary

LAHORE: The Lahore High Court (LHC)  has directed the PM Office to instruct all the civil and military agencies including the Intelligence Bureau (IB) and Inter-Services Intelligence (ISI) to not contact any member of the judiciary.

Lahore High Court Justice Shahid Karim issued a 4-page written interim order in the case of harassment of an Anti-Terrorism (ATC) judge.

Justice Shahid Karim has issued 5-point SOPs to prevent interference in the Judiciary. It has been said that the Prime Minister’s Office should issue instructions to all civil and military agencies, including the Inter-Services Intelligence(ISI)  and Intelligence Bureau(IB). The agencies should not contact any judge of the superior or subordinate judiciary or their staff in future.

In the judgment, it has been said that the IG Punjab should also issue instructions to stop the subordinate officers from interfering in the judiciary. He remarked that for the security of the ATC courts and a decision should be taken by consultation and consensus with the concerned judge.

In the verdict of the Lahore High Court, it has been said that the ATC judges should record every call in their mobile phones, and the special anti-terrorism courts of Punjab should decide the May 9 cases on priority basis.

Justice Shahid Karim appointed Hina Hafeezullah as judicial assistant and ordered the judicial staff to fully cooperate in the investigation on the case of ATC judge Sargodha and also asked the investigating court staff to record the video of the investigation and provide to high court.

LHC orders impounding smoke-emitting vehicles

LAHORE: The Lahore High Court (LHC) on Friday ordered the district government and the traffic police to take strict action against smoke-emitting vehicles and impound them for frequent violations to control smog in the provincial metropolis.

Justice Shahid Karim of Lahore High Court, while hearing the petitions filed for remedying smog, said that vehicles emitting smoke should not only be fined but should also be closed.

Justice Shahid Karim said that the Punjab Transport Department should be informed about the pictures of vehicles emitting smoke and help should also be sought from Safe City.

The court said that tire killers should be installed wherever possible to stop one-way traffic.

The court expressed concern over the ill-treatment of dogs, cats and other animals in Tollinton Market and gave them 3 months time to shift them to another place.

The court also directed Water and Sanitation Agency (WASA) Lahore to install new meters soon.

Bike scheme for students subject to environmental NOC

LAHORE: The Lahore High Court (LHC) has made the scheme of providing electronic bikes to students subject to environmental No Objection Certificate (NOC).

Justice Shahid Karim of Lahore High Court heard the case against smog and environmental pollution in which the court made the distribution scheme of motorcycles subject to environmental NOC.

Lahore High Court said that not getting environmental NOC before the project is a criminal offence. The  problem of environmental pollution is serious which cannot be ignored.

The court has extended the ban on the balloting for the distribution of electronic bikes among the students.

During the hearing, the court ordered all parks in the city to be fully restored and secured, saying that fines should be imposed to restore and secure the parks.

The court has also ordered to allocate another place for buying and selling birds.

The court ordered the restoration of LDA K7 sports complex and also directed to reduce the fees of LDA clubs.

The court expressed displeasure over the cutting of trees and destruction of the rose garden in the private housing society and ordered the LDA to submit a report on it.

LAHORE: The Lahore High Court (LHC) on Friday directed to impose a fine of Rs 100,000 for wasting water.

The hearing on the petitions filed for smog remedy in Lahore High Court was chaired by Justice Shahid Karim.

The court directed the action in the housing societies to save water and ordered the judicial commission to impose a fine of Rs 100,000 for wasting water.

The court directed to start cleanliness awareness campaign with school children and said that home is not only where we live, this whole country is our home. It is excessive that the laborer works on May 1st and we celebrate the holiday.

Lawyer Lahore Development Authority(LDA) said that illegal activities are also happening in Johar Town area, people have rented houses to banks and cafes, LDA wants to operate and remove illegal activities, cafes.

The owners bring an injunction on which the department cannot act, on which the Lahore High Court said that the department should go to the concerned court and remove the stay-order.

The court said that shopping bags used to be taken from home should still be taken, instructions should be issued to all the DCs to make a procedure to destroy plastic bags, if the deputy commissioner of a district should do anything, the revolution will come.

LHC suspends victory notification of Azhar Qayyum from NA-81

LAHORE: The Lahore High Court(LHC) suspended the notification of the victory of PML-N’s Azhar Qayyum Nahra from NA-81 Gujranwala.

Justice Shahid Karim heard the request of Chaudhry Bilal Ejaz of the Sunni Ittehad Council.

In the petition, the stand was adopted that Chaudhry Bilal Ejaz was declared successful in the February 8 election with 8,000 votes.

The petitioner thought that the Election Commission of Pakistan (ECP) declared the opposition candidate Azhar Qayyum Nahra successful in the recount of votes.

In his petition, Bilal Ijaz alleged that the returning officer had declared Azhar Qayyum the winner by reducing the petitioner’s votes on recounting of votes.

After hearing the arguments, the court suspended the notification of victory of PML-N candidate Azhar Qayyum from NA-81 Gujranwala.

On the other hand, Rana Muhammad Arshad of Pakistan Muslim League-Nawaz(PML-N)  was declared successful in the re-counting in the Punjab Assembly Constituency PP 133.

According to the returning officer, Rana Muhammad Arshad of PML-N got 44,323 votes while independent candidate Mian Atif got 41,632 votes.

Rana Muhammad Arshad of PML-N was declared successful with a margin of 2,691 votes.

It should be noted that the first independent candidate Mian Atif was successful in this contest.

LHC allows markets to remain open till midnight until Eid

LAHORE: The Lahore High Court(LHC) allowed the market to open till 12 midnight and till 1 am on Saturdays and Sunday during Ramadan.

Justice Shahid Karim of Lahore High Court heard the petitions filed for the remedy of smog, in which the court took notice of the incident of misbehavior of a restaurant owner with the judicial commission staff and at the same time the court asked the restaurants for a parking plan.

Justice Shahid Karim said that on the next hearing, “I will summon this restaurant owner to the court, we are working for improvement and everyone should cooperate in this”.

The member judicial commission told the court that trucks of dead chickens arrive in Tollinton market in the morning, dead chicken meat is used in shawarma for Rs 30, health department and food authority have started raids while water from tanneries is spreading in Kasur and no measures are being taken.

On this occasion, Lawyer of Tanneries Association said association is working with  Commissioner and Deputy Commissioner in this regard.

LHC dismisses plea seeking stop Aurat’s March

LAHORE: The Lahore High Court (LHC) dismissed the petition filed to stop the Aurat’s  march as inadmissible.

Justice Shahid Karim announced the reserved verdict on a petition filed by a citizen, Azam Butt. The court had reserved the verdict on maintainability of the petition, after hearing initial arguments, earlier.

The petitioner, through the petition, had impleaded deputy commissioner Lahore and others as respondents.

The petitioner had sought directions to restrain the march, arguing that its banners and slogans were not suitable for Islamic society.

He contended that individuals could approach the court if their basic rights were infringed upon, highlighting constitutional provisions and ongoing efforts for women’s welfare.

LHC suspends notification of fixing drug prices

LAHORE: The Lahore High Court (LHC) has suspended the notification of the Caretaker Punjab government overseeing drug pricing.

Justice Shahid Karim of LHC heard the case regarding fixing the prices of medicines.

It was argued on behalf of the petitioner, Muhammad Aslam, that the caretaker government issued a notification against the law to fix the prices of medicines, after the notification of the prices of medicines, the prices of drugs will increase.

It was argued in the petition that the government is removing the section to fix prices of drugs from the Drug Act but the caretaker government does not have this power.

It has been said on behalf of the petitioner that the public and democratic government is about to come, it can take this step, the current notification is against the constitution and the law, so the court should order the suspension of the notification till the final decision of the petition.

The Lahore High Court, while suspending the notification of the increase in the prices of medicines by the caretaker government, asked the parties including the caretaker provincial government to respond at the next hearing.

In the petition, the federal government and others have been made parties.

LHC orders re-registration of private schools

LAHORE: The Lahore High Court has ordered the re-registration of private schools and the purchase of buses for the students private sector institutes.

Justice Shahid Karim of Lahore High Court has issued a written order on the petitions for smog remedy.

The court directed the school education department to re-register private schools and purchase buses for children, 50 percent of private school children will travel home to school on these buses.

The judgment said that 2 years ago, the school education department was asked to buy buses for private schools, but the school education department did not implement this order.

The court has given instructions to the Motorway, Forest Department, Parks and Horticulture Authority (PHA) and National Highway and Housing Societies, preventing the planting of palm trees on the Islamabad-Lahore Motorway.

In the written decision of the Lahore High Court, it has been said that according to the judicial member, the campaign to plant plants on the roofs has started, plants and gardens are being made on the roofs of the colleges.

LAHORE: The Lahore High Court(LHC) ordered the re-sealing of 84 factories that were desealed in violation of the court order and also indicated action against the responsible officers.

Justice Shahid Karim of Lahore High Court heard the petitions filed for the remediation of smog and environmental pollution.

The LDA lawyer said that 84 factories were sealed on the court order, which has been de-sealed by the Environment Tribunal. The officials responsible for burning crop residue in the Nankana Sahab district have been suspended.

The Lahore High Court has asked for the names of the officers who de-sealed the smoke-emitting factories and kilns.  The court ordered that all the de-sealed factories be re-sealed and showed the order of the Environment Tribunal, and how the tribunal de-sealed the factories. The names of the officers de-sealed should be given.

The court said that action would be taken against all of them under the PEDA Act, if any officer obeys the order of anyone other than this court, then he will be suspended, if something is sealed by a court order, then it will be not be de-sealed by another order.

LAHORE: The Lahore High Court has ordered the closure of private and government schools and colleges on Saturday to control smog.

Justice Shahid Karim of Lahore High Court heard the petitions for the prevention of smog. PHA lawyer Haris Azmat said that the motorcycles of all the employees of the department have been changed to electric motorbikes.

The court remarked that other institutions should also take such steps.

The government lawyer said that a meeting of the members of the Judicial Water Commission with the caretaker Chief Minister will be held on Friday in which other orders including smog will be informed.

The court said that schools and colleges should be completely shut down on Saturdays, and government and private offices should adopt a policy of working from home two days a week. The government had followed this policy two years ago.

The court remarked that smog is no longer a problem in Lahore as it has become a problem in entire Punjab. What action was taken against the Deputy Commissioners in the districts where the air was polluted,  on this, the public prosecutor said that action has been initiated against him.
